(a) (1) The variance requested is for a Shell gas station sign, which sign is located near the intersection of DeGamo Hills Road and Myers Corners Road, on the property of the applicant. It is supported by two large metal poles, each weighing hundreds of pounds. It has been there since 1965, or almost ten years. It would be extremely expensive to move, since it is imbedded in concrete, the remaining area of the front of the station is blacktop, and the poles are quite heavy and cumbersome. The sign has a guardrail and curbing as a barrier around it. Wit;hin this enclosure, there is also a telephone pole. adjacent to the sign, so there would always be a pole in this area. There is a fire hydrant and a street sign within the enclosures. If the sign were moved 25 feet back from the property line, it would greatly interfere with the traffic pattern around the existing pump islands and would be hazardous and dangerou~ to the customers of the applicant. This would cause economic hardship. Further, the present location of the pumps and the islands make it impractical to relocate the sign ~o a place where it would continue to have reasonable visibility. The 25-foot setback would be in an area where underground gas tanks or lines leading from them currently exist and to attempt to dig in this area would be both expensive and dangerous. Moving the sign as well as disturb- ing the blacktop, underground tanks, underground lines would all cause significant economic injury to the applicant. 2. (a) (2) Further practical difficulties would be experienced by the appellant since people buy gasoline by brand name and Shell is a nationally advertised brand. It is important to have the sign near the intersection so it can be seen in sufficient time by the consumer so he can determine the brand and often '1i "/, .. .. ~ whether he has the appropriate credit card in time to enter the station. It should be noted that the sign is not illuminated after closing time, which is around 9:00 p.m. and immediately adjacent to the station and across the street from the station are other commercial properties which are presently used as such. 2. (a) (3) The variance does not request a use variance, 'but only an area variance. This request is for the continued use of a sign that has been in existence for approximately ten years beside a telephone pole, fire hydrant and street sign and will. not affect the character of the area in any way. It does not pose any safety hazard since there is a substantial barrier around it. Since a sign is already permitted in the area, this does not change the character of the district, and because of the location of the sign observes the spirit of the ordinance. There is only one sign on the premises and it is located in a place where it is visible from both roads on this corner lot. "''''--.
