Appellant owns sixty (60) acres at its above-stated location. The said
premises are used for purposes of a summer day camp and4summer recreation area.
The improvements include, among other things, the cabins for the day camp and
related and accessory buildings, the swimming pool and a pavillion providing
food services, showers and bathroom facilities. The entire facility, known as
Jekoce Acres is used weekends commencing Memorial Day weekend until the end of
public school in late June and thereafter is opened every day until Labor Day
weekend, a. period of approximately three (3) months. During the period of its

Within the past six months, considerable improvements have been made at the
said premises, including, but not limited to, the construction of a new
swimming facility consisting of two pools, one of which is a childrens' pool,
fencing, "astro-turf" type carpeting and refurbishing of the pavillion. That
the cost of said improvements were Sixty-Two ThOUSand ($62,000.00) Dollars.
Appellant believes that in the absence of adequate security that the premises,
and particularly the new pools and improved pavillion, will again be the
targets of vandals and will be again considerably damaged.

It is respectfully submitted that the police services presently provided are
not of a magnitude sufficient to provide the security necessary for a facilityi
such as the appellant's. It is further respectfully submitted that the cost of
private security for such a facility would be prohibitive, particularly for
such a small non-profit organization as the appellant.

That the appellant believes that it shall be able to provide the necessary
security for its premises, thereby alleviating the undue hardship which would
be caused to the members by reason of the continued vandalism, by permitting
one and, more ideally, two trailers to be placed upon the premises, with the
residents thereof providing the necessary security. Reference is made to two
trailers, in that appellant has been fortunate in locating two separate
families of whom the husband of one works days and the husband of the other
works evenings, the end result of which, if a requested variance is granted,
would result in around-the-clock security at the said premises at a very
nominal cost to the appellant.

Appellant fears that if this variance is not granted, the premises will again
be severely vandalized with the result that its membership will be diminished
as not only .will the cost of making the necessary repairs and replacements
result in higher cost to the members and the loss of some members by reason
thereof, but the futility of even bothering to improve the premises to merely
encourage further vandalism could result in the wholesale termination of
membersh ips.

Appellant does not believe that there are any other properties of such a
similar recreational use in the immediate vacinity of appellant, nor for that
matter, in the entire Town of Wappinger, with the exception of the Town's
recreation area; in_addition, appellant believes that its location is unique
and that the hardship is further magnified by the fact that the premises are
shielded even from the limited numbers of passers-by that travel on St~ '
Nicholas Road by the woods which surround the premises and by the lack of
street lights.

The use of the premises has been a recreation area and day camp and has been
in existence for a considerable period and, as indicated above, appellant does
not believe that other properties would be affected by granting of the
requested variance.

BE IT RESOLVED THAT the Zoning Board of Appeals of the Town
...
of Wappinger hereby grants a variance pursuant to Section 413
of the Town of Wappinger Zoning Ordinance to the Jewish Community
Center, Inc. to permit them to place one and/or two mobile homes
on premises located off st. Nicholas Road, in the Town of Wapping~r.
Said mobile homes are to be located as indicated on the site plan
of record.
The variance is granted with the following stipulations:
1. Approval of the Dutchess County Department of Health
shall be obtained.
2. When security personnel no longer reside in the mobile
homes, the mobile homes shall be removed from-the premises
within ninety days.
3. The mobile homes shall conform to the setback requirements
of the zoning district in which they are to be located.
