The matter having duly come on to be heard before a duly convened meeting of
the Board on the 21st day oiApril. 1981lDd all facts, matters and evidence
produced by the applicant,' the zoning Administrator and interested parties
having been ,duly heard, rece~yed.and considered, and due deliberation havi~g
been had, the following are"-the '.o~' "
fINDING OF FACT: The applicant has reques~ed a Special Use Permit in accordance with Article
IV, ~422, 'INB 417 to allow a car wash along wi~ gas' pimps at the existing service station. The
subject premises are located in the HB-LA ~i~~rictwhere the Special Use Permit is permitted
if the criteria as set forth in the above mentioned section of the Ordinance have been met and
the criteria set forth in the Special Use Section of the Ordinance (Article IV,Code of the YoWL
of Wappinger) pertaining to this use have been met.
A short EAF has been submitted as per SEQR requirements and a negative declaration is in order
since it appears that there will be no major impace on the environment.
THEREFORE, based upon the finding of facts it is hereby ordered be and the same granted for a
Special Use Permit subject to: 1). All water to be used in the car wash operation will be pur-
chased and not pumped out of the existing water system with the exception of 1IIake up water.
2). All water that is used in the car wash operation is to be trucked off the existing site anc
not pumped into the SSDS or public sewer. 3.) All drainage is to be back flowed on the property
Owner is to fully comply with Soil Erosion & Sediment Control Ordinance. 4.)Tbe Zoning Adminis-
trator will have periodic inspections throughout the course of the year. 5.) Premises will be
inspected each year on July 1st by the Zoning Administrator to make sure that the operation is
in conformity with the Special Use Permit and will re-issue a new Special Use Permit each year.
6.) Zonin2 Administrator to mo~itor winter operation to see that there is no hazardous traffic
