The Regular Meeting of the Town Board of the Town of Wappinger was held
on August 5, 2002 at the Town Hall, 20 Middlebush Road, Wappingers Falls,
New York. SUPERVISOR RUGGIERO opened the meeting at 7:30 p.m.

The Minutes of the Workshop Meeting of May 13, 2002, Special Meeting of
May 15, 2002, Town Board Meeting of May 28, 2002, Workshop Meeting of
June 10, 2002, and Special Meeting of June 17, 2002 having previously been
forwarded to the Board Members, were now placed before them for their
consideration.
Councilman Valdati moved to accept the above stated Minutes as submitted
by the Town Clerk be and they are hereby approved.

PRESENTATIONS/DISCUSSIONS
NESHEIWAT REZONE
Mr. Atalla Nesheiwat residing at 166 Woodside Ave, Harrison New York,
explained the he wished to rezone eighteen acres of land off Maloney Road to
Residential. The property contains road frontage of 500 feet on Maloney Road
and the surrounding property is mostly residential. It is

currently zoned airport industrial. He wishes to subdivide the property to
twelve lots ranging in size from 3 acres to 1.1 acres. Industrial activities
would be difficult based on the slope of the property. Mr. Roberts commented
that several items were left blank on the rezone application, the applicants
deed should have been attached, the dimensions of the lot should have been
included, and the submission date was missing. Discussion followed.
Councilman Valdati moved to refer Mr. Nesheiwat's rezone request to the
Planning Board for comments.

CRANBERRY HILLS
Attorney Peter Cherneff explained that on July 1st, 2002, the Town Board
discussed the cluster zone approval for the Cranberry Subdivision. At that
point the Board raised concerns regarding the appearance of some houses,
landscaping, street lighting, etc. The issue was how standards could be
developed to assure the Board that it would be comfortable with the project
and give Cranberry the possibility to add to the architecture. He announced
that the architect for Cranberry, George Gaspar was here tonight and would
go over the initial elevation plans for houses and the basic landscaping for
each house and the proposal for the street lighting. Mr. Cherneff distributed
a draft of proposed text amendments to the Local Law. If the Board finds
this acceptable, he wishes it be made part of the record, approval of the
cluster plan state these plans are acceptable, and the text of the proposed
Local Law be amended to provide that (a) cluster approval is granted based
on the submissions, and (b) that the Planning Board be authorized to approve
additional submission in the future for additional plans for construction of
various later phases of the subdivision. Discussion followed. Attorney to
the Town Al Roberts announced that he and Dan Wery would look over the
copy of text amendments on the proposed Local Law and report back with
recommendations. NO ACTIONS TAKEN
DEGNAN (THALMAN) REZONE
Sheldon Schell residing at 460 Pine Hill Road, Pleasant Valley, NY, was here
tonight as a representative for John Degnan. Attorney to the Town Al
Roberts explained that this property is currently used for the sale of heavy
trucks and truck supplies. This is a particular use that is not permitted in
the zoning district that the property is currently in. As early as 1994 several
efforts were made to have the property rezoned to Highway Business which
would permit the particular use in question, but for some reason died. In
February of this year, the current property owner insisted on a number of

uses at the site that he and Dan Wery felt were inappropriate and should not
be permitted at the site because of site constraints. It's a long narrow piece
with limited access and adjacent to the Wappinger Creek. The uses that
were suggested not be permitted at the site were, fast food restaurants,
laundry and dry cleaning establishments, tattoo parlors, outdoor kennels,
temporary outdoor sales, printing shops and gas stations. When Mr. Roberts
met with the owner in Supervisor Ruggiero's office, the owner insisted on
having a carte blanche rezoning. It has gone no where since then. Mr. Schell
explained that he has no objections with the first restraint, but he does object
to the fast food restaurants, because they want to keep their options open.
Another item that was mentioned was the Wappinger Creek. One of the
concerns was the parking of the trucks. They wish to develop this and open
up the other end of the property so the trucks that are parked on that section
of the property can be moved away from the creek. Mr. Roberts informed Mr.
Schell that he had requested, but never received, a copy of the proposed site
development map. The current use of the property is not permitted.
Discussion followed. NO ACTION TAKEN. Applicant to submit Site Plan
within 60 days.
MEMO OF UNDERSTANDING -JOINT LANDFILL
Supervisor Ruggiero announced that the Town of Wappinger was part of the
Town of Poughkeepsie joint landfill project in the early 70's that is now
closed. We are now under a DEC contempt order to close the land fill again.
It is a $6 million project and Town of Wappinger will have pay around 14% of
that cost. We will be getting a $2 million grant from the state. We have
already received one bill. We need to adopt a resolution of intent regarding
the issuance and sale of general obligation bonds for the joint land fill project.
He needed a motion to add this item to tonight's agenda.
Councilman Bettina moved to add Resolution #245 to tonight's agenda, for
adoption, seconded by Councilman Colsey and unanimously carried.
PRESENTATION MEADOWOOD WATER DISTRICT
Engineer to the Town, Jay Paggi announced that he had submitted a draft
Map, Plan and Report for the Meadowood Water District which will create a
water district on the southwest corner of All Angels Hill and Old Hopewell
Road. It binds the town to supply water to those parcels when developed. At
this time there are 14 lots approved. The second phase of about 25 lots is in
front of the Planning Board. It also serves water to two existing homes on
the north side of Old Hopewell Road west of Balfour Drive. Construction
should start toward the end of the year, and the wells should be on line by
mid next year. The Town will have to hold a Public Hearing and adopt the

order establishing the district subsequent to the Public Hearing. NO

the letter dated August 1, 2002 from Marcus J. Molinaro, Project Consultant
of Community Network.net/ WCG, Inc. to Hon. Joseph Ruggiero, Supervisor.
Supervisor Joseph Ruggiero is hereby authorized and directed to execute a
Contract consistent with the above letter on behalf of the Town of Wappinger
upon the approving recommendation from the Attorney to the Town, Albert
P. Roberts as to the form of the contract.

RESOLUTION NO. 2002-216
RESOLUTION AUTHORIZING BOND REDUCTION OF THE
KABLAOUI SUBDIVISION
The following Resolution was introduced by Councilman Valdati and
seconded by Councilman Colsey.
WHEREAS, Nasouhi N. Kablawi by Mahmoud Kablaoui, his Attorney -of -
Fact, has previously posted a Performance Agreement Secured by a Surety
Bond for the Kablaoui Subdivision in the Town of Wappinger; and

WHEREAS, Nasouhi N. Kablawi has performed some of the work required by
the Resolution of Subdivision Approval and has therefore requested a
reduction in the amount of the bonds securing the Performance Agreement
previously posted; and
WHEREAS, Paggi, Martin & DelBene, LLP, Engineers to the Town of
Wappinger, have determined that the amount of the reduced Bond should be
LM $83,606.77 as per their letter of November 14, 2001, a copy of which is
attached hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if
fully set forth and adopted herein.
2. The Town Board hereby authorizes a reduction in the Surety Bond posted
to secure the Performance Agreement in connection with Kablaoui
Subdivision from the sum of $218,683.00 to the sum of $83,606.77.
3. The Surety Bond in the original amount of $218,683.00 shall be returned
to Nasouhi N. Kablawi upon receipt of a surety bond in the sum of
$83,606.77 in such form as approved by the Attorney to the Town of
Wappinger.

plan for upgrading the computer network and training the staff within the
Town of Wappinger Town Hall; and
WHEREAS, the firm of Northeast Computer Services with an office at P.O.
Box 690, Rhinebeck, New York 12572, a qualified computer professionals
specializing in hardware and software training and installation and is
capable in preparing the Technology Master Plan that would implement a
proactive and efficient plan for upgrading the computer network and training
the staff within the Town of Wappinger Town Hall.
NOW, THEREFORE, BE IT RESOLVED, as follows:
The recitations above set forth are incorporated in this Resolution as if fully
set forth and adopted herein. James P. Jeffreys of Northeast Computer
Services with an office at P.O. Box 690, Rhinebeck, New York 12572 is hereby

RESOLUTION TO AUTHORIZE THE ADOPTION OF A LOCAL LAW
ENTITLED "LOCAL LAW NO. #10 OF THE YEAR 20029 AMENDMENTS
TO TOWN OF WAPPINGER ZONING CODE DEFINITION OF
BUILDING HEIGHT AND DRIVEWAY SPECIFICATIONS"
The following Resolution was introduced by Councilman Ruggiero and
seconded by Councilman Colsey.
WHEREAS, a Resolution was duly adopted by the Town Board of the Town of
Wappinger introducing a proposed Local Law entitled "Local Law No. #10 of
the Year 2002, Amendments to Town of Wappinger Zoning Code Definition of
Building Height and Driveway Specifications" for consideration of adoption by
the Town Board; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess
News, the official newspaper of the Town; and
WHEREAS, a Public Hearing was held on August 5, 2002 and all parties in
attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed Local Law or any part thereof; and
WHEREAS, the Town Board has determined that the proposed Local Law is
subject to environmental review; and
WHEREAS, the Town Board has determined that the proposed action is an
Unlisted Action pursuant to Article 8 of the Environmental Conservation
Law, 6 NYCRR 617 (commonly known as SEQRA) and pursuant to Chapter
117 of the Code of the Town of Wappinger (the Town's Environmental
Quality Review Law); and
WHEREAS, the Town Board has reviewed the intended action with respect to
the criteria set forth in 6 NYCRR 617 and Chapter 117 of the Code of the
Town of Wappinger and hereby determines that the intended action will not
create any significant adverse impacts on the environment and hereby adopts
a Negative Declaration of Significance for this action, a copy of which is
attached hereto as Exhibit A; and
WHEREAS, the Town Board of the Town of Wappinger after due
deliberation, finds that it is in the best interest of the Town to adopt said
Local Law.

WHEREAS, a Resolution was duly adopted by the Town Board of the Town of
Wappinger introducing a proposed Local Law entitled "Local Law No. #11 of
the Year 2002, Amendments to the Town of Wappinger Code Regulating
Peddling and Soliciting" for consideration of adoption by the Town Board; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess
News, the official newspaper of the Town; and
WHEREAS, a Public Hearing was held on August 5, 2002 and all parties in

WHEREAS, the Town Board has previously authorized the water
improvement known as Wappinger Water Improvement Area — 1999-2(R),
hereinafter referred to as "Water Improvement 99-2(R)"; and
WHEREAS, among the facilities to be constructed by Water Improvement 99-
2(R) is a dedicated water transmission line from the so-called Atlas well field
located adjacent to Wappinger Creek to the Hilltop Water Tank located on
Cider Mill Loop in the Town of Wappinger; and
WHEREAS, in order to complete the construction of the dedicated water
transmission line, various easements will be required through lands not
owned or under the control of the Town of Wappinger, including an easement
through lands now belonging to Cranberry Hills Associates as well as lands
owned now or formerly by the Metzger family through Lot No. 1 on filed Map
No. 10113; and
WHEREAS, the appropriate easements are in the process of being finalized,
drafted for execution by the property owners in question; and
WHEREAS, the Engineer to the Town, Joseph E. Paggi, Jr., P.E., has
indicated the Town will need the easements in place as soon as possible and
prior to the next Town Board meeting scheduled for September 9, 2002.
NOW, THEREFORE, BE IT RESOLVED, as follows:

interpretations of local land use regulations; and
WHEREAS, local legislative bodies are authorized to use their delegated
authority under state law to adopt a wide variety of land use regulations,
controls and incentives to provide for the balanced and harmonious
development of the community; and
WHEREAS, land owners, developers, and leaders of local civic organization
are regularly involved in testifying regarding matters pending before these
legislative and administrative bodies; and
WHEREAS, knowledge of the authority of local governments regarding land
use control and responsible decision making regarding these matters pending
before these legislative and administrative bodies; and
WHEREAS, Pace University School of Law in partnership with Glynwood
Center, with assistance of the Natural Resource Conservation Service, the
Hudson River Greenway, and the Soil and water District conservation
Boards, has established an exemplary program of training and supporting

The following Resolution was introduced by Councilman Valdati and

WHEREAS, the Town Board has received a Memorandum dated January 20,
1995 from Ernst Martin, Jr., P.E., L.S., a member of the firm Paggi, Martin &
Del Bene, Engineers to the Town, wherein Mr. Martin described a series of
survey errors within the subdivision known as "Tall Trees — Section 2" filed
in the Dutchess County Clerk's office as Map No. 3354; and
WHEREAS, the Town owns and operates a well site and water distribution
system known as the Tall Trees Water District on a parcel of land which was
originally a part of the Tall Trees Subdivision above referred to; and
WHEREAS, Cynthia J. Kablaoui is the owner of the parcel immediately
adjacent to the parcel owned by the Tall Trees Water District, which parcel is
known as Lot No. 45 as shown on Map entitled Tall Trees — Section 2" filed in
the Dutchess County Clerk's office as Map No. 3354; and
WHEREAS, Dr. Mahmoud S. Kablaoui and his wife, Cynthia J. Kablaoui,
originally purchased the aforementioned Lot No. 45 in 1969, however, title to
said property has subsequently been transferred to Cynthia J. Kablaoui,
individually; and
WHEREAS, when Dr. Mahmoud S. Kablaoui and his wife, Cynthia J.
Kablaoui, originally purchased the property, they were also provided a survey
of said parcel which inaccurately described the common boundary line
between Lot No. 45 and the Tall Trees Water District parcel; and

WHEREAS, Dr. Mahmoud S. Kablaoui and his wife, Cynthia J. Kablaoui,
have utilized the property described in their survey continuously since they
purchased the property and, in fact, a portion of the Kablaoui residence (the
deck) and a portion of their driveway are actually located on a portion of the
parcel owned by the Tall Trees Water District; and
WHEREAS, upon information supplied by Dr. Kablaoui, the survey errors in
the subdivision impacts not only the lot owned by Cynthia J. Kablaoui, but
other lots to the immediate east of the Kablaoui parcel; and
WHEREAS, Ernst Martin, Jr., P.E., L.S. has prepared a legal description of
the land needed to be transferred from the Tall Trees Water District parcel to
the Kablaoui parcel to cure the errors originally created by the inaccurate
survey provided to Dr. Mahmoud S. Kablaoui and his wife, Cynthia J.
Kablaoui, said legal description being attached hereto and made part hereof
marked and designated Schedule A; and
WHEREAS, Cynthia J. Kablaoui has hired McGrath & Company, Inc., Real
Estate Appraisers and Counselors, to undertake an appraisal of said parcel
containing 5,407± square feet, which appraisal determined that the parcel
was worth Nine Hundred and Seventy Five Dollars ($975.00); and
WHEREAS, pursuant to Town Law §215.8 and §198.12, property of a water
district not required for purposes of the district may be sold upon
authorization and resolution of the Town Board; and
WHEREAS, it has been determined that the particular area in question
described in Schedule A attached hereto is not needed for the purposes of the
Tall Trees Water District, and in fact, has been actively used by Dr.
Mahmoud S. Kablaoui and his wife, Cynthia J. Kablaoui, for a period in
excess of thirty (30) years; and
WHEREAS, pursuant to Town Law §215.8 and §198.12, no public hearing is
required because the value of the property is less than One Thousand Dollars
($1,000.00).
NOW, THEREFORE, BE IT RESOLVED, as follows:

Tall Trees Water District, hereby authorizes the sale of the premises
described in Schedule A to Cynthia J. Kablaoui and/ or her designee or
assigns.
The Town Board hereby acknowledges the appraisal prepared by McGrath &
Company, Inc. dated July 18, 2002 and addressed to Mr. Mahmoud Kablaoui
at 6 Amherst Lane, Wappingers Falls, New York 12590, a copy of which is on

file with the Town Clerk; the Town Board further accepts the determination
of McGrath & Company, Inc. that the subject parcel described in Schedule A
has a value of Nine Hundred and Seventy Five Dollars ($975.00) and hereby
agrees to accept payment in such amount as consideration for the sale of said
parcel to Cynthia J. Kablaoui and/ or her designee or assigns.
The Town Board further determines that on behalf of the Tall Trees Water
District, that the premises described in Schedule A are not needed for the
Water District's purposes and the Town Board further acknowledges that the
premises described in Schedule A have been under the practical use and
control of said Cynthia J. Kablaoui and/ or her husband for the past 30 years
or more. Upon payment of the above referenced consideration, and all related
professional fees and disbursements incurred by the Town of Wappinger on
behalf of the Tall Trees Water District, Joseph Ruggiero, Supervisor, is
hereby authorized to take all steps necessary and to execute any and all legal
instruments, including Deed, TP -584 and Equalization and Assessment Form
and such other documents as may be necessary to transfer title to the said
Cynthia J. Kablaoui and/ or her designee or assigns.
The sale of the above referenced premises to Cynthia J. Kablaoui or her
designee and/or assignees is also further conditioned on the said Cynthia J.
Kablaoui paying for all costs and expenses associated with this transaction
including all legal fees and engineering fees incurred by the Town on behalf
of the Tall Trees Water District to enable this property to be sold to said
Cynthia J. Kablaoui. Joseph E. Paggi, Jr., P.E., Engineer to the Town of
Wappinger, is hereby authorized to undertake and prepare a lot line revision
map and to make application to the Planning Board to approve the lot line
adjustment between the parcel owned by the Tall Trees Water District and
the parcel owned by the said Cynthia J. Kablaoui, known as Lot No. 45 on
filed Map No. 3354 and to take all other steps necessary to permit the parcel
described in Schedule A to be in proper form for sale to said Cynthia J.
Kablaoui. Albert P. Roberts, Attorney to the Town of Wappinger, is hereby
authorized to undertake all steps necessary and to prepare such legal
documents as are necessary including Deed, TP -584 and Equalization and
Assessment Form necessary to transfer the parcel in Schedule A to said
Cynthia J. Kablaoui and/ or her designee or assigns.

RESOLUTION AUTHORIZING ATTORNEY AND ENGINEER TO
DESIGN IMPROVEMENTS AND TO PROCEED TO BID ON
PROPOSED IMPROVEMENTS OF FACILITIES FOR THE OAKWOOD
KNOLLS WATER DISTRICT
The following Resolution was introduced by Councilman Colsey and seconded
by Councilman Bettina.
WHEREAS, the Town Board has previously adopted a Map, Plan and Report
for an increase and improvement of facilities for the Oakwood Knolls Water
District, proposing to interconnect the Oakwood Knolls Water District to the
Central Wappinger Water Improvement Area; and
WHEREAS, the Town Board conducted a Public Hearing on the proposed
improvements on February 28, 2002 at 7:45 p.m.; and
WHEREAS, at the Town Board's regular meeting on June 10, 2002 at 7:30
p.m. prevailing time, the Town Board adopted a Public Interest Order
authorizing the increase and improvement of the facilities of the Oakwood
Knolls Water District in accordance with the aforementioned Map, Plan and
Report; and
WHEREAS, at the Town Board's regular meeting on June 10, 2002 at 7:30
p.m. prevailing time, the Town Board adopted a Resolution authorizing the
issuance of Two Hundred and Five Thousand Dollars ($205,000.00) serial
bonds of the Town of Wappinger to pay the costs of the increase and
improvements of the facilities at the Oakwood Knolls Water District as set
forth in the aforementioned Map. Plan and Report; and
WHEREAS, the Resolution authorizing the issuance of Two Hundred and
Five Thousand Dollars ($205,000.00) serial bonds of the Town of Wappinger
also directed that a copy of the Resolution be published in the official
newspaper of the Town in accordance with 81 of the Local Finance Law
(Estoppel Notice).
NOW THEREFORE BE IT RESOLVED, as follows
1. The recitation above set forth are incorporated in the Resolution as if fully
set forth and adopted herein.
2. Twenty-one (21) days after the date of publication of the Resolution
authorizing the issuance of Two Hundred and Five Thousand Dollars
($205,000.00) serial bonds of the Town of Wappinger, the firm of Paggi,
Martin & DelBene, LLP with an office at 54-56 Main Street,
Poughkeepsie, New York, Engineers to the town of Wappinger and the

WHEREAS, La Fonda Del Sol is a restaurant located at 100 Old Route 9 in
the Town of Wappinger on a parcel identified on the Town of Wappinger Tax
Map as Tax Grid No. 6157-02-542585; and
WHEREAS, the owners of the restaurant have requested permission to
connect to the sewer services maintained by the Town through the Sewer
Improvement known as Wappinger Sewer Transmission/ Treatment
Improvement Area Phase 3A; and
WHEREAS, La Fonda Del Sol is situated outside of the geographic
boundaries of Wappinger Sewer Transmission/ Treatment Improvement
Area Phase 3A; and
WHEREAS, the owners of La Fonda Del Sol have indicated that they have
had repeated difficulty with the septic system servicing the restaurant; and
WHEREAS, the sewer transmission pipes for Wappinger Sewer
Transmission/ Treatment Improvement Area Phase 3A are in relative close
proximity to the restaurant; and
WHEREAS, by adoption of this Resolution by the Town Board hereby
authorizes the restaurant known as La Fonda Del Sol located at 100 Old

Route 9 in the Town of Wappinger to connect to Wappinger Sewer
Transmission/ Treatment Improvement Area Phase 3A as a Tenant upon
terms hereinafter enumerated.
NOW, THEREFORE, BE IT RESOLVED, as follows:
The recitations above set forth are incorporated in this Resolution as if fully
set forth and adopted herein.
The restaurant known as La Fonda Del Sol located at 100 Old Route 9 in the
Town of Wappinger on a parcel identified on the Town of Wappinger Tax Map
as Tax Grid No. 6157-02-542585 is hereby authorized to connect to
Wappinger Sewer Transmission/ Treatment Improvement Area Phase 3A as
a Tenant, effective upon the Town's receipt of its standard Tenant Agreement
and payment of fees set forth in said Agreement.
It is hereby confirmed that the restaurant is located on a parcel of property
identified on the Town of Wappinger Tax Map as Tax Grid No. 6157-02-
542585 and that in the event of the failure of the owners and/or the
restaurant to pay the required tenant sewer user fees in a timely manner
said fees will be relevied on the State, County and Town tax bills levied for
this parcel in January of each year in accordance with law.
La Fonda Del Sol and/ or the property owner of a parcel identified on the
Town of Wappinger Tax Map as Tax Grid No. 6157-02-542585 shall pay
tenant fees equal to the yearly Benefit Assessment plus the quarterly
Operation and Maintenance Charges paid by commercial properties within
the boundaries of Wappinger Sewer Transmission/ Treatment Improvement
Area Phase 3A, as said Benefit Assessments and Operation and Maintenance
Charges are determined by the Town Board from time to time for each year,
said tenant fees to be paid on a quarter -annual basis.
The Assessor to the Town is hereby directed to determine the number of
benefit units to be assigned to the subject parcel in accordance with the
benefit assessment formula established for Wappinger Sewer Transmission/
Treatment Improvement Area Phase 3A.

WHEREAS, pursuant to the Local finance Law of the State of New York, as
amended (the "Act'), the Town of Wappinger (the "Town"), a municipal
corporation of the State of New York, has the authority and power to issue its
general obligation bonds for the purpose of, among other things, planning,
constructing and financing the cost of any facility owned and operated by the
Town: and
WHEREAS, the Town has participated in joint landfill project pursuant to
an Agreement authorized under Article 5-G of the General Municipal Law of
the State by and between the City and Towns of Poughkeepsie, Wappinger
and LaGrange, and the Village of Wappingers Falls to lease, construct,
operate, close and monitor a municipal landfill on property leased from the
County of Dutchess located next to the Dutchess Airport and Route 376 in the
Town of Wappinger (the "Joint Landfill"); and
WHEREAS, the Town is considering a proposal that he Town issue its
general obligation bonds and notes pursuant to the Act for the purposes of
financing the Town's proportionate share of the cost of the planning and
construction of the closure of the joint Landfill, including pre -closure work,
testing, site preparation (including removal of tires), design and construction
of the closure and leachate collection facilities, in the aggregate principal
amount not exceeding Eight Hundred and Fifty Thousand, Three Hundred
and Sixty Eight Dollars ($850,368.00) (collectively, the "Project"); and
WHEREAS, the Town, by Resolution reasonably expected to be duly adopted
in 2002, is expected to determine to proceed under the provisions of the Act to
issue its general obligation bonds or notes for the purposes of financing its
proportionate share of the costs of the Project, subject to the terms an
conditions set forth in such Resolution; and
WHEREAS, the Internal Revenue Code of 1986, as amended, and the United
States Treasury Department regulations promulgated thereunder (together,
the "Code") require that an issuer who intends to reimburse itself for monies
to be advanced and expended for a capital project from the proceeds of a debt
obligation of the issuer, adopt Declaration of official Intent to so reimburse
not later than Sixty (60) days after the payment of any such original
expenditures paid with such advanced monies; and
WHEREAS, the Code provides that such Declaration may be made in the
form of a Resolution of the issuer.
NOW THEREFORE BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if
fully set forth and adopted herein.
2. The Town Board hereby finds and determines that:

(a) the Town has been vested with all powers necessary and convenient to
carry out and effectuate its proportionate share of the Project;
(b) it is the intent of the Town to issue and sell its General Obligations
Bonds (or notes in anticipation thereof) in the aggregate principal
amount not exceeding Eight Hundred and Fifty Thousand, Three
Hundred and Sixty Eight Dollars ($850,368.00) (the "Bonds") for the
purpose of financing its proportionate share of the cost of the Project.
(c) It is expected that under Section 149(e) of the code, interest on the
Bonds will not be includable in gross income for federal income tax
purposes.
(d) In anticipation of the issuance of the Bonds, the Town hereby states
its intention to reimburse monies of the Town hereafter expended in
connection with the Project through the issuance of the Bonds, such
reimbursement allocations to be made not later than Eighteen (18)
months after the later of:
• The date of the original expenditure is paid; or
• The date of the Project is placed in service or abandoned but in no
event more than Three (3) years after the original expenditure is
paid.
3. A copy of this Resolution shall be placed on file in the office of the Town
Clerk where the same shall be available for inspection during business
hours.
4. This Resolution shall take effect immediately.

RESOLUTION IN SUPPORT OF NEW YORK STATE DEPARTMENT
OF TRANSPORTATION TECHNICAL ASSISTANCE IN TRAFFIC
ENGINEERING AND TRANSPORTATION PLANNING FOR
LOCALITIES GRANT APPLICATION
The following Resolution was moved by Councilman Bettina and seconded by
Councilman Colsey.
WHEREAS, the Town board of the Town of Wappinger has recently
authorized Frederick P. Clark Associates, Inc., the Town's Planning
Consultants, to prepare a new comprehensive plan for the Town of
Wappinger; and
WHEREAS, the current comprehensive plan was prepared in 1988, since
which time, significant changes to the local and regional economy and
development patterns have occurred and require review, updating and
revision of the comprehensive plan; and
WHEREAS, the Town of Wappinger is seeking funding assistance with the
preparation of the traffic element of the new Town Comprehensive Plan
through the New York State Quality Communities Initiative; and
WHEREAS, the Town of Wappinger has prepared and submitted a complete
application for the New York State Department of Transportation Technical
Assistance in Traffic Engineering and Transportation Planning for Localities
grant reimbursement program to advance coordinated land use and
transportation planning; and
WHEREAS, the Town of Wappinger and the village of Wappingers Falls have
been working together to address mutual planning concerns, particularly
transportation planning and related land use issues; and
WHEREAS, the Town of Wappingers is committed to working with the
Village of Wappingers Falls, official and agencies of Dutchess County and
New York State in a spirit of intermunicipal cooperation; and
WHEREAS, both the Town of Wappinger and the Village of Wappingers Falls
are proud members of the Hudson River Valley Greenway Compact and are
committed to implementing its principals; and
WHEREAS, said grant application was submitted under cover letter from
Supervisor Joseph Ruggiero dated July 30, 2002, which letter clearly
articulated the position of the Town Board with respect to its support for the
grant application and its commitment to regional and intermunicipal
planning and the preparation and implementation of the new comprehensive
plan;

A Public Hearing was held by the Town Board of the Town of Wappinger on August
5, 2002, at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the
Proposed Local Law Regulation of Garage Sales in the Town of Wappinger.
Supervisor Ruggiero opened the meeting at 7:34 p.m.

The Town Clerk offered for the record, the Affidavit of Posting and Publication duly
signed and notarized. (These Affidavits are attached hereto and make part thereof
the Minutes of this Hearing).
Supervisor Ruggiero wished to know if there were any comments or question from
the audience.
Claire Gibson of 11 Spring Street, Chelsea explained that although she did not have
yard sales very often she felt this proposed law was very unfair that the residents
must apply for a permit. Supervisor Ruggiero explained the reason to have
residents apply for permits is to control the number of garage sales held by
residents. According to the Town Zoning Ordinance there is no law prohibiting
garage sales. What we are doing is authorizing garage sales legally. You just have
to register for the permit, and if you do more than three days in any consecutive
weekend, that would be deemed a business which would be illegal. Under this
proposed law you would be eligible to have four garage sales a year. Mrs. Gibson felt
that this just creates more paper work, and she feels that in the future there will be
a fee charged.
She also feels if the town limits it to four, why does the town need the dates.
Supervisor Ruggiero explained that the town wishes to keep track. At present there
are people who do abuse this and the only way to control it to put a system in place
where residents can hold a garage sale legally.
There were no more comments or questions.
COUNCILMAN VALDATI moved to close the Public Hearing, seconded by
Councilman Bettina and unanimously carried

Code are to regulate transient, sta-
tionary and semi -stationary peddling
and soliciting In the Town of
Wappinger, such that:
".Peddlers and solicitors shall not
stand or remain:
(a) Within 100 feet of any pudic street
intersection.
(b) On any public sidewalk.
(c) Within 250 feet of any commer-
cial establishment which sells like
goods, public building, government
building, premises occupied as a
public or private school or college or
'used for such purposes. or premises
primarily used for religious purposes.
2. There shall be no stationary ped-
dling in Residential Districts.
3. No peddlers or solicitors shall have
any exclusive right to any location in
the public streets nor shall a licensee
be permitted to operate in a con-
gested area where such operation
impedes access to the entrance of
an adjacent building or driveway, on
the paved portion of any public high-
way, obstruct traffic flow, or otherwise
create circumstances which would
endanger the public health, safety
and welfare of the traveling public. For
the purpose of this Chapter, the judg-
ment of any police officer or of the
Building Inspector or Zoning Admin-
istrator of the Town of Wappinger ex-
ercised in good faith shall be deemed
conclusive as to whether the area is
congested or the public Impeded or
inconvenienced.

Supervisor Ruggiero opened the meeting at 7:42 p.m.

COUNCILMAN VALDATI moved to close the Public Hearing, seconded by

NOTICE IS HEREBY GIVEN that the
Town Board of the Town of Wappinger
will conduct a PUBLIC HEARING on
the 5th day of August, 2002, at 7:30
P.m. at the Town Hall, Town of
Wappinger, 20 Middlebush Road,
Wappingers Falls, New York, at which
time all parties in interest and citizens
shall have an opportunity to be heard
as to whether the Town Board of the
Town of Wappinger shall adopt a pro-
posed Local Law entitled 'Local Law
No. _ of the Year 2002, Amend-
ments to Town of Wappinger zoning
Code Definition of Building Height
and Driveway Specifications.'

that a summary of the proposed
Amendments are as follows:.
A. Building Height; The greatest ver-
tical distance measured from the
adjoining finished grade at the front
of a building to the highest point of
the roof ifthe roof Is f lat or to the mean
level between the eves and the high-
est point of the roof H the roof is of
any other type.
B. Driveway gne ifi ahons: Drive-
ways and access roads shall be so
designed so as to provide Fire De.
partment apparatus access to within
a distance of seventy-five (75) feet
orless of the structure that may be
called upon to be protected and such
driveways and access roads shall be
designed so as to meet the following
requirements:
(1) Driveways under Five Hundred
(500) feet long shall have a minimum
width of Twelve (12) feet; Driveways
over Five Hundred (500) feet long
shall have a minimum width of Twelve
(12) feet and, in addition, shall have
a Fifty (50) foot by Twelve (12) foot
pull -of every Five Hundred (500) feet
to accommodate a Forty (40) foot
long piece of Fire Fighting appara-
tus.
(2) The driveways shall have'and
maintain an overhead clearance of
Fifteen (15) feet, free of any obstruc-
tions such as tree branches, personal
light poles, utility wires, etc.
(3) The driveway base shall be suffi-
cient to support a Thirty (30) ton Fire
Fighting apparatus.
(4) No turns shall be of such a de.
cree as to prevent access of Fire De.
partment apparatus.
