3. A VARIANCE IS REQUESTED for the following reasons:
J) Strict application of the. Zoning Ordinance would produce undue hardship because: Appellant
wishes to sqbdiv!de her property as shown on the attached plan into two
parcels. Parcel nAn is where Appellant resides and she desires to sell
Parcel "Anto a member ofhy'r family.The house on Parcel"A"was bui--lt. in 1935
and the house on Parcel liB' in 1953, prior to the enactment of zon~ng laws
town. 2) The hardship created is unique and is not shared by all properties alike in the immediate
vicinity of this property and in this district because: Appellant owns both dwelli1:)~s
which she built on one parcel of land prior to the enactment of the present
zoning laws and noW must obtain an area variance and subdivision approval
in order to sell one dwelling.
3) The ~~nce would observe the spirit of the Ordina.nce and would not change the character of
the clistnct because: Both houses were built prior to the enactment of the
zoning laws and there will be no alteration of the structures on the prop-
erty and the use of the property will remain the same as presently exists.
