Y. 121590 TEL.. 2g7.82!58 March 22, 1982 Frank Bruno Horizon #3 Fort Lee, New Jersey 07024 RE: Illegal use at property on Diddell Road and Route 376 Dear Mr. Bruno: ! ~ .~ ,~"' ~ I have been aware that you have permitted a Universal Cash Register showroom/sales business to operate out of the section of your building that was formerly occupied by Bunker Hill Realty. i ( Under present zoning (enacted March 10, 1980) the property was changed from PI (Planned Industry) to R-40 (one acre - residential) .~The realty office and single-family residence constituted a non-conforming use. That use was im.prope~ly established from a prior non-conforming use; i.e. John Darrowmonurnents and a single-family residence (which had been issued a Certificate of Occupancy in 1966). The present regulations pertaining to non-conforming uses do not allow for the change of a non-conforming use, except to a fuliy conforming use. Therefore, the residential use and showroom/sales combination is not permitted and must be discontinued. There are many single and/or compatable uses permitted in the R-40 zone. Enclosed is a listing of these uses, as well as a variance application if you desire to appeal my decision and seek a variance from the Zoning Board of Appeals. I have also informed your tenant that portable kerosene heaters are illegal uses in places of business and in the Town of Wappinger and directed the use be immediately discontinued. , t;' , .
