Supervisor Smith called the meeting to order at 7:48 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Paoloni, Councilman Joseph Ruggiero, Councilman Others Present: Jay Paggi, Engineer to the Town Gerald Vergilis, Acting Attorney to the Town Graham Foster, Highway Superintendent Absent: Gloria Morse, Town Clerk The Supervisor requested all to join in the Pledge of Allegiance to the Flag. MINUTES The Minutes of the Regular Town Board Meeting of June 25, 2001 and Special Town Board Meeting of July 11, 2001 having previously been forwarded to the Board Members, were now placed before them for their consideration. COUNCILMAN RUGGIERO moved that the above stated Minutes as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Paoloni Motion Unanimously Carried REPORTS OF OFFICERS Reports for the month of July were received from the Town Justices, Supervisor/Comptroller, Building Inspector, Zoning Administrator, and Dog Control Officer for May and June COUNCILMAN VALDATI moved to accept the reports and place them on file. Seconded by Mr. Valdati Motion Unanimously Carried PETITIONS & COMMUNICATIONS Correspondence was received from Christine Hickey complaining about the frequent rate increases in her cable bill. Over the past year her cable bill has continually increased without explanation. COUNCILMAN PAOLONI moved to accept the correspondence and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Scott T. LeRoy informing the Board that his family wishes to donate a rare document that was found in the Red Barn on the old Horton property when they owned it. The document proclaims the Exempt Fireman status to Mr. George Horton on April 1, 1926 to the Town of Wappinger. The only stipulation is to identify 07/23/2001.RGM his family's generosity by placing a donation plate on the future frame of the document identifying: "A Donation by William, Diane and Scott LeRoy 2001 ". COUNCILMAN RUGGIERO moved to accept the rare document and authorize the Town Clerk to send a letter of thanks. Seconded by Mr. Bettina Motion Unanimously Carried Next is Dan Stone, Engineer for the Chelsea Ridge Complex to discuss the potential for bringing a new water supply to the Chelsea Ridge Complex. He discussed three (3) alternative means. Poughkeepsie, City of Beacon and Village of Fishkill. After carefully looking at these alternatives they have determined that the cost of bringing water from the Town of Poughkeepsie, would be about 3.5 million total cost. The second alternative to bring water from the City of Beacon would be around 2.1 million and the cost to bring water from the Village of Fishkill to be about 1.6 million. He feels that his client, Chelsea Ridge Complex should pursue getting the water from the Village of Fishkill. Discussion followed. Supervisor Smith announced that a workshop and a presentation for a public informational meeting would be needed. COUNCILMAN BETTINA moved to set a workshop for 10/08/01 at 7:30 p.m. Seconded by Mr. Valdati Motion Unanimously Carried Notification from Marshall & Sterling, Insurance Carriers for the Town of Wappinger, that the renewal rate for the upcoming term would increase from $3.70 to $4.95, due to recent claims history. COUNCILMAN RUGGIERO moved to accept the notification and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried Al Roberts, Attorney to the Town with several reports. The first is a Summary Report of a Limited Appraisal for the property owned by Castor Alverez, Jr. located at 178 Smithtown Road together with an invoice in the amount of $1,500 from McGrath, Basciani & Associates. COUNCILMAN BETTINA moved to accept the Appraisal Report on Smithtown Road and place it on file. Seconded by Mr. Paoloni Motion Unanimously Carried Notification from Mr. Roberts that the DeGarmo Culvert Robert G. Haas & Doris Haas f/k/a Doris Fleishman Easement and Agreement were recorded with the Dutchess County Clerk on June 27, 2001. COUNCILMAN PAOLONI moved to accept the notification from Mr. Roberts and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried The next item for discussion is Computer Software for the Building Department. COUNCILMAN VALDATI move to take to a workshop. 