was held on January 2, 2003 at the Town Hall, 20 Middlebush Road,
Wappingers Falls, Dutchess County, New York. SUPERVISOR RUGGIERO
Opened the Meeting at 7:30 p.m.

RESOLUTION NO. 2003-001
TOWN BOARD APPOINTMENTS TO VARIOUS TOWN OFFICES
AND POSITIONS
The following Resolution was introduced by Councilman Colsey and
seconded by Councilman Paoloni.
BE IT RESOLVED, that the following persons be and they hereby are
appointed to the following offices and positions of employment with the
Town of Wappinger to serve in such capacity at the pleasure of the Town
Board for the year 2003.

Deputy Town Superintendent of Highways, and, the Town Historian is to be

WHEREAS, The Town Board of the Town of Wappinger wishes to appoint
Gerald Terwilliger as Town Comptroller, and Patricia Maupin as Receiver of
Taxes and Assessment for the Town of Wappinger,
THEREFORE, BE IT RESOLVED, that Gerald Terwilliger is hereby
appointed to the office of Comptroller in the Town of Wappinger, to serve in
such capacity for a term ending on the 31St of day of December, 2003, and
BE IT RESOLVED, that Patricia Maupin be and she hereby is appointed to
the office of Receiver of Taxes and Assessments in the Town of Wappinger, to
serve in such capacity for a term ending on the 31St day of December, 2003,
and
BE IT FURTHER RESOLVED, that the Comptroller be paid an
annual salary of $50,027.00 payable every Friday throughout the year 2003,
with the first payday to be January 3, 2003, and
BE IT FURTHER RESOLVED, that the Receiver of Taxes and
Assessments be paid an annual salary of $ 42,773.00, payable every Friday
throughout the year 2003, with the first payday to be January 3, 2003, and
BE IT FURTHER RESOLVED, that the Receiver of Taxes and
Assessments be and she hereby is authorized to employ such clerical
employees as may be necessary for the performance of her duties and to
compensate such clerical employees up to the prevailing maximum hourly
rate.

BE IT FURTHER RESOLVED, that the salary for Andrea Paustian,

RESOLUTION ESTABLISHING THE PAY SCALE FOR CERTAIN
EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY
DEPARTMENT
The following Resolution was introduced by Councilman Colsey and
seconded by Councilman Paoloni.
WHEREAS, the pay scale for the employees hired by the Town of
Wappinger Highway Department must be in accordance with the CSEA
contract,
THEREFORE, BE IT RESOLVED, that the pay scale for the employees
hired by the Town of Wappinger Highway Department will be in accordance
with the C.S.E.A. contract, and
BE IT FURTHER RESOLVED, that all such Highway Department
employees engaged on an hourly basis shall be paid every Friday throughout
the year 2003 with 52 pay periods during such year consistent with the pay
schedule in accordance with a signed C.S.E.A. contract, with the first payday
to be January 3, 2003.

The following Resolution was introduced by Councilman Colsey and

WHEREAS, Cheryl Hait is hereby appointed to serve as Chief Court Clerk
for the Town of Wappinger, Dutchess County, New York, and
WHEREAS, Linda Walters is hereby appointed to serve in the position of
Deputy Court Clerk to the Justices for the Town of Wappinger Justice Court,
and
WHEREAS, Yvonne Lawrence is hereby appointed to serve as the Clerk to
the Justice for the Town of Wappinger, Dutchess County, New York.
THEREFORE, BE IT RESOLVED, that the annual salary for Cheryl Hait,
the Chief Court Clerk of the Town of Wappinger is hereby fixed and
established at the annual rate of $ 41,729.00, to be paid every Friday
throughout the year 2003, with the first payday to be January 3, 2003.
BE IT FURTHER RESOLVED, that the annual salary of the Linda

Anthony Mussara, the Custodian of Buildings and Grounds is hereby fixed
and established at an annual rate of $ 22,659.00 and on anniversary date of

