RESOLUTION AWARDING CONTRACT FOR
WAPPINGER WATER EAPROVEMENT AREA —1999-2(R) CONTRACT NO. 6
The following Resolution was introduced by Mr. Paoloni and seconded by
Mr. Colsey
WHEREAS, the advertisement for bids for Wappinger Water Improvement Area —1999-
2(R) Contract No. 6 was published in the Southern Dutchess News and Poughkeepsie Journal
newspapers on June 5, 2002; and
WHEREAS, bids were opened on June 28, 2002 and reviewed by Gloria J. Morse, Town
Clerk of the Town of Wappinger; and
WHEREAS, Joseph E. Paggi, Jr., P.E. of Paggi, Martin & Del Bene, Engineers to the
Town of Wappinger, has provided an award recommendation to the Town Board.
NOW, THEREFORE, BE IT RESOLVED,
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Contract for Wappinger Water Improvement Area —1999-2(R) Contract No. 6
is hereby awarded to Clayton Industries doing business at 86 Fox Hill Road,
Wallkill, New York 12589 for the price of $1,533,250 in accordance with the award
recommendation letter dated July 1, 2002 from Joseph E. Paggi Jr. of Paggi, Martin
& Del Bene, Engineers to the Town of Wappinger, to the Town Board.
3. Supervisor Joseph Ruggiero is hereby authorized and directed to execute said
Contract on behalf of the Town of Waappinger.

RE: Wappinger Water improvement 99-2(R)
Contract No. 6
We have reviewed the above bids and find them all to be numerically correct and in order.
Our construction cost estimate was 52,250,000.00. The apparent low bidder is approximately
32% below our estimate and 5433,416.00 below the second lowest bidder.
We have spoken with the principal of Clayton Industries, Harry C. Serviss III, on Friday, June
281' and today, regarding his bid to insure that he included all of the items of the project. Mr.
Serviss indicated that he included all of the items and was confident in his bid.
Currently, we are checking the references provided to us from Clayton Industries. The references
we have contacted thus far have given Clayton Industries a satisfactory rating.
One issue that has surfaced with Clayton Industries was a problem they had an a Municipal job
for the Town of Wallkill. Apparently, the Town of Walldll and Clayton Industries had some
contractual differences, and Clayton's Bonding Company is seeking quotes to complete the
project.
We would recommend that the Town attorney reviews the bid bond and contact the attorney for
the Town of Wallkill for additional information on the problem with their project.
Subsequently, no recommendation of award will be made until all references are contacted and
the Town attorney finishes his research.
At that point, a special Town Board meeting will be requested to take the appropriate action.
