RE: Lot 21 _ Agreement Meeting for'conditions Prior to C.O.
Dear Mr. Croniser:
The following agreements were made, relative to the requirements for a
C.o. on lot 21, on August 11, 1980 between you, William P. Horton,
Rudolph E. LaPar, Mr. Gadionniex, Mr. Sanchirico and myself:
1. All rock, gravel, stumps and other materials on Mr. Gadionniex's
property that were removed, placed or otherwise deposited as a
result of construction on lot 21 will be removed and the original
ground level will be re-installed, particularly from the beech tree
and up.
2. TO proptect future erosion or deposition of rock, soil, gravel, etc.
on Mr. Gadionniex's property from the beech tree to the front
property line, that area will be graded, (to a stable contour and
condition) top soil placed and a ground cover planted (crowned vetc1',
or equivalant).
3. The driveway will exceed 15% and will still require a variance prior
to issuance of a C.O., but the design of the driveway will be such,
that it will pitch into the hill, for run-off and in an effort to
prevent a car from sliding over the outside edge in case of a
slippery condition.
4. The driveway will be blacktopped.
5. There will be a parking area added on the property, at the bottom
of the hill, so that at least two cars can be parked off Town right
of-way. No area of the parking or access to it, shall be greater
than 4% grade within 35' of the center line of park Hill Drive or
greater than 12% grade from the 35' point and in, unless variance i
granted.
6. Boulders, sufficient in size to prevent a vehicle from penetrating

through, shall be placed from the beech tree and down to the
property line, on the outside edge of the driveway with a
maximum open space between them of three (3) feet and at least two
feet (2) of the boulder is to protrude above the ground level of
the edge of the driveway.
For the record, these conditions are imposed upon you because you did not
follow the approved preliminary plot plan you submitted to receive a
building permit. The cerified plot plan showed that:
1. The house would be 144' back (it actually is 100')
2. The sideyard(to lot 19) was to be 40' (it is 28')
3. The driyeway was to.be cut into the hill 2' to 4' in its upper
half area instead of being raised above~ the existing grade .

4. The fill shown on the lower half of the driveway was to be less
than 2' (6' to 8' of fill was placed.
5. . A foundation survey was required prior to framing - none was
submitted
6. A note was added to the plot plan(by me) that lot 19 was to be
"protected from drainage during construction from erosion and
materials" but inspection during our referenced meeting , it
was obvious that materials were on lot 19 as a result of your
construction on lot 21. .. . .
I think it is obvious that we, the Town of Wappinger, want 'to control
building in our Town and when plans are submitted for a permit, it behooves
the applicant to adhere to the approval given. We all realize that field
conditions occasionally require amendments to the submitted plans, these
will be considered and every effort will be made to accommodate the
applicant. An applicant who ignores or violates our rules will be handled
accordingly.

RE: Lot 21, site inspection
Dear Mr. Croniser:
My footing inspection today revealed that the house will be placed'
on the lot at approximately 115 feet (instead of the proposed 144 ft.)
front yard setbacks, although this set back does meet zoning requirements, .
I have determined that the driveway grade will exceed the permitted 15%.
I will not be able to issue a Certificate of Occupancy unless the drive-
way conforms or other measures are taken by you to build wi thil! the
local requirements.
As per your verbal instructions I will submit your Notice of Appeal to
the Zoning Board of Appeals for a variance.