2 Seconded by Mr. Paoloni 07/23/2001.RGM Motion Unanimously Carried As per the Town's request, Frederick P. Clark Associates has prepared a Full Environmental Assessment Form for the proposed Town Community Center. COUNCILMAN RUGGIERO moved to accept the Full Environmental Assessment Form for the proposed Town Community Center and declare a Negative Declaration. Seconded by Mr. Bettina Motion Unanimously Carried. Next are several reports from Jay Paggi, Engineer to the Town. The first report concerns the lab results on Doyle Drive. CAMO Pollution Control took a sample and ran a POC analysis. All results were under the maximum contaminant level for drinking water and/or listed as non-detected. The only parameter that was detected was MTBE, which level was 1.2 parts per billion. The 1.2 parts per billion that was realized is more or less a background level and is evident in just about any environment that would be tested. We do need to test for herbicides and pesticides prior to advising that the Highway Department could make any excavations. When the results are in, Mr. Paggi will advise the Board and Graham Foster. Mr. Foster informed the board that a new sink hole has shown up on the Todaro property around 50 feet from where the excavation will be done. We will need to negotiate another easement. COUNCILMAN VALDATI move to accept the report and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried COUNCILMAN VALDATI moved to accept the Todaro easement and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts work with Mr. Paggi and Mr. Foster in expanding the easement to investigate the sink hole. Seconded by Mr. Paoloni Motion Unanimously Carried The next report concerns the Kent Road/All Angels Hill Road re -alignment. Three copies of maps had been prepared indicating the proposed realignment (one for Mr. Roberts office, one each for the affected property owners). The proposed improvements would result in Kent Road shifting approximately 18' in a northerly direction. This would require the Town secure additional road right-of-way along the northerly side of Kent Road. The affected properties are: Thomas W. Connollan, 2 Robin Lane and Timothy J. & Sharon Sullivan, 4 Robin Lane. COUNCILMAN RUGGIERO moved to authorize Attorney to the Town to obtain the necessary right-of-way. Seconded by Mr. Paoloni Motion Unanimously Carried 3 07/23/2001.RGM The next report is in reference to the various sewer and water improvements. As you are aware, we are proceeding with the construction of numerous sewer and water projects within the town of Wappinger. With this new construction it came to mind that there is a necessity for placing these new Districts/Improvements on the tax rolls. The Districts/Improvements that come to mind are: • Wappinger Sewer Transmission/Treatment Improvement Area — Phase 3A • Wappinger Water Improvement 99-1 • Wappinger Water Improvement 99-2(R) COUNCILMAN RUGGIERO moved to accept the report and place on file. Seconded by Mr. Bettina Motion Unanimously Carried The next report concerns the feasibility of extending the service area of the Central Wappinger Water Improvement Area to provide water to an area along New York State Route 376 and possibly to the Spring Terrace Wyndham Crossing and Russell Road subdivisions. COUNCILMAN RUGGIERO moved to take to the 10/08/01 Workshop for further discussion. Seconded by Mr. Paoloni Motion Unanimously Carried Mr. Paggi was also authorized to prepare a Map, Plan and Report for the Fleetwood II Water District in order to provide water to an area along Osborne Hill Road. COUNCILMAN BETTINA moved to accept the Map, Plan and Report for the Fleetwood II Water District and take to a 10/08/01 Workshop. Seconded by Mr. Ruggiero Motion Unanimously Carried Mr. Paggi requested a Change Order for the Wappinger Sewer Transmission/Treatment Phase 3A, Contract No. 2 due to a decision to tie in the Bell -Aire Lane ejector station at this point in time to the collector lines on Contract No. 2. Mr. Paggi feels this would be in the best interest of the Town. To make the final connection, the Contractor has submitted an amount of $7,100.00. Mr. Paggi finds this amount acceptable and recommends the Board approve the Change Order. COUNCILMAN RUGGIERO moved to approve the Change Order based upon the recommendation of Mr. Paggi. Seconded by Mr. Valdati Motion Unanimously Carried The last report concerns the Alpine rezone parcels. COUNCILMAN RUGGIERO moved to table at this time. Seconded by Mr. Bettina