TYPE OF APPEAL (Complete relevant section).* a. A VARIANCE IS REQUESTED for the following reasons: I) Strict application of the Zoning Ordinance would produce undue hardship because: 2) The hardship created is unique and is not shared by all properties alike in the immediate vicinity of this property and in this district because: 3) The variance would observe the spirit of the Ordinance and would not change the character of the dist.rict because: b. OTHER REMARKS: ........................................................................................................................................................................................ (Use extra sheets if necessary) Signature.......f~.......~~.~...... * The required plan must accompany the Notice of Appeal. / ~ ~~ . ill , . Attachaent to Notice of Appeals The property adjoining ours was recently purcha.ed by Mr. Robert Kowalski to house hi. .eltagh Enterpri.... Mr. Kowalski i. remodeling the building on the property zoned ccmmercial and i. using it commercially (a furniture bu.ine..). Be maintlain. three hor.es on the premises and stables them in a building on the property. OUr interpretation of the zoning ordinance i. that at least ten acres are nece.sary to harbor hor.e. and this parcel is less than two acres. Mr. Kowalski has verbal permis.ion fran Mr. Ludewig to stable the horses. Mr. Ludewig interpr.tes the u.e of the land as a farm and therefore hor.es are allowed. This i. the reason there is no need for a variance according to Mr. Ludewig'. interpretlation. The horses are a nui.ance and have jumped over the electric fence twice in the short time they have been there. The last time they jumped the fence (June 30, 1971) they went into Peter Bur.azzoli' s garden and ate the carrots and letteuce and are thus now destroying property besides being a nuisance. We are requesting clarification of the legality of Mr. Kowalski to maintain horses on the parcel and feel Mr. Luc!ewiq was wrong in classifying the land as farm use. The major use of this property is to donduct a business and no one i. on the premises at night or on w.ekends and no one lives on the premises. .. Appeal :# 119 -2- November 9, 1971 Mr. Hirt moved that in relation to the Appeal of Peter and Livio Burgazzoli the ZOning Board of Appeals qoe. on record .s reaching the following factual determination upon the .vid~nce presented at the original public hearing and upon the evidence presented at the subsequent public hearing held on October 19, 1971: 1.
