PRETATION OF THE ZO~IING. ORDINANCE, DAN APPEAL AS AN AGGRIEVED PERSON (5) . (check
a. A VAR~CE IS REQUESTED for- the following reasons:
1) strict application of the zoning Ordinance would produce undue
hardship because: The Appellant can not have a free standing sign
in fron~ of his building without placing it in the paved areaS,
as per section 416.73 of the zoning law which requires a 25' .
setback from the property line.
2) The hardship created is unique and is not shared by all properties
alike in the immediate vicinity of this property and in this district
because: Most of the properties along Route 9 fall into one of
two categories: They were either built prior to zoning, or prior
_to the widening of Route 9. therefore, either the sign or the building
_is more visible to passing traffic than ours. Many of the others are

change the characte:r: of the district because-: This is a business
zone, and all of the existing businesses already have signs, I feel
that placing a tasteful free standing sign in an appropriate location,
such as the grassed area in front of our property would not be a
noticeable change in the character of the district.
