RIDER TO APPEAL FOR A VARIANCE
The applicant is the owner of a parcel of land consisting of approxima ly
2.09 acres on the easterly side of All Angels Hill Road. in the Town of
Wappinger. Dutchess County. New York. At the time that this parcel was
acquired in l\/larch 1968. there were four trailers located on the front portion
of this property. The attached plan show s the location of the trailers upon
the property and also the location of the proposed residence which is the
subject of this appeal.
An application was made for a building permit for the construction of
a single family residence upon the premises. The zoning administrator of
the Town of Wappinger denied the application because of failure to comply
with the residence district standards set forth in S422. 1 of the Town of
Wappinger Zoning Ordinance.
1. Strict application of the Zoning Ordinance would produce undue
hardship. Applicant's mother is retired and manages the trailers that
now exist on the subject premises. The net income from four trailers
would allow her to be self sustaining. Removal of any of the trailers would
allow her sufficient funds to support herself.
2. The hardship created in unique and is not shared by all properties I

alike in the immediate vicinity of this property and in this district. The I

applicant's property consists of 2.09 acres of land. The four trailers located !

on the front portion of this property occupy less than one half of the total
area of this parcel. The residence contemplated would be situate on a parcel
exceeding one acre and would be in conformity with the zoning ordinance. if
.1 it were not for the trailers on the front portion of the property. The trailers
are nonconforming and have existed at the same location for a period dating
prior to enactment of the zoning ordinance. The area to be utilized by the
erection of a single family residence is in excess of the area density required
by the ordinance. As stated. the removal of any trailers would create

severe hardship in that it would deprive applicant's mother of her ability
to be self- supporting. The ordinance further creates a hardship on applicant
in that it deprives him of the use of more than one- half of his property.
3. The variance would observe the spirit of the ordinance in that it
would allow construction in an area of land exceeding the density requirements
of the ordinance. It would not change the character of the district as the
residence would be secluded on the rear portion of applicant's property and
would not be visible from adjoining properties or from the road.
