A Public Hearing was held by the Town Board of the Town of Wappinger on
November 13, 2001, at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York on the Benefit Assessment for the Ardmore Water
Improvement
COUNCILMAN VALDATI opened the meeting at 7:20 P.M.

At this time Attorney, Gerrald Vergilis went on to explain that last year our
Court of Appeals had decided that whenever a municipality was going has
created a special benefit district, such as water and sewer, that public notice
must be given by letter to everyone whose property will be effected. Before
this was decided municipalities could create these special benefit districts by
just advertising in the newspaper and then having a Public Hearing such as
this one. This is not to create new benefit or special assessment districts,
because some of these have been around for as many as 20 years. Mr. Paggi,
Engineer to the Town went on to explain how the districts were formed, what
a benefit unit was and how the formula was determined for the benefit units.
By the time the entire sewer project is done there will be five to six phases.
Each phase takes between three and five years to develop, design and build.
If you do not have a sewer line in front of you house, your not paying for the
sewer line, your paying for your share of that large trunk line that you will
eventually hook into. Until you receive the sewer service your share or cost
of that trunk line increases by 25% to the full $49. Until you do that your
share is only 75%. Mr. Anderson of Spook Hill Road wished to know what
happened to the first phase that we paid for in the 70's. Mr. Paggi
announced that the district is still in effect. Most of the residents that have
septic tanks wished to know when they are going to get sewers. Mr. Paggi
informed her that we respond to need for each individual phase. We keep a
master list and a history of failing systems to identify where the needs are.

The rate for the Myers Corners II Water District in 2001 was $715 and in
2002 will be $ 726. Mr. Paggi explained that the Pizzagalli Building is the
sole resident of the Myers Corners II. Mr. Paggi was asked to explain what
was meant by a benefit unit. He explained that a benefit unit is a method of
measurement which we assess special districts defined as a piece of property
with 2 acres or less with a house on it. If it's a vacant piece of property of less
than 2 acres, is .8 benefit units. If its in excess of 2 acres with a house is 2
plus .2 benefit units. For the majority of the people here tonight with less
than 2 acres with a house, its 1 benefit unit.

The rate for the Oakwood Knolls Water District for 2001 was $14.52 and in
2002 will be $13.89. One resident explained that he lived on Lake Oniad
Drive and wished to know how these fees would impact him on his tax bill.
Mr. Paggi explained he was in Central Wappinger Water and that
assessment is going up $8 this year. Wappinger Cranberry is going down
about 70 cents.
COUNCILMAN RUGGIERO moved to close the Public Hearing, seconded by
Mr. Valdati and unanimously carried.

2002 will be $10.96. One of the residents had a question on all the hearing
matters. It seems all they are finding out is what the rates are going to be.
COUNCILMAN RUGGIERO explained that this is the capital chart for the
bonding. This is what we bonded over the years to build these water and
sewer plants, these are fixed costs like the mortgage on your home for the life
of the loan. When you see a decrease its because its being paid down. If you
see an increase its because we are constructing. There is no room to
negotiate, these are the costs of the bonding.

#2. The rate for the Wappinger Sewer Transmission Treatment
Improvement #2 in 2001 was $45.96 and in 2002 will be $49.07.
COUNCILMAN VALDATI asked if there were any questions or comments
from the audience. Mr. Lopez of Ingall Street, explained that his is the only
house on the street and has three 50' non -buildable lots that he is getting
billed for. He has a letter from former Assessor, Tom Logan that said the
lots had no value in 1983, but he is still getting billed. COUNCILMAN
VALDATI wished to bring this to the attention of the Town Assessor, because
if their not buildable lots then they should not be handled as a benefit unit.
Mr. Lopez also informed the board that he has been paying double water and
sewer rates because he is considered a tenant to the Village and there is no
way that he can hook up to the new town water/sewer. He would have to go
through someone's property. Mr. Paggi explained that there was an
agreement made between the Town and the Village about ten years ago, and
the properties in the Town were hooked up to Village facilities that were
paying double rates, the arrangement was that they would stop paying
double rates and would start paying capital assessment to the Town. Mr.

Paggi recommends that Mr. Lopez's case be turned over to Attorney, Al
Roberts to be address.

Mr. Lutz who lives on the far end of Myers Corners Road explained that he
has been paying on the treatment plant since 1991 and no when can give him
any indication when he will see a sewer line out there. Mr. Paggi explained
that they are extending the trunk lines in phases, and that section of
property is on the extreme end of the district, so it would be in one of the last
phases. We have completed No. 3 and are starting the 4th . Each phase takes
around 3 years, and yours should be done in 9 years. Doug Somers of
Middlebush Road wished to know what phase he would be in and Mr. Paggi
answered he would be in phase 3B, which is on the table now.

A Public Hearing was held by the Town Board of the Town of Wappinger on
November 13, 2001 at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York on the Benefit Assessment for the Wappinger Sewer
Transmission Treatment Phase 3A.
COUNCILMAN VALDATI opened the meeting at 8:28 p.m.

The Town Clerk offered for the record the Affidavit of Posting and
Publication duly signed and notarized. (These Affidavits are attached hereto
and made part thereof the Minutes of the meeting).
The rate for the Wappinger Sewer Transmission Treatment Phase 3A in 2001
was —0- and in 2002 will be $547.76.
COUNCILMAN VALDATI wished to know if there were any questions or
comments from the audience, and Christine Mitchell a member of board the
Pavilion was recognized. She explained that the Pavilion represents 280
benefit units. She had prepared an analysis and looked at the total cost and
divided it by the number of benefit units. She claimed it didn't add up. The
number of benefit units that was in the original map, plan and report did not
agree with the number of benefit units that went into the calculation. She
sat down with the Assessor and she mentioned that the map that was
provided by the Engineer was missing parcels. She was told as of today that
there was an additional map that was provided by the Engineer and those
parcels have been put back on, but those numbers still don't add up.
Engineer to the Town explained that in 1996, when Phase 3A was developed,
benefit units were assessed at 1,448. The number now is about 1,379. Ms.
Mitchell felt that there was several flaws in the calculation. It very important
that calculate the number correctly. Mr. Paggi went on to explain that in
1996 when the district was formed we estimate the total amount of the
project. The total amount of the project has not increased. We also estimate
a bond amortization schedule based on interest rates of 1996. These were

developed six years ago, but they are not the final amortization schedules.
They are based on the dates they were developed, which was 1996. The
interest rate realized by the municipality in 1996 are different in 2002. As
far as the benefit units go, we sat down in 1995-96 with the Assessor and we
make spread sheets of every single benefit unit in the district. Benefit units
change every year. The change because property is developed, houses are put
up, assessments change. This is a formula that has been in use since 1972.
COUNCILMAN VALDATI informed Ms Mitchell that we are going to require
the Engineer, Assessor and Comptroller go over the questions you raised and
in the next few days we will expect a rendering from all of them as to the
questions that you have raised here tonight. We will have that to deliberate
before we sit down and vote on the budget on the 19th of November. There
may be an adjustment. Mr. Bonani of Orange Court wished to know if he
was in a water district. Mr. Paggi answered no. Mr. Paggi also explained
why some residents were paying less than others and where the trunk lines
were located.
There were no more questions or comments.
COUNCILMAN VALDTI moved to close the Public Hearing, seconded by Mr.
Ruggiero and unanimously carried.
The Public Hearing closed at 8:55 p.m.