Motion Unanimously Carried 4 07/23/2001.RGM Next are the bid results for the Wappinger Water Improvement 99-2 (R) Cider Mill Loop Water Storage Facility Tank Rehabilitation/Painting. The bids were open on July 201h, 2001 at 11:00 a.m. Bid results are as follows: 1. Benjamin Construction, Inc. $108,000.00 2. Demco Enterprises $123,000.00 3. United Eagle Painting, Corp: $124,020.00 4. JNP Construction Corp. $147,460.00 5. Millstone Corp. $159,021.00 Mr. Paggi has reviewed the bids and finds them to be in order, and therefore, recommends that the bid be awarded to Benjamin Construction, Inc., in the amount of $108,000.00, they being the lowest bid. COUNCILMAN VALDATI moved to award the bid for the Wappinger Water Improvement 99-2 (R) Cider Mill Loop Water Storage Facility Tank Rehabilitation/Painting to Benjamin Construction, Inc. for $108,000.00 based on the recommendation of Mr. Paggi. Seconded by Mr. Ruggiero Motion Unanimously Carried Notification from the State of New York Office of Real Property Services with respect to determination of adjusted base proportions, they have determined the assessed value of the special franchise property on the levy roll at the reference (prior) roll level of assessment amounts to $14,226,022 for the Town of Wappinger COUNCILMAN VALDATI moved to accept the notification from the State of New York Office of Real Property Services and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried Next are several requests for the return of escrow. The first is a request from Scott and Sandra Nunziata, 60 Red Hawk Hollow Road, $1,500 for seeding. COUNCILMAN BETTINA moved to authorize the return of escrow in the amount of $1,500 to Scott and Sandra Nunziata based on the recommendation of Deputy Building Inspector. Seconded by Mr. Ruggiero Motion Unanimously Carried A request for return of escrow from Frank Hunter of 35 Losee Road $35 for return of Building Permit fee. COUNCILMAN PAOLONI moved to authorize the return of escrow in the amount of $35 to Frank Hunter, based on the recommendation of the Building Inspector. Seconded by Mr. Ruggiero Motion Unanimously Carried A request for return of escrow from John Mirabillo, 20 Old State Road, $1,500 for seeding. COUNCILMAN BETTINA moved to authorize the return of escrow in the amount of $1,500 to Mr. Mirabillo, based on the recommendation of the Deputy Building Inspector. 5 07/23/2001.RGM Seconded by Mr. Ruggiero Motion Unanimously Carried A request for return of escrow, from Mark Mason, 42 Losee Road, $500 for seeding. COUNCILMAN BETTINA moved to authorize the return of escrow in the amount of $500 to Mr. Mason, based on the recommendation of the Deputy Building Inspector. Seconded by Mr. Ruggiero Motion Unanimously Carried Several requests from Ralph Holt, Recreation Chairman. Recreation has been approached by a young man (Scott Vittoli) who is seeking to earn his Eagle Scout Badge. He would like to construct a sign to be placed at the entrance to the Towns Robinson Lane Complex. This sign would spell out that it is the Town of Wappinger Complex at Robinson Lane and would have a separate attachment indicating that it is the home of the Town of Wappinger Little League. The sign and the landscaping around it would have an estimated value of $1,200. Through the efforts and his fathers, they will produce the bulk of the investment. They would like us to provide an estimated $200 toward the project. We agree and request your approval to proceed. The $200 would come out of the Robinson Lane line in our budget. Discussion followed. COUNCILMAN RUGGIERO moved to authorize $200 toward the project as requested by Mr. Holt. The clay is more expensive, but its good qualities make this decision a positive one because it is easier to maintain and much safer to play on. The funds to cover this are in budget account A-7110.4 COUNCILMAN VALDATI moved to approve a P.O. payable to Partac Peat Corporation in the amount of $1,712 for 25 tons of clay for the ball fields as requested by Mr. Holt. Seconded by Mr. Ruggiero Motion Unanimously Carried Mr. Holt announced that the request from the Towns Little League to assist them in further up -grading of the Robinson Lane building has been withdrawn. COUNCILMAN RUGGIERO moved to accept and place on file Seconded by Mr. Paoloni Motion Unanimously Carried Next are several