The Regular Meeting of the Town Board of the Town of Wappinger was held
on March 24, 2003 at the Town Hall, 20 Middlebush Road, Wappingers Falls,
New York. Supervisor Ruggiero opened the meeting at 7:35 p.m.

RECEIPT & APPROVAL OF MINUTES
The Minutes of the Regular Meeting of February 24, 2003 having previously
been forwarded to the Board Members, were now placed before them for their
consideration.
Councilman Colsey moved to accept the above stated Minutes as submitted
by the Town Clerk be and they are hereby approved.

DISCUSSIONS:
• Alamo's Purchase of Sloper Willen & the effect on the Town
A presentation by Richard Henley in regard to the pending acquisition of
Sloper-Willen Ambulance.
• SLR Construction regarding tenancy for a sewer connection for parcel on
Old All Angels Hill Road.
Councilman Colsey moved to authorize tenancy to Joseph Scorsone, SLR
Construction, to Wappinger Sewer Transmission Treatment Improvement
Area Phase 3A.
Seconded by Councilman Paoloni
Motion Unanimously Carried
• D'Amato Wheelchair Ramp. Mr. D'Amato claiming that the road salt the
Highway Department has been using caused the deterioration and
crumbling of the concrete on his wheel chair ramp. Mr. D'Amato is
requesting the Town of Wappinger restore the ramp to a usable condition.
Jay Paggi, Engineer to the Town explained that he did go to look at the
ramp and observed that the end of the ramp had deteriorated and is

lower than the road by 3 1/2 inches. There is a swale. When the plow
pushes the snow toward the side of the road, snow to gets deposited there,
and the snow has salt content to it. The existing type of construction for
the ramp appears somewhat homemade and the concrete did not have a
good finish and was not brought up to the elevation of the road. The salt
definitely caused the deterioration, but if you go up 12 feet or so its
deteriorated there also. Graham Foster observed that the only thing that
is deteriorated is the very surface of the ramp. He would not have
recommended it be built of concrete to start with, because it is adjacent to
the road where we do use salt. Because of its construction, water has a
tendency to sit in that area. It should have been raised up 4-5 inches
higher with a pipe underneath. It was very poorly built, and he does not
feel we should get involved. Discussion followed.
Councilman Valdati moved to table this request to an Executive Session,
seconded by Councilman Bettina and unanimously carried.
RESOLUTION NO. 2003-093
RESOLUTION AUTHORIZING THE EXECUTION OF LEASE FOR
HIGHWAY DEPARTMENT RADIO EQUIPMENT
The following Resolution was introduced by Councilman Bettina and
seconded by Councilman Paoloni.
WHEREAS, the Town of Wappinger Highway Department requires radio
equipment to facilitate efficient communication between Highway
Department personnel as well as various Town administrative agencies to
promptly address issues relating to maintenance and safety of Town
roadways and local emergencies as they may arise; and
WHEREAS, the Town of Wappinger Superintendent of Highways, Graham
Foster, has recommended the renewal of a Lease Agreement with the New
York Communications Co., Inc. (NYCOMCO) including service of said
equipment for the same price and terms as the previous Lease Agreement
entered into by the Town; and
WHEREAS, Graham Foster has noted a positive experience with
NYCOMCO's equipment and service (see letter from Graham Foster to Joe
Ruggiero attached hereto and marked Exhibit "A"); and
WHEREAS, this proposal complies with the Town's Procurement Policy.
NOW, THEREFORE, BE IT RESOLVED,
The recitations above set forth are incorporated in this Resolution as if fully
set forth and adopted herein.

The Town Board hereby determines that the terms and conditions set forth in
the Lease Agreement between the Town and NYCOMCO, a copy of which is
attached hereto and marked Exhibit `B", are acceptable and consistent with
the terms and conditions of the Highway Law and the Procurement Policy of
the Town and otherwise meet the communication needs of the Highway
Department.
The Town Board accepts the proposal set forth in the Lease Agreement
(Exhibit "B") and hereby authorizes Supervisor Joseph Ruggiero to execute
said Lease Agreement by and on behalf of the Town of Wappinger in the form
annexed hereto.
The Town Board directs that the amounts identified in the Lease Agreement
approved of herein shall be appropriated.

WHEREAS, due to an inadvertence, Resolution Nos. 80 and 85 were
introduced incorrectly at the March 10, 2003 Town Board Meeting.
NOW, THEREFORE, BE IT RESOLVED, as follows:
The recitations above set forth are incorporated in this Resolution as if fully
set forth and adopted herein.
Resolution Nos. 80 and 85 are hereby rescinded and the subject matter of
those Resolutions will be reintroduced by new Resolutions to be adopted by
the Town Board.

Association's 21st Annual conference in Buffalo, New York on April 27, 28, 29
and 30, 2003.
NOW, THEREFORE, BE IT RESOLVED, to authorize Gloria Morse, Town
Clerk to the Town of Wappinger, to attend the New York State Town Clerks
Association's 21st Annual conference in Buffalo, New York on April 27, 28, 29

RESOLUTION AWARDING CONTRACTS FOR HIGHWAY
DEPARTMENT SUPPLIES
The following Resolution was introduced by Councilman Colsey and
seconded by Councilman Paoloni.
WHEREAS, the Town of Wappinger Highway Superintendent, Graham
Foster, solicited bids for the supply of various Highway Department
materials; and
WHEREAS, bids were received and reviewed by the Town of Wappinger
Highway Superintendent, Graham Foster; and
WHEREAS, Town of Wappinger Highway Superintendent, Graham Foster,
has provided an award recommendation to the Town Board, and
WHEREAS, Town Highway Superintendent has recommended rentals form

