The Regular Meeting of the Town Board of the Town of Wappinger was held
on August 30, 2004, at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York. Supervisor Ruggiero opened the meeting at 7:30 p.m.

RECEIPT & APPROVAL OF MINUTES
The Minutes of the Town Board Meeting of July 26, 2004 having previously
been forwarded to the Board Members, were now placed before them for
their consideration.
Councilwoman McCarthy moved to accept the above stated Minutes as
submitted by the Town Clerk, seconded by Councilman Bettina and
unanimously carried

DISCUSSIONS:
• Community Center Progress -Don Swartz announced that since he was
here last he responded to comments from the DEC regarding one of his
earlier sketch plans for the proposed Municipal Building. DEC had
some concerns with the position of the building as it was originally
proposed into the designated wet lands. Since then, Mr. Paggi has
had the wet lands delineated. Don also went over the map that was
presented to DEC and explained the revised layout to the Board
Members. DEC approval has been given and we can now proceed with
the next step. Mr. Paggi explained that the one item DEC had some
concerns with, was the Storm Water Management Plan. When the
original Town Hall Complex was built there was no plan in place to
manage the run-off that was generated from the building to the

parking area and they requested, when we prepare the Storm Water
Management Plan for the Community Center, to incorporate the entire
site into a comprehensive plan. He advised the DEC they would, and
do it under the proposed paved areas. The DEC also suggested a
pedestrian bridge from the west part of the parking area over the
finger of wet land would be an appropriate way of getting people from
point A to point B. Supervisor Ruggiero informed the Board that he
was invited to a meeting with some other municipalities regarding a
possible joint YMCA that may phase in the Town of Wappinger. It
may be a collaboration between Wappinger, Fishkill, East Fishkill and
the YMCA, so before he attends that meeting he does not wish to
authorize Don to go forward.
Councilman Valdati moved to place this report on file, seconded by
Councilman Bettina and unanimously carried.
Cranberry Update— Councilman Valdati wished to know if there was
going to be a referendum for Cranberry. Supervisor Ruggiero
explained that we are waiting for the second appraisal so we may not
be able to meet the deadline in September in order to get it on the
November ballot. We may have to have to hold a Special Election for
Cranberry.
Intermunicipal Traffic Committee—Councilman Valdati wish to
address the traffic situation in the surrounding communities. He
would like the Board to send correspondence to the surrounding
communities asking if they would be interested in working together in
solving some of the issues. Supervisor Ruggiero explained that there is
a committee that exists at the County called the Poughkeepsie
Dutchess Transportation Council which he sits on as Supervisor as
well as Supervisor Pagones, the Village Mayor as well as DOT, and
County Planning. They work to help set the moneys that are received
from the Federal Government through Albany through the County to
allocate projects such as the Route 9 widening, and the Newburgh
Beacon Ferry.

RESOLUTION TO AUTHORIZE A PUBLIC HEARING ON THE USE
OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS

WHEREAS, the Dutchess County Department of Planning and Development
is soliciting applications for the 2005 Community Development Block Grant
Program; and
WHEREAS, the Town of Wappinger is required to hold a Public Hearing to
discuss the Town's intended use of Community Development Block Grant
funds in furtherance of applying for said funds.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this

2. The Town Board hereby schedules a Public Hearing for all
parties in interest and citizens to have an opportunity to offer
comments and suggestions on the Town's intended use of
Community Development Block Grant Funds for which the

Grant Program said Public Hearing to be held at Town Hall, 20

RESOLUTION NO. 2004-248
RESOLUTION INTRODUCING LOCAL LAW NO. OF THE
YEAR 2004, DESIGNATING A STOP INTERSECTION ALONG DEER
RUN AND VORNDRAN DRIVE
The following resolution was introduced by Councilwoman McCarthy and
seconded by Councilman Valdati.
WHEREAS, Town Highway Superintendent, Graham Foster, by letter dated
June 29, 2004, attached hereto marked and designated as Exhibit "A", has
recommended that the Town install a "stop sign" and establish a full stop

