was considered and the following action on the request for: [XI A VARIANCE, 0 A SPECIAL USE PERMI'f, 0 AN
INIERPRETATION OF THE ZONING ORDINANCE, 0 AN APPEAL AS AN AGGRIEVED PERSON(S), was
taken:
1. VARIANCE: By resolution of the Board, it was determined that strict application of the Ordinance 0 would 0 would
not produce undue hardship for these reasons:
a. The property in question 0 would 0 would not yield a reasonable return if limited to the use permitted under the
Ordinance, because:

vicinity of the property and in the same use district, because:

At the June 10th, 1986 meeting of the Zoning Board of Appeals, a motion
was made by Mr. Cortellino to deny the requested variance. There was knowledge
of where the building was to be and the applicant should have been aware of the
Zoning Ordinance and what the requirements were, and, therefore, he went into
business, perhaps, thinking that the Zoning Board would grant a variance. There
was no assurance the Board would grant the variance.
Mr. Caballero added that the sign would be to close to the road and would be
distracting because it is illuminated.
The motion was seconded by Mr. Hirkala.

Mr. Cortellino - aye
Mr. Urciuoli - aye
Mr. Landolfi - abstain
Mr. Hirkala - aye
The motion was carried.
