6. A 6 ft. stockade fence shall be provided on the
easterly line of the site extending frc~ the inside
curb line to the rear line.
7. The planting strips along the frontage shall be
curbed. Plantings shall be low type not exceeding
2 ft. in heighth.
8. The parking lot shall be fully paved.
9. The changes indicated above shall be shown on a
revised plan together with any changes, alterations,
or improve~ents which may be imposed by the Zoning
Board of Appeals if it sees fit to grant the variance
required, and said plan shall be submitted to the
Planning Board for final approval.
10. Approval shall be secured from the Health Dept.
for sewage disposal and water supply before building
permits shall be issued.

Planning Board, the following action was taken.
A motion was made by Robert Steinhaus, seconded by
D~ Robert Heisler, to adopt the following resolution:

Homes, Inc. for site plan approval of a commercial development
located on Route 9D in an LB zone.
NOW, THEREFOREr BE IT RESOLVED Ta~T the s~~e plan as
shown on a map entitled "Proposed Stores", prepared by
Xilton Chazen, P.E. & L.S.r and dated 3-30-66 be tentatively
approved subject to the following conditions:

action was taken.
A motion was m&de by Gordon airt, seconded by
Richard JaCObson, that the request of I.e.S.M. Ho~cs,
Inc. for a varianco of 24 ft. for tho re~r lot line
w~d a S-ft. front yard varianco for a portion of tho
lot to pe~it construction of ret~il etores on their
parcel of land located on the west side of Route 90
in Hughsonville, be granted on the grounds ~~at:
1. A practical difficulty exists becauoo of tbe
unusual shape of the lot in that the depth of the
portion of the lot where the approval has been granted
is insufficient to allow reasonablo sized stores to be
placed theroon.
2. The land is zoned commercial and site plan approval
for the submitted plan has been previously obtained from
the Planning Board.
3. The provision of a G-ft. alleyway does provide
sufficient access and egress to and from thooe ntores to
allow for refuse disposal, pUblic safety, and fire
protection. Motion Unanimously Carried

Zoning Board of Appeals, held on April 26, 1966, the

construction of a retail store building within one
foot of rear line on a portion of their lot located
on the west side of Route 9D in Hughsonville, Town
of VIa pping er, New 'Iork.
A motion was made by David Koffsky, seconded by
Thomas Graham, to deny the requested variance on the
grounds that the provision of a l-ft. alleyway behind
the stores does not provide sufficient access or egress
to and from these stores to allow for refuse disposal,
public safety, and fire protection.
