September 1, 1964 Members of Board of Appeals Town of Wappingers Dear Sirs: As I would like to construct a home for my wife and children in your lovely and friendly community, I would appreciate your consideration. The house I intend to construct is my long sort after dream house. It will be a:p. extremely well-constructed architectural designed home of nice proportions. The house will have its entire exterior fmished off in Norman or Roman brick, shadow pointed with the exception of a small portion of the front which will be finished in stone. It all will be in good taste and top quality. The house will have no chimney, issue no offensive smoke as it will be a,n ALL ELECTRIC GOLD MEDALLION HOME, heated by ceiling radiant heat. I assure you a lot of care and planning and a lot of sacrifice has and will go into this house. However, I find I have a problem, which I hope you will give your consideration. The house is 81 feet long, the lot 125 feet. If I left 20 feet of side yard to the left of the house,only 24 feet remain on the right for a turn about into the garage which has two 9 foot doors. It is considered. desirable, in fact necessary, to have 30 to 32 feet to turn a car at right angles into a garage. I would therefore appreciate your allowing me to have a side yard of 13 feet on the left so I have a compromise turnabout area on the right of 31 feet. 13+81+31 = 125 feet Please appreciate my situation. I purchased this one acre lot at considerable expense. My deed states I can build within 10 feet of lot line. The map was approved on June 18, 1962 by the Planning Board of the Town of Wappingers. Now, after the fact a new code restricts to 20 feet. Please consider this. Also your present code allows garage if 75 feet back to be within 10 feet of the side line. My garage however is attached but will be at least 100 foot back. I cannot change the length of the house, it will destroy two of the rooms, be unsuitable for my requirements and kill1Jlec.-beauty and balance of the house. I do, do need the space to get in the garage. _ My neighbor on the side where I request to gain seven feet, is at least 36 feet from his line, so there will still be over 40 feet between houses in fact 36 + 13 = 49 feet. To: Town of Wappinger Zoning Board Subject: Denial of Variance Request In Re: Seligman Gentlemen, We, the undersigned, oppose granting Seligman a zoning variance. to build a house within 13 ft. of A. T. and Mary Ann Popielarski's .:pr-.operty line. The following are comments of Popielarski. Seligman did not come to me personally in this matter and ask for my cooperation and explain why he feels a need to ask for special consideration from myself and fellow townsman, however, I feel he is entitled to know that I oppose his action based on the following analysis; Lets talk dollars ,and fact; Point 1. At the time of purchase of my lot it was priced in excess of $400 more than lots in the same division of only 5 feet less width and some less length. I paid over $400 to get privacy thatBeligman wants to infringe on for nothing. Every man is entitled to keep U13.t which he lawfully earned and paid for. 2. T~is point also involves financ:ial consideratio!1. I cannot, in all honesty, put a:.1 ac:curate dollar figure on what a too close house will do to my resale value but I would estimate, based on the dEference in original lot cost that I could be hurt to the extent of $1,500 on resale. Seligman does not, I think, realize that his property value will also be hu:-t. As he is a very recent, Long Island resident, I feel he d:)l~s not appreciate what. ten years residence in Wappingers area have ..... Page 2 of 3 taught me; Land is available here for any legitimate purpose, if you are willing to lookior it and pay the price. Once you buy it, you don't expect unnecessary in- fringement. 3. Aesthetil~s:"no date residents of our area have built in conformance to community regulations. We are developing a fine community and adding substantially to the Wappinger tax rolls. The building of an off center, oversize 80 ft. house on an undersized 125 ft. lot will do nothing to promote the beauty of the-area. 4. In opposing Seligman's request, though havinz full legal right to do so; I have looked at the following points to see if I would be morally responsible for doing him an injustice: . A review of the following points tells me my concience is clear: "" 1. Would HE be hurt financially? I feel not because any man that can afford to live in an 80 foot long, 2400 square foot home, will not be hurt if he revises his building plans. If he cannot revise his plans and has to sell his lot, highly imp~bable, will he be hurt? I think not, as almost every lot in the area is sold and he could sell rapidly - possibly even to myself. 2. \\iould he be hurt personally? I cannot say except to surmise that a man obviously as experienced in the business of home owning, (I believe the former owner of 4 or 5 homes ) and obviously, to me a business man in appearance and action, would not jEopardize his family or pocket book by rash action. - .. Page 3 of 3 I have spoken of the probable and real effects of Seligman's request on myself and himself. Now I would like to talk about the effect on the good order of the community. . 5. Established residents in this area have developed a way of life based on respect for their .neighbors and themselves. They are concious that to give in to whim and caprice of one at the expense of another is not honorable or sensible. This is the basis of a democratic society. The community has, at g-.ceat effort and expense established zoning and a planning bo:ard to protect its residents. Granting Seligman's request does not reward the community, the neighborhood, or myself, for our efforts.