intersection at Deer Run at its westbound intersection with Vorndran Drive;
and
WHEREAS, the Town Board has elected to create a full stop intersection at
Deer Run at its westbound intersection with Vorndran Drive; and
WHEREAS, the Town Board, in accordance with the recommendation of
Town Highway Superintendent, Graham Foster, directs the placement of the
"stop sign" on Deer Run at its westbound intersection with Vorndran Drive to
be located at the northeast corner of the aforesaid intersection; and
WHEREAS, this is a Type II action pursuant to 6 NYCRR 617.5 (c) (20) and
is otherwise exempt from environmental review pursuant to the New York
State Environmental Review Act (SEQRA).
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this
Resolution as if fully set forth and adopted herein.
2. The Town Board hereby introduces for adoption Local Law
No. of 2004 in the form annexed hereto.
3. The Town Board hereby determines that the enactment of the
aforementioned Local Law is a Type II action as defined in 6
NYCRR 617.5 (c) (20) and, accordingly, the Town Board hereby
expressly determines that this action is not an action that
requires review pursuant to the provisions of New York State
Environmental Review Act (SEQRA) or pursuant to Local Law
No. 6 of 1992 or pursuant to 6 NYCRR Parts (17).
4. The Town Board hereby schedules a Public Hearing on the
Proposed Adoption of Local Law No._ of the Year 2004 to be
held at Town Hall, 20 Middlebush Road, Wappingers Falls, New
York on the 27th day of September, 2004, at 7:30 p.m., and that
the Town Clerk be directed to post and publish Notice of the

as per a letter dated August 17, 2004, a copy of which is attached hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth ate incorporated in this
Resolution as if fully set forth and adopted herein.
2. The Town Board hereby approves completion change order No. 1
for Wappinger Sewer Improvement Area No. 4 in the amount of
Eight Thousand, One Hundred Seventy-five Dollars and 00/100
($8,175.00) for the reasons set forth in the letter dated August

RESOLUTION NO. 2004-259
RESOLUTION ENDORSING EFFORTS OF THE ASSOCIATION OF
TOWNS OF THE STATE OF NEW YORK TO ALLOW LOCAL
GOVERNMENTS TO RETAIN FINE REVENUE
The following Resolution was introduced by Councilman Valdati and
seconded by Councilwoman McCarthy.
WHEREAS, New York State Governor George Pataki's 2004-2005 Executive
Budget proposal includes provisions relating to the disposition of Justice
Court fines pursuant to Section 1803 of the Vehicle and Traffic law of the
State of New York; and
WHEREAS, the aforementioned proposed Executive Budget provides that
only fines or penalties associated with a violation "with which the Defendant
was originally charged" would be returned to local governments; and
WHEREAS, the New York State Association of Towns estimates that more
than $12.5 million dollars in fine monies would be shifted from local
governments to the State, which will result in increased real property taxes
caused by local governments seeking to mitigate budgetary shortfalls; and
WHEREAS, G. Jeffrey Haber, Executive Director of the Association of Towns
of the New York State, by letter dated August 12, 2004 (with attachment) to
Supervisor Ruggiero, a copy of which is annexed hereto as Schedule "A", has

requested immediate action to urge Governor Pataki to restore the
aforementioned fine revenue back to local governments.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this
Resolution as if fully set forth and adopted herein.
2. The Town Board of the Town of Wappinger endorses, encourages
and supports the efforts of the Association of Towns of the State
of New York to urge Governor Pataki to restore fine revenues
distributed pursuant to §1803 of the Vehicle and Traffic Law of
the State of New York to local governments and otherwise
opposes Governor Pataki's 2004-2005 Executive Budget proposal
as it pertains to the disposition of Justice Court fines, as more
particularly set forth in Schedule "A".
3. The Town Board by adoption of this Resolution also endorses the
position taken by the Association of Towns of the State of New
York in its letters dated March 15, 2004 addressed respectively
to Senate Majority Leader, Joseph Bruno, and Speaker of the
House, Sheldon Silver, copies of which are annexed hereto
marked as Schedule "B" and "C", respectively.
4. Town Clerk, Gloria Morse, is directed to send copies of this
Resolution to Governor George Pataki, Majority Leader Joseph
Bruno, Speaker Sheldon Silver, Senator Stephen Saland, and
Assembly Joel Miller.

