At the present time my father (William H. Powel I) resides in
Schenectady, N.Y. He wil I be 84 years old in July and should not live along
any longer. I do not want him to go to a nursing home. I feel that I would
I ike to take care of him during his remaining years.
Our house is too smal I to provide a comfortable living quarters for Dad.
We had thought about requesting to put an addition on to the house. However,
we felt that this was a permanent variance and really we just want a separate
apartment for Dad. A trailer would be just the answer. We would like to place
it on the other side of our driveway so that there would be just one driveway
to take care of.
We will be wil I ing to extend our stockade fence so that the trailer will
not be visible from the road. The lot on which our house Is situated is
approximately 1 acre. However, we own the lots on both sides and the side
where we would put the trailer Is wooded.
If there are any other questions please contact me. My father is in
the process of sel I ing his home in Schenectady and it is important tha;'
have a place for him by spring. His health has been fai I ing and I have had
to go to Schenectady quite often to check on him and see that he has
groceries etc. It Is therefore imperative that he comes to I ive with us.
We had also thought of an apartment, but he isn't able to take care of
an apartment.

The regular meeting of the zoning Board of Appeals of the
Town of Wappinger was held on Tuesday, March 11th, 1980, beg~nning
at 8:00 p.m., at the Town Hall, Mill street, wappingers Falls,
New York. '

The Chairman then a~ked the secretary if th~ Appellants
and abutting property owners had been notified.
The secretary replied that Mrs. Christensen, who filled
in during her vacation, had sent the notices out.
The Chairman then explained that it was the procedure of the
Board to hear all the cases, take a short recess then reconvene at
which time the Board mayor may not render a decision on each case
but either way the appeallants would be advised. Mr. Landolfi
also noted that everyone will be given an opportunity to be
heard and that they should aive their names and addresses and
present facts.

PUBLIC HEARINGS:
Appeal # 458, at the request of Nay and George Van De Carr,
seeking a variance of Article IV, Section 421 of the Town of Wappinger
zoning Ordinance, to permit a mobile home to be placed on their
property located on 21 Roberts Road, being parcel # 6257-01-086899,
in the Town of Wappinger.
The Chairman read the legal notice.
Mrs. Mary Van De Carr was present.
Mrs. Van De Carr presented the Board with a layout
property and noted that they ~ere asking for permission

old and is becoming incapacitated and they did not have
him in the house, and that there would be 135 feet from

added that they only wanted the traiter for her father as he
has to have a hip operation and this would allow her to be
able to look in on him yet he would have privacy.
Mr. Cortellino asked about the total acreage.
Mrs. Van De Carr replied that they have about four acres,
500 some feet frontage, and the trailer would not be seen on the
l~ acre parcel.
Mr. Cortellino then commented that the trailer would not be
permanent.
Mrs. Van De Carr replied that it would be for her father
only, for his use and that they did not ~ant to add onto their
home as this would be permanent.
Mrs. Waddle then asked how many there were in the house.
Mrs. Van De Carr replied herself, her husband and daughter
and the extra room is only 6' by about 7~'.
Mr. Prager then asked if it would be a new trailer.
Mrs. Van .De Carr replied that it would be basically a
new type, her father wants to keep his 0\'.-::1 furniture and are
looking for two bedrooms as one could be used as a ~en, smaller
size, we do not want a big trailer.
Mr. Landolfi then asked Mrs. Van De Carr if here father will
be able to care for himself.
Mrs. Van De Carr replied that he has one artifical hip now,
he walks with a cane and that operation was very successful.
The Chairman then asked if there was anyone present who
wished to be heard for or against the Appeal.
Mr. Ernie Prassel noted that he lived on the corner of
Spook Hill Road and Roberts Road and had some questions, two
bedrooms, would it be around 55 feet.
Mrs. Van De Carr replied that they wanted as small a trailer
as they could get.
Mrs. Waddle then asked if it would be a camper-trailer type
or a mobile home which would be from 55 feet to 60 feet.
Mr. prassel then asked if it would be on a permanent foundation.

Mrs. Van De Carr replied that it would be a mobile home,
they would just be putting skirting around, if it,is visible
they would continue the redwood fencing or it could be put
back further on the property and that her father is 84 years old
and would want the trailer only as long as he needs it.
Mr. Landolfi noted that the trailer would have to be
setback at the minimum distance for that zone, and then
asked Mr. prassel if he had an objection.
Mr. prassell noted that he did not want to see the area
depreciated, one presently exists in the area and it is an
eyesore.
Mr. cortellino noted that if the variance was granted, as
part of the variance when the use ceases the mobile home would
have to be removed.
No one else present wished to be heard.
The hearing was closed at 8:13 p.m.
Appeal # 459, at the request of the Nes company (Cross Courts),
seeking a special use permit pursuant to section 423, District AI,
paragraph 1 of the Town of Wappinger zoning ordinance, to permit
them to construct outdoor tennis courts, a swi~~i~g pool a~d snack
bar on their property located on New Hackensack Road, consisting
of six acres and being parcel # 6258-01-081999, in the Town of
\vappinger.
The Chairman read the legal notice.
Mr. Kenneth C. Russ of Richard G. Barger, P.E. & L.S.'s office,
and Mr. Ronald Netter, president of the Nes Company and owner of
the property, were present.
Mr. Landolfi asked if they would be hiring' additional people.
Mr. Netter replied that they would be hiring one extra person
fo~ the restaurant (fast food - snack bar) and when the pool goes,
although that won't be this year, we would have one lifeguard with
perhaps two more part-time, SO there might be a maximum of four
people.
Mr. Russ noted that there would be no lights installed, this
is as a good w~ather supplement, in the summer people will be able
to play outdoors, there will be five double courts for a total
of ten courts.
Mrs. Waddle asked where the pool would be.

Mr. corte1lino suggested that it be bought contingent upon
getting a variance later on.
Mr. Barbato noted that there had been a trailer on the
property before.
Mr. Me Millen then asked if they maintained the property
next door.
Mrs. Barbato noted that it is now about 7/8th of an
acre, the state took land from both pieces.

The Chairman then asked if there was anyone present who wished
to be heard for or against the Appeal.
No one present wished to be heard.
The hearing was closed at 8:50 p.m.
The Board then recessed and then reconvened at 9:40 p.m.
with regard to Appeal # 458, at the request of Mary and George
Van De Carr, a motion was made by Mr. cortellino, seconded by
Mrs. Waddle, to grant the requested variance with the stipulation
that it will be reviewed annually.
Motion Was Unanimously Carried
with regard to Appeal # 459, at the request of the Nes company,
a motion was made by Mrs. Waddle, seconded by Mr. Mc Millen,
to recommend that the Special Use permit be issued and that site
plan approval be obtained from the TOwn of Wappinger Planning Board.

with regard to Appeal # 460, at the request of Dennis K.
Henderson, a motion was made by Mr. prager, seconded by Mr. Mc Millen,
to grant the requested variance.

Mr. Me Millen read that it was the interpretation on the zoning Board
of Appeals that they deter~ine that the proposed use is similar to
