Re: Locke Variance Request (Second Application)
The Dutchess County Department of Planning has reviewed subject referral
within the framework of General Municipal Law (Article 12B, Section 239-1
and 239-m) and finds essentially as it did in Referral 80-147, that the
decision in this matter primarily involves matters of local concern.
The appl i cant requests a vari.ance from the requi rement that a bui 1 di ng
lot have frontage on a public road. Subject property is approximately
2,000 feet from Stoneykill Road.
The Dutchess County Department of Planning, therefore, reiterates its
recommendation that the decision be based upon local study of the facts
in the case. Consideration, however, should be given to problems of pri-
vate roads. As more houses are built, the residents will request the
Town to take over the private road. If the Town does take over the
road, the Town road system thus gains an unplanned often unimproved
addition which mayor may not relate to the plans for land use and
transportation in that area and may require extensive reconstruction
at public expense.
The Dutchess County Department of Planning does not presume to base its
decision on the legalities or illegalities of the facts or procedures
enumerated in subject zoning action.
