The Special Use Permit is granted subject to the following
conditions:
1. The hours of operation shall be 9:00 a.m. to 11:30 a.m.,
Monday through Friday, September to June according to the
Wappinger Central School District schedule.
2. Enrollment shall be limited to twelve children.
3. A portion of the back yard shall be fenced as a play
area and the size of said play area shall be in accordance
with the requirements of the Dutchess County Department
of Health.
4. The Planning Board shall review the parking on the site
within six months of operation.
5. No advertising signs shall be erected on the property.
6. The New Hackensack Fire Company shall inspect the premises
prior to the issuance of a Certificate of Occupancy.
7. The Special Use Permit is issued solely to Lois C. Witham.
At such time as Mrs. witham ceases to have the nursery use, the
Special Use Permit would no longer be in effect.

Subject: Application of Lois witham for a Special Use Permit
to operate a Nursery School on her property located
on 19 cider Mill LOop, in the Town of Wappinger.
At their June 2nd, 1980 meeting, a motion was made by
Mr. Fanuele, seconded by Dr. Miller, to recommend the issuance
of a Special Use Permit with the following conditions:
1. A portion of the back yard be fenced as a play area
and the size of said play area shall be in accordance
with the reguirements of the Dutchess County Department
of Health.
2. The parking on the site be reviewed within six months
of operation.

Comments to Witham Special Use Permit
. May 28, 1980
1. I feel either fencing should be required as part of the approval
or a stipulation that fencing may be required in the future if the
zoning Administrator finds a problem exists without fencing.
2. I feel that the parking should be improved in that it will be
impossible for cars to turn around in the driveway now and when
the children are dropped off and picked up congestion will occur
on Cider Mill LOop. Again, it could be handled that a review
would be made by the zoning Administrator in the future.
3. I feel the Special Use Permit should be issued only to this
applicant and it would terminate if she discontinued direct
participation .or ownership.
4. A Certificate of Occupancy will be required prior to actual use.