RESOLUTION AUTHORIZING BUDGET AMENDENTS
The following Resolution was introduced by Councilwoman McCarthy and
seconded by Councilman Valdati.
WHEREAS, the Comptroller to the Town of Wappinger, Gerald A.
Terwilliger, has recommended certain budget transfers hereby amending the
Town budget as set forth in a letter dated August 25, 2004 from Gerald A.
Terwilliger, Comptroller, to the Supervisor and Town Board Members.
1. General Fund -Budget Amendment
Increase A3005 Mortgage tax $70,000.00
Increase A3089 Other State Aid $25,000.00
Increase A1420.400 Attorney Fees $50,000.00
Increase A1660.400 Central Storeroom $4,000.00
Increase A1670.400 Central Printing/Mailing $5,000.00
Increase A1910.400 Unallocated Insurance $15,000.00
Increase A1940.400 Purchase of Land $25,000.00
To Increase anticipated mortgage and to increase budgeted
attorney fees, central storeroom, central printing/mailing and
allocated insurance to cover anticipated expenditures for the
balance of the year. To adjust budget for purchase of Smithtown
Road property.
2. Ambulance Fund -Budget Amendment
Increase AM4540.100 Personnel Services $6,000.00
Increase AM4540.200 Equipment $1500.00
Increase AM4510.410 Office Supplies, est. $750.00
Increase AM0599 Appropriated Fund Bal. $8,250.00
To Adjust Budged for hiring of Emergency Services Coordinator as
per Town Board July 26, 2004.
3. General Fund -Part Town Budget Amendment

2. The Town Board hereby authorizes the following budget transfers
hereby amending the Town of Wappinger Budged adopted for the
calendar year of 2004.
The foregoing was put to a vote which resulted as follows:

Vincent Bettina, Councilman Voting Aye

The Resolution is hereby duly declared adopted.
NEW BUSINESS
Councilman Valdati wished to have any calls that are received at Town Hall
from constituents be logged in for the appropriate councilmember .
Councilman Bettina wished to thank the Zoning Administrator for looking
into the stagnate water situation in Chelsea.. Mr. Bettina was contacted by
Pop Warner. They are looking for property to play on, and he would like
recreation to look into it. Supervisor Ruggiero replied that we have had
discussions with Pop Warner about locating property we are trying to work
with other municipalities. Councilman Bettina also wished to thank Jay
Paggi for his recommendation for the placement of a Stop sign on Booth
Boulevard
Councilwoman McCarthy wished to thank the Town Board for the flowers
they sent in memory of her brother in-law who recently passed away.
Councilman Valdati wished to know the status of the Village Building
Inspector. Supervisor Ruggiero replied, "We are going into Executive Session
to discuss the Village Building Inspector issue."
Councilman Bettina recommended we could contact the New York State
Assessors Association on our search for an assessor. Supervisor Ruggiero
explained he would like to make that appointment soon. "We did several
interviews several weeks ago prior to my going into the hospital and took no
action. We should follow up with those people. It wouldn't hurt to conduct
more interviews."
Councilman Valdati said that during the past decade we have instituted
sewer improvements for the Town. Since the Village and Town of
Poughkeepsie are part of Tri -Municipal, moneys have been exchanged. for
each of the phases. He wished to know from Mr. Paggi, approximately, how
much money the Town has bought into for each of the three phases. Mr.
Paggi replied that over a $1 million would be a total number, and the Village
portion of that would be approximately 71%. Councilman Valdati requested
Mr. Paggi to forward him the costs of Phases 1,2 and 3A.

At this time 8:10 p.m., Councilman Bettina moved to go into Executive
Session to discuss Alamo Ambulance, the Village Inspector issue and
Resolution No. 2004-250; seconded by Councilwoman McCarthy and
unanimously carried.
The meeting reconvened at 10:20 p.m. with all Board Members in attendance
except Councilman Paoloni. There was no action taken in Executive Session.
Councilman Valdati moved to close the meeting, seconded by Councilwoman
McCarthy and unanimously carried.
The meeting closed at 10:20 p.m.
