George Urciuoli Chairman Vice Chairman Secretary Mr. Michael Hirkala Mr. Charles Cortellino Mrs. Alberta Roe Member Member MEMBER The matter having duly come on to be heard before a duly convened meeting of the Board on the 21st day of April, 198Jind all facts, matters and evidence produced by the applicant,' the zoning Administrator and interested parties having been ,duly heard, received ,and considered, and due deliberation having been had, the following are~the fINDING OF FACT: The applicant has requested a Sp'ecial Use Permit in accordance with Article IV, ~321, '113 in order to permit 'temporary stands for sale and display of field and garden crops grown on the premises and rel~t~d products ie. wine. The subject premises are located in the R-40 district where the Special Use Permit is permitted if the criteria as set forth in the above mentioned sections of the Ordinance (Article IV code of the Town of Wappinger) pertaining to this use have been met. A Short EAF has been submitted as per SEQR requirements and a negative declaration is in order since it appears that there will be no major impact on the environment. THEREFORE, based upon the finding of facts it is hereby ORDERED be and the same GRANTED for a Special Use Permit subject to: 1.) That the applicant will manufacture or sell no more than 1,500 gallons of wine. 2.) The temporary stand or stands for the sale of field and garden crops will open from August 1st of any year to October 1st of any year. 3.) The stand or stands will operate only during daylight hours. 4.) The applicant will only sell home grown grapes and garden crops. 5.) The applicant will file with the Zoning Administrator all the Federal Licenses as well as any State Permits that have been granted to him for the operation of the wine business. .'6.) Premises shall be inspected by the Zoning Administrator every September 1st of any year to make sure that the operation is in conformity with the Special Use Permit and will re-issue a new Special Use Permit each year. THEREFORE, based upon the above findings of fact, it is hereby ORDEREO'-tna"t: the application or appeal be and the same is hereby GRANTED.