Maintenance Supervisor for the Recreation Department of the Town of
Wappinger, Dutchess County, New York, and

Supervisor for the Recreation Department be and the same hereby is fixed
and established at an annual rate of $ 38,709.00, to be paid every Friday

BE IT RESOLVED, that Ralph Holt, Chairman of the Recreation
Committee, is hereby is appointed to serve as the Consultant to the Town of
Wappinger Recreation Committee, and
BE IT FURTHER RESOLVED, that the annual salary for the Consultant
to the Recreation Committee of the Town of Wappinger be and the same
hereby is fixed and established at the annual rate of $ 11,252.00 to be paid

RESOLUTION NO. 2003-013
RESOLUTION DESIGNATING COURT OFFICER FOR
THE TOWN OF WAPPINGER JUSTICE COURT
The following Resolution was introduced by Councilman Colsey and
seconded by Paoloni.
BE IT RESOLVED, that all individuals hereinafter designated by the Town
Board as Court Officers as such title is defined by the Uniform Justice Court
Act have all those powers accorded to Court Officers by Law during such
time they are actually serving in such capacity, and
BE IT FURTHER RESOLVED, that the Town Justices of the Town shall
designate and schedule the days and evenings such individuals shall serve
as Court Officers, and
BE IT FURTHER RESOLVED, that the Court Officers shall be
compensated at the hourly rate of $ 10.78 for time actually served, and
BE IT FURTHER RESOLVED, that Armed Court Officers shall be
compensated at the hourly rate of $15.11 for time actually served at sessions
of Court where their services are required and,
BE IT FURTHER RESOLVED, that the Town Justices shall submit to the
Town Comptroller on a weekly basis, the names and hours served, and that
the Town Comptroller be empowered to issue remuneration consistent with
the foregoing, from funds appropriated for Justice Court, and
BE IT FURTHER RESOLVED, that the following individuals be
designated as Court Officers for the Year 2003.

PATROL COORDINATOR FOR THE TOWN OF WAPPINGER
The following Resolution was introduced by Councilman Colsey and

BE IT RESOLVED, that the designated salaries for the following persons
holding full time or part-time positions, are hereby fixed and established as
follows:
Gary Corbett Vandalism Patrol Coordinator $ 20.57 per hour.
BE IT FURTHER RESOLVED, that all such persons so designated shall
be paid every Friday throughout the year 2003, with 52 pay periods during
such year, with the first payday to be January 3, 2003.

WHEREAS, The Town of Wappinger has certain recreation employees who
are paid on a weekly pay scale,
THEREFORE, BE IT RESOLVED, that the weekly salaries for certain
personnel retained to give weekly exercise classes to the Senior Citizens be
and the same hereby is established as follows.
Susan Borchardt Exercise Lessons $ 20.00 per session
BE IT FURTHER RESOLVED, that all such personnel engaged on a
weekly basis shall be paid every Friday throughout the year 2003 with the
first payday to be January 3, 2003.

WHEREAS, The Town of Wappinger Employs Barry Kaufman and Doreen
Kaufman as Meter Readers for the Town,
THEREFORE, BE IT RESOLVED, that the remuneration for, Barry
Kaufman, and Doreen Kaufman, Town of Wappinger Meter Readers, be
established at the rate of $1.03 per meter, and
BE IT FURTHER RESOLVED, that the remuneration shall be consistent
with number of meters read, and the Comptroller is empowered to issue
remuneration upon approval by the Supervisor.