easement complaints. The first is from Edward Rubeo of 13 Doyle Drive. Upon researching the law concerning the stream easement, he believes that the rel 07/23/2001.RGM town is only partly correct. The town has the right to take down the trees only if it is necessary to remove them in order to clean out the stream. This was not the case concerning his trees. Mr. Foster said what Mr. Rubeo does not understand, is, there are two easements, one is a storm sewer easement for drainage and the other is an easement for the sanitary sewer. To add trees back to that area is only going to put more roots into the trunk line. We do not want trees in the sanitary sewer easement. Unfortunately, the stream cannot support trees. In the process of excavating the bank of the stream, one tree fell down. The other trees were cut down on purpose because the roots were infiltrating our soil. One tree was endangering one of the manholes. Mr. Foster explained that he will go back to fix the topsoil, but he is shorthanded at this time, and will be shorthanded in the foreseeable future possibly the rest of the year. He is trying to work on the worst situations first, but he will take care of this. COUNCILMAN BETTINA moved to accept the correspondence and place it on file. Mr. Foster to send a letter explaining. Seconded by Mr. Valdati Motion Unanimously Carried Next is the drainage situation from Amy Kwei of 30 Lake Oniad Drive. Ms. Kwei explained that Mr. Foster had informed her that he could not get on her property without an easement on her deed. Her request is for drainage pipes on Foxhill Road, not in her property. At present, the water on the road is directed toward her empty lot that is a breeding ground for mosquitoes. The road is public property. Now the road runs down the hill, and is draining water into her lot. She wishes to have this unacceptable situation remedied. Mr. Foster explained, that there are issues involved here. He can install drainage pipes down Foxhill Road. The actual movement of the brook cannot be done without a drainage easement. That is why he referred this back to the Town Board. He will notify her that he can install the drainage pipes down Foxhill Road. COUNCILMAN VALDATI moved to accept the correspondence and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried At the last Town Board meeting the bid for the two pick-up trucks was tabled until Mr. Foster contacted the vendors who declined to bid and ask why they declined to bid for the trucks. Mr. Foster also sent each vendor who declined to bid specifications for those trucks. Discussion followed. COUNCILMAN VALDATI moved to authorize Mr. Foster to go out to bid again for the two pick-up trucks. COUNCILMAN PAOLONI had no reports at this time Due to contamination of their well, Mr. & Mrs. Fusaro of 71 Losee Road, are requesting permission to connect to the Central Wappinger Water District as a tenant. COUNCILMAN VALDATI moved to authorize Mr. & Mrs. Fusaro of 71 Losee Road to connect to Central Wappinger Water District as a tenant, due to contamination of their well. Seconded by Mr. Ruggiero Motion Unanimously Carried SUPERVISOR SMITH informed the Board that we must transfer $8,170 to pay for repairs of the traffic signal on Middlebush Road & Old Route 9. COUNCILMAN VALDATI moved to authorize the transfer of $8,170 to pay for the repairs. Seconded by Mr. Ruggiero Motion Unanimously Carried SUPERVISOR SMITH announced that Grinnell Library is circulating a petition for a referendum to get $300K more for the Library. COUNCILMAN PAOLONI moved to table the adoption of the Local Law for Recission of Alpine Rezone. Seconded by Mr. Ruggiero Motion Unanimously Carried Next is to adopt the Resolution in support of Group Workcamp of DC working in the Town of Wappinger during July and August 2002. Mr. Richard, the General Manager explained that support from the business community as well as from individuals has been excellent. Services and funds are being donated and we have already identified a number of work sites, which are being processed for that summer work period. They are going around to the various towns and cities to get support in identifying sites. There is usually five teenagers and one adult leader per work site. In most cases the work that is performed does not require a building permit. Discussion