We, the undersigned, are requesting your permission to divide our present
business known as Dick's Fine Foods, into two different businesses. One
being the present business, Dick's Fine Foods and the other being a
Real Estate office. I have been in Real Estate for a few years and feel
this is the time to open my own office.
As you probably are aware, Route 376 is being made into three lanes
and we have been informed that a curb will be placed in front of our
property extending from the corner of All Angels Hill Road across the
front of our property to the left side of our btilding with one entrance
and exit. Therefore, no one can enter the parking lot coming from
All Angels or New Hackensack going East unless they go completely
in front of the store. Traffic will be just one way and we are certain
this will impair our business at Dick's Fine Foods considerably.
Inasmuch as the Real Estate business will only serve customers by appoint-
.ment, there will not be an excessive amount of traffic coming from our
area. The addition of Real Estate will not increase the amount of parking.
I would greatly appreciate having your approval to establish this Real
Estate office as soon as possible.

In accordance with the provlslons of General Municipal Law (Article 12B,
Secti ons 239-1 and 239-m) ,. the Dutchess County Department of Pl anni ng haf.
reviewed subject referral with regard to pertinent inter-community and
county-wide considerations. Upon field investigation and analysis, this
Department makes the following findings:
Applicant seeks a variance to divide an existing business into two different
businesses. Subject property is located at the intersection of Route 376,
New Hackensack Road and All Angels Road. This property is in a General
Business Zoning District. The General Business district regulations do not
allow multiple business uses on a lot.
A more appropriate mechanism for this type of change is the zoning amendment
process. The zoning amendment process provides for a comprehensive evaluation
of zoning changes. A variance, on the other hand, would apply only to one
specific property.
Recommendation
In view of the above findings, the Dutchess County Department of Planning
recommends that this variance application be disapproved. An evaluation of
the impact of the entire zoning district should be made in evaluating this
type of change. Changes should then apply to all properties in the zoning
district rather than an individual property.
The Dutchess County Department of Planning does not presume to base its
decision on the legalities or illegalities of the facts or procedures enumer-
ated in subject zoning action.
