A Variance

A few years ago , our neighbor had a t~o bedroom and bath
dormer added to their home to take care of their needs. At tiat
time, all three houses in this area were zoned ~-20 t acre,
until lIB _ 2 'Was put in on Uareh 26, 1980. This home has been
our residence for 19 years.
Our addition would not change the character of this district
because it will have the same exterior as tr~ preeent house.

be tabled for further review. Seconded by Mr. Cortellino. Vote

referred to the Planning Board. Seconded by Mr. Cortellino. Vote
was unanimous.

Appeal #54~ - Mr. Landolfi made a motion that this appeal be
denied. He pointed out that a guest house is exactly that, for
guests who are normally those individuals having a transient status
rather than a permanent status. Transients do not normally require
full kitchen facilities. Seconded by Mr. Cortellino. Vote was
unanimous.
The meeting was adjourned at 10:00 p.m.

Re: Parkton Variance Request
In accordance with the provisions of General Municipal law (Article 12B,
Sections 239-1 and 239-m), the Dutchess County Department of Planning
has reviewed subject referral and upon analysis, makes the following
findings:
1. The applicant is seeking a variance to allow an addition for a
residence in a district zoned HB-2A (Highway Business). Section
422, "Schedule of Regulations for Non-Residential Districts,"
does not provide for residences in the HB Zone. The applicant is,
therefore, seeking a "Use Variance."
2. The procedure by which zoning districts and regulations are
established and amended is a legislative function, By varying
uses within a district, an administrative agency runs the risk
of illegally assuming this function and making a decision contrary
to the "1egis1ative intent" of the zoning ordinance. In light
of this, the Dutchess County Department of Planning recommends
denial of the proposed use variance.
The Dutchess County Department of Planning does not presume to base
its decision on the legalities or illegalities of the facts or pro.
cedures enumerated in subject zoning action.
