ADDENDUM TO THE MINUTES OF MEETING OF THE TOWN OF
WAPPINGERS ZONING BOARDS OF APPEALS DATED DECEMBER 21, 1965
The fOllowing is a minority opinion with respect to the appeal of Mrs. Claude
Knapp for a variance to put a pre-built home on Plaza Road:
Ii; is my opinion that this Board acted in a manner completely contrary to its
charter and, in fact, was remiss in its obligation to the public by refusing to
grar..t a variance to Mrs. Knapp. This is based on the fOllowing points:
1. The resolution, as proposed by Mr. Koehler, Was so poorly worded it
showed no cognizance of the facts in the case. I quote Mr. Koehler, "I
p::opose we deny this appeal because the appellant wants to erect a house
on a non-approved Town road and has not proved hardship or practical
difiicultyll. I will stand corrected on the quote as per the minute s taken
by the secretary. The point here is that we, the sole group with the
authority to vary Our zoning and Town la-w: 'and to grant relief to the
aggrieved citizens of this Town, have voted for a motion which is, in
:':<lct, a regurgitation of the very appeal we were considering. Mrs.
I<:11.app has asked ior relief from Town Law ZBO-a which forbids build-
ing on a non-approved Town road unless the Zoning Board of Appeals
sees fit to allow it due to practical difficulty or hardship being imposed
on the requestor. Mr. Koehler's resolution was framed as if this Board
could not grant such a variance and, secondly, that Mrs. Knapp had not
Pl'oven hardship where her petitions and letter state that her land and
home had been sold to the State and that she wanted to move her pre-
built home to the land she has owned since 1939. I submit that this hard-
shiPi imposed by a State' function, could not be more clearly spelled out

citizens of this Town of their only avenue of relief except the Courts and
this is wrong, both D:;l9rally and legally and a iqrther restriction of the
rights of out citizens..
2. M:;,.. Koehler's resolution, both original and modified, was seconded by
Mr. Jacobson as he so stated "for the sake of c,liscussion". I submit that
the hOU14 we spent in discussion was ample and that Mr. Jacobson showed D:o
cognizance of our charter and parliamentary procedures by seconding a
motion merely ior qiSCussion purposes.

3. Mr. Graham was confused as to the resolution and voted for it where
he might well have voted against had it been explained more clearly.
4. Tl1.c views of the members of the Planning Board present were taken
out of context and used by Mr. Koehler in making his decision. I sub-
rnit that if the mi~utes do not reflect this, this was the case none the
less and was not fair to the appellant because she could not rebut some
of the points hear'd by Mr" Koehler and which he was using to form his
opinion.
In su...."l.mary, I must admit that to have approved this variance would open
the floodgates for requests from citizens who own land on non-approved Town
ro<::,03. However, until or unless the Town Board sets a policy for this type of
condition, I strongly feel that the Zoning Board should grant this type of
vc:.riance pased on the facts of each case and so condition the variance that it
win enhance the climate between builder, homeowner and the Town and will,
in iact, assist in getting these roads upgraded or improved by virtue of the
:fac'~ th;;;.t people will be livip.g on these roads and will iorce such improvement.
This as contrasted by our current situation whereby keeping potential builders
off of land on non-approved roads, we limit development of the Town, we
re::;:t'l"ict the rights of our Citizens and adversely affect the relations between
Town Board and Town residents.
