-the variance requested 18 tor the relocation
and replacement of a Shell 9aa stat10n 8i9n located near the
intersection of 14ev York State Route 9 and Hopewell Road 1n the
Town of Wappinqer on premise. of the appllc.ant. The 819ft is
the usual trademark red IlUld yellovSbel1 siqn. The existing 8i9n
ha8 been located as shown on the attached plot plan about four
years. Th1s location was approved by t.be Town.. A similar 819n
was located at the north corner,. ne.r 'ray lor rental f since the
station opened. The new s1gn 1s to be supported by two metal
poles and will be stationary. The s1gn itselt wi~l not revolve.
The aiqn is located at thesoutnwest corner of
the premises and haa coneret.e curbinq as a barrier on the north
and east sides. A yard lig-ht pole is located nearby within the
curbing protected ar:ea. .'fb.eplans indicate that the pole nearest
Route 9 i8 located approx!mauly 45 feet: from ~ eageof the
road shoulder and 13 feet from the pro.perty line.. Said pole is
42 feet from the edge of the road shoulder of Hopewell Road and
19 feet from the southerly boundary of the properf:y. Said pole
is within 5 teet ot the looat.1011 of the exiatLnq8i9n previously
approved by the Tow8.

As people buygaaol1ne by brand name, and Shell
is a nationally advertised brand, practical difficulties are being
experienced by the appe1.lant who 1s limited to the use of the
existing s1911. Rout.e 9 is it State hiqhwaywith a speed limit
of 55 miles an hour in front of the st.ation. Car. approaching
in a northerly direction are on a alight downhill grade. All
alonq Route 9 there 1s siqlliticaBt fOliage which li.its viSibility.
Because of the topography of the land It 1s important to the operator
of the station to have a 819ft close to Route 9 and high enoup
in order t.o have it visible to customers approaching from the
South. If it "ere set back any further or limited t.o the existing
height, It Is not visible t.o dri.-era travelin<g northbound on Route
t in sufficie.nt time ao that they can determine 1:he brand and
often whether they have the appropriate credit card in time to
enter the station.
It is estimated that in excess of 90' of the people
who recognize the station dOBO OBI!, to buy CJaaoline. The statioD
pumps between 55,000 and 60,000 gallons of gasoline per month.
It is estimated that in exce.. of 50\ of the customers are transient
customers relyinq UpoD it 819n. If the sign is made IIOre visible,
by increasing it.a beight and its area# i't is eati_t.e(I that tbe
salea could be increased between 10,000 to 15,000 gallons of qa.sollne
per moft~ for a substantial ~c benefit to the local operator.

properties across the street and adjacent t.hereto. 'there are
no residences visible from the slde.. Agae st.ation s190 is peculiar
to it.s trade and it 1. .. well known fact that. people do rely upon
seeing t.he uaual sign. her nat.ional braads of gasoline and look
for them. If they do not see them in ~, the 9aaol.1ne will
not be bought at. that station. "file variance request.ed is an are.
variance.. This request is for the continued use of a free-stand-iAg
sigft that has been in existence for approximately .. years. It
is intended to move the sign a very ahort distance, iDer...e it..
height from 18 feet. t.o 30 feet. and t:o increas. t.he top areawhicb
is the brand name sign trom 25 square feet. t.o approximately 64
square fee't.. It is submitted t.hat this increase in heiqht. And
8i91\ area will not affect: the character of the neighborhood in
any way and because of its location, it observes the spirit of
the ordinance. 'rhe siqn is t.o be located and it is t.o be of such
hei9hth and size where it. will be visible upon Route 9.
'lhe premises will becoae neater and. more orderly
since the new aip haa .paClla for 9.spri~ and service speciale.
'1'his will eliminat.e the many smaller free-at.imd1ag sips now on
the premiaes aad elitd.nate the .clutter-effectlf now exi.t.in.,..
The net effect will be one which ia aore buaine..-like t pict.ures
vill be presented to the Board to show the lack of ri..ibi~lt.y
of the s'ta1:.ion as it is approached on acute 9 from the south.

on the plans and the spe.iflcations submitt.ed herewith.