GO OUT TO BID TO SELL EXCESS EQUIPMENT
The following Resolution was introduced by Councilman Bettina and
seconded by Councilman Paoloni.
WHEREAS, Graham Foster, Highway Superintendent to the Town of
Wappinger has requested in a letter to the Town Board dated March 14,
2003, to go out to bid to sell excess equipment which the Town no longer uses,
and
WHEREAS, the excess equipment which is to be sold is as follows:
Ford Bronco II previously used by Building Inspector
Ford Escort Station Wagon previously used by Fire Inspector
13 bias ply tires, new and used no longer compatible with Town trucks
(to be sold as one lot)
NOW THEREFORE, BE IT RESOLVED, as follows
1. The recitations above set forth are incorporated in this Resolution as if
fully set forth and adopted herein.
2. Graham Foster Highway Superintendent to the Town of Wappinger is
hereby authorized to go out to bid to sell excess equipment as outlined in

School on June 2nd, 3rd and 4th, 2003 in Ithaca, New York.

Superintendent to the Town of Wappinger is hereby authorized to attend
training at the Association of Towns Highway School on June 2nd, 3rd and 4th,

constructed or erected on residential property without the owners first
obtaining a Building Permit and consequently many of these sheds are in
violation of the Town of Wappinger Zoning Code; and
WHEREAS, the Town Board further acknowledges that over the course of
the last thirty years inconsistent information has been supplied by the
Town's Building and Zoning Departments with respect to whether or not a

landowner was first required to obtain a Building Permit before constructing
or erecting a shed; and
WHEREAS, in consequence of the numerous real estate sales and mortgage
refinancing currently taking place for properties within the Town of
Wappinger, title insurance companies routinely request a Zoning/ Building
Code Violation Search which has resulted in the Town's Building Department
discovering numerous sheds which are in violation of the residential set -back
requirements contained in the Town's Zoning Code, which, in turn, have
resulted in numerous Applications being made to the Zoning Board of
Appeals for variances to permit sheds to remain as constructed or erected in
violation of the Town's zoning set -back requirements; and
WHEREAS, the Zoning Board of Appeals has asked the Town Board to
address the issue of sheds being constructed or erected without benefit of
Building Permits to simplify the procedure by which homeowners could
validate the placement of sheds previously constructed or erected; and
WHEREAS, the Town Board hereby introduces Local Law No. _ of 2003 in
the form annexed hereto which establishes a procedure whereby residential
property owners will be given an opportunity to register sheds which were
constructed or erected prior to January 1, 1997, without first obtaining a
Building Permit for construction of same, and upon compliance with this
Local Law, receive a Certificate of Legal Non -Conformity to be issued by the
Building Inspector, Zoning Administrator or Fire Inspector; and
WHEREAS, the Town Board has determined that the proposed action is a
Type I Action pursuant to Article 8 of the Environmental Conservation Law,
6 NYCRR 617 (commonly known as SEQRA) and pursuant to Chapter 117 of
the Town of Wappinger Code (the Town's Environmental Quality Review
Law); and
WHEREAS, the Town Board has determined that the proposed Local Law is
an action for which there are no other Involved Agencies and that the Town
Board is therefore, by default, the Lead Agency for this action; and
WHEREAS, the Town Board has not made a Determination of Significance
pursuant to SEQRA and reserves the right to make such Determination until
after the conclusion of the Public Hearing.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if
fully set forth and adopted at length herein.
2. The Town Board of the Town of Wappinger hereby introduces for
consideration of its adoption proposed Local Law No. _ of 2003 in the form
annexed hereto.

3. The Town Board has reviewed the Proposed Action pursuant to Article
8 of the Environmental Conservation Law, 6 NYCRR 617 (SEQRA) and

4. The Town Board has reserved its right to make its Determination of
Significance pursuant to SEQRA until after the conclusion of the Public
Hearing on the proposed Zoning Law Amendment.
5. The Town Board further directs the Town Clerk to act as follows with
respect to the proposed Local Law:
(a) To serve a copy of this Resolution, the annexed proposed Local

municipality not less than ten days prior to said public hearing.

Planning and Development for Advisory Review in accordance with §239 of
the General Municipal Law; and
(c) To distribute a copy of this Resolution and the annexed proposed

Planning Board for its review and recommendation pursuant to §240-12 of
the Zoning Code prior to said Public Hearing.
6. The Town Board hereby schedules a Public Hearing on the proposed
adoption of Local Law # of 2003 to be held at Town Hall, 20 Middlebush
Road, Wappingers Falls, New York, on the 28th day of April, 2003 at 7:30
p.m., and that the Town Clerk is directed to post and publish Notice of the

Lease Agreement with Dobson Cellular Systems, Inc. d/b/a Cellular One on
March 24, 2000 authorizing Dobson to erect a cellular tower at the Town Hall
complex at 20 Middlebush Road, Wappingers Falls, New York; and
WHEREAS, Omni Point Communications, Inc. seeks to enter into a
sublease agreement with Dobson Cellu' ar Systems, Inc. to permit a
collocation of an additional communication facility on the same tower; and
WHEREAS, the Town Board hereby consents to such sublease agreement on
the express condition that Dobson CE:llular Systems, Inc. obtain an amended
Site Plan Approval from the Town o Wappinger Planning Board to permit
such collocation of the additional facility and an amendment to the Facility/
Tower Special Permit (F/TSP) allowing the collocation of such systems, and
provided further that Dobson Cellular Systems, Inc. otherwise comply with
Town Code §240-81 entitled "Telecommunications towers, antennas and
personal wireless service facilities".
NOW, THEREFORE, BE IT RESOLVED, as follows:
