The Reorganization Meeting of the Town Board of the Town of Wappinger
was held on January 2, 2002 at the Town Hall, 20 Middlebush Road,
Wappingers Falls, Dutchess County, New York. SUPERVISOR RUGGIERO
Opened the Meeting at 7:30 p.m.

The SUPERVISOR asked all to join in the Pledge of Allegiance to the Flag.
The SUPERVISOR confirmed the appointment of Gina Basile, Confidential
Secretary to the Supervisor, Andrea Paustian as Bookkeeper and hereby
appoints Joseph Paoloni as Deputy Supervisor.
COUNCILMAN COLSEY moved to accept the above confirmations and
appointments as presented by the Supervisor and place on file.

The TOWN CLERK confirmed the appointment of Sandra Kosakowski as
First Deputy Clerk, Florence Hannon as Second Deputy Clerk & Dorothy
Groark as Third Deputy.

presented by the Town Clerk and place them on file.

the office of Comptroller in the Town of Wappinger, to serve in such capacity
for a term ending on the 31st of day of December, 2002, and

annual salary of $47,313.00 payable every Friday throughout the year 2002,

RESOLVED, that Patricia Maupin be and she hereby is appointed to
the office of Receiver of Taxes and Assessments in the Town of Wappinger,
to serve in such capacity for a term ending on the 31st day of December,
2002, and
BE IT FURTHER RESOLVED, that the Receiver of Taxes and
Assessments be paid an annual salary of $ 40,514.00, payable every Friday
throughout the year 2002, with the first payday to be January 4, 2002, and
BE IT FURTHER RESOLVED, that the Receiver of Taxes and
assessments be and she hereby is authorized to employ such clerical
employees as may be necessary for the performance of her duties and to

RESOLVED, that the pay scale for the employees hired by the Town
of Wappinger Highway Department will be in accordance with the C.S.E.A.
contract, and
BE IT FURTHER RESOLVED, that all such Highway Department
employees engaged on an hourly basis shall be paid every Friday throughout
the year 2002 with 52 pay periods during such year consistent with the pay
schedule in accordance with a signed C.S.E.A. contract, with the first payday
to be January 4, 2002.

STATISTICS FOR THE TOWN OF WAPPINGER
The following Resolution was offered by COUNCILMAN BETTINA who
moved its adoption.
RESOLVED, that Gloria J. Morse be and she is hereby appointed to
serve as Registrar of Vital Statistics to the town of Wappinger, Dutchess
County, New York, for a term of two years commencing January 1St, 2002
and ending December 31St, 2003, pursuant to Section 4123, Public Health
Law, and
BE IT FURTHER RESOLVED, that said Registrar of Vital Statistics
to the Town of Wappinger shall receive no salary or compensation, however,
she shall be entitled to receive for the performance of the duties of this
respective office the fees fixed by applicable statute.

RECREATION COMMITTEE OF

The following Resolution was offered by COUNCILMAN BETTINA who
moved its adoption:
RESOLVED, that Ralph Holt, Chairman of the Recreation
Committee, be and he hereby is appointed to serve as the Consultant to the
Town of Wappinger Recreation Committee, and
BE IT FURTHER RESOLVED, that the annual salary for the
Consultant to the Recreation Committee of the Town of Wappinger be and
the same hereby is fixed and established at the annual rate of $ 10,924.00 to
be paid every Friday throughout the year with the first payday to be
January 4, 2002.

RESOLUTION NO. 18 2002
TOWN BOARD, TOWN OF WAPPINGER
DESIGNATING COURT OFFICER FOR
THE TOWN OF WAPPINGER JUSTICE COURT
The following Resolution was offered by COUNCILMAN VALDATI who
moved its adoption:
RESOLVED, that all individuals hereinafter designated by the Town
Board as Court Officers as such title is defined by the Uniform Justice Court
Act have all those powers accorded to Court Officers by Law during such
time they are actually serving in such capacity, and
BE IT FURTHER RESOLVED, that the Town Justices of the Town shall
designate and schedule the days and evenings such individuals shall serve
as Court Officers, and
BE IT FURTHER RESOLVED, that the Court Officers shall be
compensated at the hourly rate of $ 10.26 for time actually served, and
BE IT FURTHER RESOLVED, that Armed Court Officers shall be
compensated at the hourly rate of $14.38 for time actually served at sessions
of Court where their services are required and,
BE IT FURTHER RESOLVED, that the Town Justices shall submit to
the Town Comptroller on a weekly basis, the names and hours served, and
that the Town Comptroller be empowered to issue remuneration consistent
with the foregoing, from funds appropriated for Justice Court, and
BE IT FURTHER RESOLVED, that the following individuals be
designated as Court Officers for the Year 2002.

holding full time or part-time positions, as otherwise fixed, be and the same
hereby are fixed and established as follows:
Gary Corbett Vandalism Patrol Coordinator $ 19.97 per hour.
Gretchan Leak Recycling Assistant (weekly) $ 40.00
BE IT FURTHER RESOLVED, that all such persons so designated
shall be paid every Friday throughout the year 2002, with 52 pay periods
during such year, with the first payday to be January 4, 2002.

Supervisor Ruggiero informed the Board that Sargent Corbett is currently
on military duty at the World Trade site, and in his absence Sargent
Waterson is acting on his behalf. Supervisor Ruggiero will be meeting with
Sargent Waterson in the next few days.

moved its adoption:
RESOLVED, that the weekly salaries for certain personnel retained
to give weekly exercise classes to the Senior Citizens be and the same
hereby is established as follows.

Supervisor Ruggiero informed that Board that he was notified during the
last week prior to taking office, that the Town's insurance was about to
expire. Jack Peluse of Marshal & Sterling contacted the insurance company
to make sure we were covered. After speaking to other Supervisors, Mr.
Ruggiero was informed that there were ways to go out to bid for insurance
to save the Town money, which he wishes to pursue, but he did not want our
insurance to lapse. Mr. Peluse assured him that he has renewed the
insurance and within the next few months we can discuss going out to bid.

Department Head shall be established at the minimum hourly rate, or if
otherwise fixed and established, shall be subject to the approval of the Town

WHEREAS, the Justice Court has had an increase in its work load
and has the need of having to make change on a daily basis, and
WHEREAS, the Town Clerk of the Town of Wappinger has numerous
requests for expenditures of small amounts of cash for postage, supplies,
making change on a daily basis, and various miscellaneous items, for various
departments of the Town of Wappinger, and
WHEREAS a Petty Cash fund has been established for the Receiver of
Taxes, pursuant to the provision of Section 64, paragraph 1-a of Town Law,
which shall be reimbursed to the Supervisor for advances at the close of each
fiscal year, and
WHEREAS, the Recreation Committee has numerous request for
expenditures of small amounts of cash for supplies and miscellaneous items
and reimbursement of small expenditures to various areas of the Recreation
program and Maintenance work for the Town of Wappinger,
NOW THEREFORE BE IT RESOLVED, that the Town Justice Court,
the Town Clerk, and the Receiver of Taxes are hereby authorized and
directed to establish a Petty Cash Fund, in the sum of $200 each, for the use

WHEREAS, subdivision 10 of Section 29 of the Town Law requires
that the Supervisor of each Town prepare and file with the Town Clerk
within 30 days after the expiration of each fiscal year an annual financial
report accounting for all monies received and disbursed by him, together
with the certificates or certificate of the bank or trust company where Town

monies are deposited, showing the amount of such monies on deposit with
said bank or trust company, and cause a certified copy of such report to be
published in the official newspaper, and
WHEREAS, in lieu of preparing the report required by Subdivision 10
of Section 29 of Town Law, the Town Board may determine, by resolution,
that the Supervisor shall submit to the Town Clerk within 60 days after the
close of the fiscal year, a copy of the report to the State Comptroller
required by Section 30 of the General Municipal Law and the Town Clerk
shall cause a summary of such report to be published within 10 days after
receipt thereof in a form approved by the State Comptroller in the official
newspaper.
NOW, THEREFOR IT IS HEREBY RESOLVED, that in lieu of
preparing the report required by Subdivision 10 of Section 29 of Town Law,
the Supervisor shall submit to the Town Clerk within 60 days after the close

WHEREAS, it has come to the attention of this Town Board of the
Town of Wappinger that there are now or may be in the future, funds and
monies, except proceeds of loans and monies the investment of which is
otherwise provided by law, belonging to the Town which are or which may be
in excess of the amount required for immediate expenditure to pay current
expenses and obligations, and
WHEREAS, it is or it may be to the advantage of the Town to deposit
and/or invest all or part of such funds in special time deposit accounts, or in
certificates of deposit issued by banks or trust companies located and
authorized to do business in this State, short term obligations of the United
States of America and/or the State of New York, and
WHEREAS, it appears that the Temporary Deposit and/or investment
of such excess and surplus funds may be beneficial and profitable to the
Town of Wappinger,
NOW THEREFORE, IT IS HEREBY RESOLVED, that the duly
elected, qualified and acting Supervisor of the Town of Wappinger be and he

manner prescribed by Section 11 of the General Municipal Law of the State

PURCHASING PROCEDURES

WHEREAS, pursuant to Town Law, a Budget is prepared each year
by the Supervisor detailing expenses and revenues for the ensuing year, and

reject or modify any budgetary item as they deem appropriate, and
WHEREAS, that after due process of Public Hearing and provision for
additional amendments, the annual Budget shall be adopted,

section 117 of the Town Law where provisions have been made in the annual
budget for specific, large expenditures, further approval by the Town Board
to consider the purchase of those expenditure need not be sought, provided
that no other part of the Town's procurement Policy is circumvented, and

bids on various large purchases may not be required if any item is available

Pursuant to subdivision 104-b of the General Municipal Law the Town
adopted a Procurement Policy establishing purchasing procedures and
bidding limits for commodities and Public Works projects.
BE IT RESOLVED that the Town's Procurement Policy is hereby referred to
a Town Board Workshop for further review and study and the Procurement
Policy as set forth in Chapter 46 of the Code of the Town of Wappinger shall
remain in full force and effect until further action by the Town Board.

The following Resolution was offered by COUNCILMAN VALDATI who
moved its adoption, as drafted, and seconded by COUNCILMAN COLSEY.
A RESOLUTION AUTHORIZING THE ISSUANCE OF $250,000 BONDS
OF THE TOWN OF WAPINGER, DUTCHESS COUNTY, NEW YORK, FOR
THE ACQISITION OF VARIOUS MACHINERY AND APPARATUS FOR
CONSTRUCTION AND MAINTENANCE PURPOSES FOR USE BY THE
HIGHWAY DEPARTMENT IN AND FOR SAID TOWN
WHEREAS, the applicable provisions of the State "Environmental
Quality Review Act have been complied with to the extent required with
respect to the above -titled purpose;
BE IT RESOLVED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows"
Section 1. The financing of the acquisition of various machinery and
apparatus for construction and maintenance purposes for use by the Town
Highway Department in and for said Town, a class of objects or purposes, is
hereby authorized.
Section 2. The maximum estimated costs of such class of object or
purposes is $250,000, and the plan for the financing thereof is by the
issuance of $250,000 bonds of said Town hereby authorized to be issued
therefor pursuant to the Local Finance Law.
Section 3. It is hereby further determined that the period of probable
usefulness of the aforesaid class of objects or purposes is five (5) years,
pursuant to subdivision 28 of paragraph a of Section 11.00 of the Local
Finance Law. It is hereby further determined that the maximum maturity

Of the bonds herein authorized will not exceed five years, and that the
foregoing is not an assessable improvement.
Section 4. Subject to the provisions of the Local Finance Law, the
power to authorize the issuance of and to sell bond anticipation notes in
anticipation of the issuance and sale of the bonds herein authorized,
including renewals of such notes, is hereby delegated to the Town
Supervisor, the chief fiscal officer. Such notes shall be of such terms, form
and contents, and shall be sold in such manner, as may be prescribed by said
Town Supervisor, consistent with the provisions of the Local Finance Law.
Section 5. The faith and credit of said Town of Wappinger, Dutchess
County, New York, are hereby irrevocably pledged for the payment of the
principal of and interest on such obligations as the same respectively become
due and payable in such year.
Section 6., Subject to the provisions of this Resolution and of the Local
Finance Law, and pursuant to the provisions of 30.00 relative to the
authorization of the issuance of bond anticipation notes or the renewals
thereof, and of 50.00 and 56.00 to 60.00 of the Local Finance law, the powers
and duties of the Town Board relative to authorizing the issuance of any
notes in anticipation of the sale of the bonds herein authorized, or the
renewals thereof, and relative to prescribing the terms, form and contents
and as to the sale and issuance of the bonds herein authorized, and of any
notes issued in anticipation of the sale of said bonds or the renewals of said
notes, are hereby delegated to the Town Supervisor, as the chief fiscal officer
of the Town. The Town Supervisor may sell such bonds at public or private
sale, at a discount or premium, at fixed or variable rates of interest or at no
interest whatsoever, or as capital appreciation bonds, and with such
amortization of principal as the Town Supervisor shall determine is most
favorable to said Town, and in compliance with any rules of the State
Comptroller applicable thereto. Such notes shall be of such terms, form and
contents, and shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with the provisions of the Local Finance Law. The
Town Supervisor, in the event it is determined to issue variable rate bonds,
is hereby authorized to enter into such agreements as said officer finds
reasonable to facilitate the issuance, sale, resale and repurchase of such
bonds, as authorized under Section 54.90 of the Local Finance Law. The
Town Supervisor is also authorized to enter into such agreements and take
such other action as my be necessary or appropriate and lawful to assure
that interest on the bonds and notes authorized hereby will not be includable
in the gross income, for federal income tax purposes, of the recipients
thereof.

Section 7. The validity of such bonds and bond anticipation notes may
be contested only if:
1) Such obligations are authorized for an object or purpose
for which said Town is not authorized to expend money,
or
2) The provisions of law which should be complied with at
the date of publication of this resolution are not
substantially complied with, and action, suit or
proceeding contesting such validity is commenced within
twenty days after the date of such publication, or
3) Such obligations are authorized in violation of the
provisions of the Constitution
Section 8. This resolution, which is effective immediately, shall be
published in summary in the Southern Dutchess News, the official
newspaper, together with a notice of the Town Clerk in substantially the
form provided in Section 81.00 of the Local Finance Law.
The question of the adoption of the foregoing resolution was duly put to a
vote on roll call, which resulted as follows:

The resolution was thereupon declared duly adopted.
SUPERVISOR RUGGIERO announced that Kevin Jeffreys came in today to
help set up the e-mail account for the Supervisors office. The Councilman
will get official e-mail accounts that can be logged in from their homes to get
e-mail and correspondence. Once it is all set up, you will be given the
passwords in order to log in from home. The locks have been changed and
new keys will be issued. There were also problems with the phones and the
heat.
COUNCILMAN BETTINA wished to look into going out to state bid for
purchase of a four wheel drive car for the Supervisor, at a future workshop.
COUNCILMAN BETTINA moved to close the Reorganization Meeting,
seconded by Mr. Paoloni, and unanimously carried.
The Reorganization Meeting closed at 8:30 p.m.