followed. COUNCILMAN PAOLONI moved to refer this resolution to the Attorney to the Town for his opinion and get back to the back to the board at the next meeting. The meeting adjourned at 9:40 p.m. 10 By Florence Hannon Gloria/rke Town F] F�' 07/23/2001.WS A Public Hearing was held by the Town Board of the Town of Wappinger on July 23, 2001 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on a proposed Local Law amending section 240-37: District Regulations' by amending the `Schedule of Dimensional Regulations' and Section 240-8 "Zoning Map' by recinding the conditional rezoning of the parcel identified in schedule I & confirming the zoning of said parcels to be R -20 -One Family Town of Wappinger. Supervisor Smith opened the meeting at 7:25 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Others Present: Gerald Vergilis, Acting Attorney to Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent Absent: Gloria J. Morse, Town Clerk Al Roberts, Attorney to Town The Deputy Town Clerk offered for the record, the Affidavit of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof the Minutes of this Hearing). Supervisor Smith wished to know if anyone from the audience had any questions or comments. Mrs. Concetta Oliveri of 207 Old Hopewell Road was recognized by the chair. She was not against rezoning this property back to R-20, but she had several questions that needed to be answered. This hearing should not be taking place, because none of the property owners were informed. If she did not purchase the Southern Dutchess News, she would have known about this. This Public Hearing is illegal and her rights have been violated. She also has noticed that Losee Road is being connected to sewer, and she wished to know when she will be connected. Mr. Paggi told her it is being done in fazes. Discussion followed. SUPERIVISOR SMITH explained to Mrs. Oliveri that it was her responsibility to send out the letters, and she did not do it, therefor she would like someone to make a motion to table this Public Hearing. Supervisor Smith opened the meeting at 7:20 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Ruggiero, Councilman Joseph Paolom, Councilman Others Present: Jay Paggi, Engineer to the Town Gerald Vergilis, Acting Attorney to Town Graham Foster, Highway Superintendent Absent: Gloria J. Morse, Town Clerk Al Roberts Attorney to Town Salary Study for Recreation. COUNCILMAN RUGGIERO moved to classify salary of Stephen Lowery, Recreation Director to a grade 5 step 4, and compensate him retroactively to January 1St Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN VALDATI moved to classify salary of Bill Gallinger, Recreation Maintenance to a grade 2 step 5, mid -point. Seconded by Mr. Ruggiero Motion Unanimously Carried The following Resolution was offered by COUNCILMAN PAOLONI who moved its adoption: RESOLVED, that Ralph Holt be and he hereby is appointed to fill the vacancy on the Recreation Committee of the Town of Wappinger, which has occurred by reason of expiration of his term of office, and BE IT FURTHER RESOLVED, that the said Ralph Holt is hereby appointed to the said Recreation Committee for a five year term which shall expire on the 1St day of May, 2006. Seconded by Mr. Bettina Motion Unanimously Carried There was also discussion on the vandalism that was being committed at the various Town Parks. Mr. Holt informed the board that over the weekend, the Port -John was dumped over in Quiet Acres, and it we had to get people to clean it up on Saturday before the park could be opened this morning. They have cutters and have cut eight locks. We are being terrorized at Castle Point. They cut the fences and come in with their RV's and doing wheelies on the ball field. We are getting foul language on all of the buildings. 07/23/2001.WS Martz Field is terrible. These are not teenagers. Steps must be taken to prevent all this vandalism. Discussion followed. COUNCILMAN BETTINA moved to authorize a third patrol vehicle be brought in to patrol the recreation areas being vandalized. Seconded by Mr. Valdati Motion Unanimously Carried Mr. Holt said he would like put a flier together and hand deliver them to houses all along the back of Castle Point. We must try to prevent RV's from going into Castle Point. We did this several years ago, and it subsided, now the RV's are back.
