The matter having duly come on to be heard before a duly convened meeting of
the Board on the 9TH day of February and all facts, matters and evidence
produced by the applicant,' the zoning Administrator and interested parties
having been ,duly heard, received and considered, and due deliberation having
been had, the following are~the .
FINDING OF FACT: The above request is anallowabl~ use in the HB-IA zone under
Article IV, ~422. '
A short EAF has been submitted as per SEQR,r~quirements and a negative declaration is in
order since it appears that there will be rio major impact on the environment.
Therefore, based upon the findings of fact it is hereby ordered that the application be
GRANTED subject to the following conditions:
1. The Fire Prevention Bureau shall inspect the premises prior to the issuance of a
Certificate of Occupancy. .
2. Any signs to be located on the premises and/or the building shall comply with the
requirements of the Town of Wappinger Zoning Ordinance.
3. Adequate screening shall be required for the refuse enclosure as determined by the
Planning Board.
4. Waste oil shall be stored in a 550 gallon tank underground. Said tank shall meet the
current Dept. of Environmental Control Regulations. Applicant is to file with the
Zoning Administrator a Certificate of Compliance with the Zoning Administrator.
5. New and old tires will be stored inside the building. There shall be no outside storage.
6. There shall be no storage or sale of any automobiles during the term of the Special
Use Permit or during the term of any renewals.
7. The business it to be conducted on this premises is strictly a repair business such as
tires, mufflers, shock absorber replacement, brakes, tune-ups, lube & oil filters. There
will be no engine washing or engine cleaning.
8. There will be floor pans under each lifte to recover any excess oil spillage so that no
oil gets on the floor ,area.
