Garofalo Smith Crossing Road Wappingers Falls, New York 12590 RE: Caretaker's cottage and mobile home on Jul-Fran Farms Dear Dr. & Mrs. Garofalo: As per our discussion in my office last week, you agreed to apply for a building permit for a garage with a caretaker's cottage by February 15, 1981 and I will allow the mobile home to remain until completion of the new quarters as per . section 415.3 of the Zoning Ordinance. Building a cottage for help would be an undue hardship because of the following: We do not own the access road road ~nd have little orosnect .. . of recei'ling word from the railroad about this sale. This could take a year or so according to ray lawyer. This is a 1;lell known problem in this area. It would be impossible to build on Smith Crossing Road because of a large swamp and we ca:.'1not build on i.'Ialoney Road because it is too far from the barns. Inflationary coasts have exhausted all our resourses unexpectantly. It would be a fatal move to try to build anything else. Our large fa~ily requires our income for their education, seven children in colleges and professional schools for whom we are their only support. The hardship that would be created if t~is petition is denied is related to the problems of raising thoroughbred horses. Unlike cold blooded horses, thoroughbreds require consta,::1t care and protection by their handlers. They are prone to injury anc illness~ Careful ettention is re quired by help living on tt_e premises. They also need lc"~rge ereas for grazing and exercises a:ld to be carefully watched. They must be taken into the barn twice a day. They must be protected against vandals and theft. There has been se"veral cases of thoroughbred thefts, most recently, horses stolen from a throughbred farm in Somers and recovered by the F.B.I. Durinf; foaling season v;hich lasts approximately six months, we need several men to assist the mares to avoid injury and deathto both foals and mares. This is u:1ique Vii tl1 thoroughbreds vihich are highly imbred and charactertically have difficulty in delivery. F Breeding of ;nares during the spring also re quires several handlers because the :r.are and stallion must be held and handled durin; breeding process. Horsemen must be on the property for a successful breeding progra~. Our situation is unic;,ue because we are the only thoroughbred horse far~ in our area, as far as we know. Our neighbors do not recuire specialized help as we do. J. If these animals were to be lost through neglect, injury or theft because of the lack of total protection t'wenty-four hours a day our losses would be insurmontable. Replacement in these inflationary times would be impossible and our life t s \o'lOrk and dree.ms would be destroyed. We are too old to handle these lli~predictable animals and injuries to ourselves would ensue. Without livein help we would have no alternative but to quit. Our farm contributes to the econo~Y of Wappingers Falls in these days of hardship. We employ local help to drain the iatid, plant new grazing area, build fences, barnes and a ho~e. We have spent many thousands of dollars in local l~~beryards, hardware stores and supply houses all in Wappingers Falls. \'le have also spent many thousands of dollars in salaries given to local residents. We have spent many thousands of dollars for gravel, fuel, horse feed and supplies, hay, etcera, all from local merchants. \'Ie expect to contLm.e to spend our money in Wappingers Falls, and are happy to participate in COiJ.rnuni ty affairs and business. The mobile home is near the barn and a new structure would have to be built on smith Crossing Road (in the S\'i8.mp) or Maloney Road which is a considerable distance from the barns and horses. The mobile home is located more that 1500 feet away from Smith Crossing Road a.nd more than 3000 feet from Haloney Road and more than 2000 feet from the rear of the property line v!here there is a ten acre heavily wooded area. It is located -almost in the middle of 140 acres. It is unobtrusti ve, '\'Tell built, has a good appearance but is not visible from the ,road or is it in the sight of any neighbor. The horse farm we have built at great cost' and sacrifice has complimented the neighborhood and has-only improved adjacent property 'ralues. Many people have told us how happy they are that the land has been rescued from bands of motarcylicts that were destroying this site. ~hese maurauding groups of people caused noise pollution and distress arnong neighbors. 'Vle are beautifying the excess roads and h,ave deepened the five lakes on the property for water fowl, wild turkey, phease~~t and deer. Pl<:mting of trees and shrubs and grazing lands is already in progress. .We have consulted v.i. th the agriculturial agent on Route 44 in reference to the above. Our ain is to improve the Enviroment and protect the ~;ild life \'ihile persueing our interest in horses. Granting the variance to keep the mobile home permanently vlQulct not increase the value of the land and it will not reduce the value of the land nor would it affect the value of our neighbors property.
