RE: Schmidtke Store on Middlebush Road, Town of Wappinger, N.Y.

Under Section 416.01 of the Town of Wappinger Zoning Ordinance,
the Schmidtke store is a legally non-conforming use ina residential
zone. Also under Section 416.33 such use may be changed only to a
similar use or less non-conforming, as determined by the Zoning
Board of Appeals.
As Zoning Administrator, I would conclude that the proposed change
from a meat store and grocery to a place serving food and beverages
and grocery is a similar use, in that all those uses appear in
paragraph 2 under Permitted Principal Uses, LB District, Section 423.

I enclose a notice of appeal on behalf of Mrs.
Schmidtke, requesting an interpretation by the Zoning
Board of Appeals with respect to the proposed use of
the present business portion of the premises as a
restaurant and a place to serve food and beverages.
I trust that it is in proper form. If there is a filing
fee, kindly let me know and I shall remit.
It is my further understanding that the Board will
meet on February 5, 1980, at 8 p.m. at the Town Hall.
The representative of this office will be present.