WHEREAS, Joseph E. Paggi of Paggi, Martin and DelBene was appointed
Town Engineer in 2002, and
WHEREAS, Mr. Paggi has requested an amendment to his Rate Schedule in
accordance with a letter to the Town Board dated December 10, 2002,
THEREFORE, BE IT RESOLVED, that Joseph E. Paggi be and he hereby
is employed and retained for the purpose of furnishing to the Town Board,
its Officers and Agencies, such engineering advise and services as may be
required and shall receive compensation therefore in accordance with a
proposal submitted to this Board: and
BE IT FURTHER RESOLVED, that the Rate Schedule of Joseph E. Paggi,
Town Engineer is hereby amended in accordance with his letter dates
December 10, 2002 to the Town Board.

minimum hourly rate of $6.00 to a maximum hourly rate of $12.96 per hour,
and
BE IT FURTHER RESOLVED, that the part-time hourly rate for any
subsequent part-time clerical employee engaged by any Official or Agency
Department Head shall be established at the minimum hourly rate, or if
otherwise fixed and established, shall be subject to the approval of the Town
Board, and
BE IT FURTHER RESOLVED, that the pay scale for all presently employed
part-time laborers and Maintenance people, other than Highway Personnel,
engaged to perform services for the Town Board and/or its Officers, Officials
and Agencies, be and the same hereby is fixed and established at a minimum
hourly rate of $ 10.13 to a maximum hourly rate of $ 14.19 per hour, and
BE IT FURTHER RESOLVED, that all such extra Part-time Clerical
Employees and Laborers, and Maintenance people, other than Highway
personnel, engaged on an hourly basis shall be paid every Friday throughout
the year 2003, with the first payday to be on Friday, January 3, 2003.

services for the protection of Town Parks, various other Town properties and
performance of other such duties as may be assigned by the Town Board of

with the Dutchess County Sheriff.

for said position, however, she may accept gratuities up to $75.00 per
ceremony at which she officiates.

WHEREAS, the Justice Court has had an increase in its work load and has
the need of having to make change on a daily basis, and
WHEREAS, the Town Clerk of the Town of Wappinger has numerous
requests for expenditures of small amounts of cash for postage, supplies,
making change on a daily basis, and various miscellaneous items, for various
departments of the Town of Wappinger, and
WHEREAS, a Petty Cash fund has been established for the Receiver of
Taxes, pursuant to the provision of Section 64, paragraph 1-a of Town Law,

which shall be reimbursed to the Supervisor for advances at the close of each
fiscal year, and
WHEREAS, the Recreation Committee has numerous request for
expenditures of small amounts of cash for supplies and miscellaneous items
and reimbursement of small expenditures to various areas of the Recreation
program and Maintenance work for the Town of Wappinger,
THEREFORE, BE IT RESOLVED, that the Town Justice Court, the Town
Clerk, and the Receiver of Taxes are hereby authorized and directed to
establish a Petty Cash Fund, in the sum of $200 each, for the use of said
Justice Court, Town Clerk, and Receiver of Taxes, and the sum of $200 for
the use of the Recreation Committee, as provided by Paragraph 1-a of
Section 64 of Town Law.

newspaper entered as second class main matter, be and the same hereby is
designated as the official paper of the Town, and
BE IT FURTHER RESOLVED, that the Poughkeepsie Journal, published
in the County of Dutchess and having general circulation therein, be and is
designated as an additional newspaper for the publication of Town Notices,
subject to the limitations of Section 64, Subdivision 11 of the Town Law of

BE IT RESOLVED, that the voucher order checks of the Town of
Wappinger may be signed with a facsimile signature of the Supervisor of the
Town as reproduced by a mechanical check -signing device or machine
provided that the safeguards specified by the manufacturer and inherent in
the operations of such device are properly observed, and
BE IT FURTHER RESOLVED, that a certified copy of this resolution be
filed with all banking institutions which are depositories of the monies and
funds of the Town of Wappinger, for the purpose of indicating authority for
the use of such facsimile signature, and
BE IT FURTHER RESOLVED, that the Supervisor of the Town of
Wappinger be and is hereby authorized and empowered to take all steps
which may be necessary and proper to acquire a mechanical check -signing

York, be and they each hereby are severally designated as depositories of the
monies of this Town, and

