At the April 12th, 1983 meeting of the Zoning Board of
Appeals, a motion was made by Mr. Cortellino, that another
public hearing be held. The motion was seconded by Mr. Caballero.

Mr. Cortellino - aye
Mr. Urciuoli - aye
Mr. Caballero - aye
Mr. Landolfi - aye
The motion was carried.
Mrs. Waddle then advised Mr. Zablocki to see Mr. Gunderud
about getting on the docket for next month for a public hearing
so the property owners can be notified again.
She further advised that the Board has a new set of
rules they are operating under now.

As per our phone discussion, attached are copies of the Special Use
-Permit, Zoning Board of Appeals resolution, 1963 ?nd 1980 zoning
Sections 437 and 438 respectively and the 1979 resolution adopting
the-Zoning Ordinance.

My interpretation is that the provisions of the 1979/80 Ordinance
be adhered to, i.e. the Special Use Permit expired since no work
has commenced to date.

Dear Hans:
After further reviewing the above matter, I would take the
position that any rights as to the special use permit expired
when the zoning ordinance was superceded by a subsequent zoning
ordinance unless it can be demonstrated that the holder of the
permit prior to that time took some steps in reliance upon the
permit. An argument can be made that the existence of the
prior special use permit rose out of and existed only under the
provisions of the prior zoning ordinance; once that zoning
ordinance was superceded, a new permit would be necessary.

to the Special Use permit. violations of said conditions could
result in revocation of the special Use Permit.
11. Should tenancy for the medical offices bE~ unavailable,
use of the property must revert back to residential use
pursuant to Section 421 of the Town of ~'iappin';er zoning
