I'" ,~ ; ~ : ; /;'! .. \ \ Petitioners ask for an interpretation of the Zoning Ordinance of the Town of Wappinger by the Zoning Board of Appeals pursuant to the power vested in said board by Article V, Section 543 of said Ordinance on the following statement of facts: Petitioners are contract vendees of certain premises shown and designated as Lot No.3 on a certain map entitled I~ot conveyed by Mary Popula to Florence Lynch, now Florence Lynch Thorne and Edward +hornefJ, dated May 23, 1951, and by various revisions thereof, the latest being September 10, 1959, attached hereto and made a part of this application. Petitioners have made application to a local lending institution for a mortgage on the aforesaid premises and counsel for the lending institution raises the following question: Are the premises part of a tract of land presently being subdivided? The premises in question, along 'with the other parcels on the aforementioned map were acquired by Florence A. Lynch (Thorne) in 1951. In 1953 Florence A. Lynch conveyed the entire tract to Edward Thorne, Sr. and herself, Florence Lynch Thorne. The premises were divided for resale in 1951 as in- dicated on the aforementioned map and sales were made by Edward Thorne, Sr. and Florence Lynch Thorne as follows: Parcel B - to Mario and Michael Olivieri - 1956. Lot 2 - to Michael J. and Harriet So Delaney - 19590 Lot 3 - to Harriet S. Delaney - 1963. Lot 4 - to Donald H. McMillen and wife - 1965. Buildings were erected on all the lots sho\~ on the map prior to 1960, except lot No.1, which remains vacant, and a right-of-way was constructed for the use and benefit of Lots 1, 2, 3 and 4 prior to 19600 Petitioners' contention, therefore, is that the entire tract was subdivided in 1951 or no later than 1959 as indicated from the dates on the map sho\ung the initial drawing thereof and the revisions thereof, the fact that all buildings erected on the entire tract were completed prior to 1960, a right-of-way over a private road, twenty feet in width running from the premises in question to the Chelsea Road was created for the benefit of the lots fronting on it prior to 1960, all before the adoption of the TOvffi of Wappinger Land Sub-Division Regulations on June 5, 1961, or the Zoning Ordinance on January 29, 1963.