RESOLUTION AUTHORIZING THE SUBMISSION OF THE
SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE
COMPTROLLER
The following Resolution was introduced by Councilman Colsey and
seconded by Councilman Paoloni.
WHEREAS, subdivision 10 of Section 29 of the Town Law requires that the
Supervisor of each Town prepare and file with the Town Clerk within 30
days after the expiration of each fiscal year an annual financial report
accounting for all monies received and disbursed by him, together with the
certificates or certificate of the bank or trust company where Town monies
are deposited, showing the amount of such monies on deposit with said bank
or trust company, and cause a certified copy of such report to be published in
the official newspaper, and
WHEREAS, in lieu of preparing the report required by Subdivision 10 of
Section 29 of Town Law, the Town Board may determine, by resolution, that
the Supervisor shall submit to the Town Clerk within 60 days after the close
of the fiscal year, a copy of the report to the State Comptroller required by
Section 30 of the General Municipal Law and the Town Clerk shall cause a

summary of such report to be published within 10 days after receipt thereof
in a form approved by the State Comptroller in the official newspaper.

except proceeds of loans and monies the investment of which is otherwise
provided by law, belonging to the Town which are or which may be in excess
of the amount required for immediate expenditure to pay current expenses
and obligations, and
WHEREAS, it is or it may be to the advantage of the Town to deposit and/or
invest all or part of such funds in special time deposit accounts, or in

certificates of deposit issued by banks or trust companies located and
authorized to do business in this State, short term obligations of the United
States of America and/or the State of New York, and
WHEREAS, it appears that the Temporary Deposit and/or investment of
such excess and surplus funds may be beneficial and profitable to the Town
of Wappinger,
NOW THEREFORE, IT IS HEREBY RESOLVED, that the duly elected,
qualified and acting Supervisor of the Town of Wappinger be and he hereby
is authorized, empowered and directed to deposit and /or invest such surplus
and excess funds of the Town in the aforesaid manner pursuant to Section
11 of the General Municipal Law of the State of New York, and
BE IT FURTHER RESOLVED, that such Temporary Deposits and/or
investments shall be secured, registered or held, as the case may be in the
manner prescribed by Section 11 of the General Municipal Law of the State
of New York, and
BE IT FURTHER RESOLVED, that the Supervisor of the Town of
Wappinger be and he hereby authorized and empowered to invest and
participate in a Flexi-Cash program, sponsored by Merrill, Lynch, Pierce,
Fenner and Smith, Inc., and administered by the Bank of New York, in the
manner prescribed by Section 11 of the General Municipal Law, and
BE IT FURTHER RESOLVED, that the aforesaid Supervisor of this Town
be and he hereby is authorized, empowered and directed to take all steps
necessary from time to time to carry out and implement this Resolution.

RESOLUTION RELATIVE TO PURCHASING PROCEDURES
The following Resolution was introduced by Councilman Colsey and
seconded by Councilman Paoloni.
WHEREAS, pursuant to Town Law, a Budget is prepared each year by the
Supervisor detailing expenses and revenues for the ensuing year, and
WHEREAS, the Town Board shall review said tentative budget and reject
or modify any budgetary item as they deem appropriate, and
WHEREAS, that after due process of Public Hearing and provision for
additional amendments, the annual Budget shall be adopted,
THEREFORE BE IT RESOLVED, that within the confines of section 117
of the Town Law where provisions have been made in the annual budget for
specific, large expenditures, further approval by the Town Board to consider
the purchase of those expenditure need not be sought, provided that no other
part of the Town's procurement Policy is circumvented, and
BE IT FURTHER RESOLVED, that Town Board permission to
seek bids on various large purchases may not be required if any item is
available through either State or County Bids.

WHEREAS, Pursuant to subdivision 104-b of the General Municipal Law
the Town adopted a Procurement Policy establishing purchasing procedures
and bidding limits for commodities and Public Works projects.
THEREFORE, BE IT RESOLVED, that the Town's Procurement Policy is
hereby referred to a Town Board Workshop for further review and study and
the Procurement Policy as set forth in Chapter 46 of the Code of the Town of
Wappinger shall remain in full force and effect until further action by the
Town Board.
