BOX 324 WAPPINGERS FALLS, NY 12590.0324 NO OTHER BUSINESS SHALL COME BEFORE THE BOARD. 05/14/2001.WS The Workshop Meeting of the Town of Wappinger was held on May 14, 2001, at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith called the meeting to order at 7:30 P.M. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Gloria J. Morse, Town Clerk Others Present: Al Roberts, Attorney to the Town Jay Paggi, Engineer to the Town SUPERVISOR SMITH announced that the first item on the workshop is on the public information meeting that was held on Saturday for the Anvil Court pipe that has to be put in. Five residents attended the meeting, and all were in agreement to go with option #1. She also received five phone calls and they said they would go with the consensus of the majority. Jay Paggi, Engineer to the Town gave a short presentation on the proposed installation and the two alternate paybacks. The estimated cost of the water main installation would be approximately $54,000. Option #1 would be 4 quarterly payments of $29.39 for one year, and option #2 would be 5 yearly payments ranging from $29.40 to $24.68. The residents that were in the audience also opted for Option #1. COUNCILMAN VALDATI moved to go out to bid based upon the work detailed by Mr. Paggi. Seconded by Mr. Paoloni Motion Unanimously Carried COUNCILMAN VALDATI moved to authorize Mr. Paggi send progress reports to the residents also. Seconded by Mr. Valdati Motion Unanimously Carried Jay Paggi, Engineer to the Town went over a Water Use Capacity Chart for all the water districts for the Town of Wappinger. Discussion followed. COUNCILMAN PAOLONI moved to authorize Mr. Paggi to perform a desk top study of cost to provide water to the entire Town on the basis that we may get water from Poughkeepsie. Seconded by Mr. Valdati Motion Unanimously Carried At the last meeting Mr. Paggi was authorized to look at the existing curve on Smithtown Road approximately 800' east of the intersection of Cooper Road. 1 05/14/2001.WS The curve has a very short radius and if the posted speeds are not followed, accidents can occur. Guiderails on the south side of the roadway support this statement. To construct a horizontal curve of the proper radius would require taking enough property on the north side of the road to allow for roadway construction. It appears the entire lot (989897) as shown on the enclosed sketch will need to be taken along with a portion of Lot No. 005926. There is an existing structure on Lot No. 989897 that is in a state of disrepair, and appears to be abandoned. The Board may wish to pursue this matter further, knowing that an entire lot and structure would need to be obtained.. COUNCILMAN PAOLONI moved to authorize Attorney to the Town to obtain an appraisal of the property, and authorize Mr. Paggi to come up with a cost to perform the work. Seconded by Mr. Valdati Motion Unanimously Carried DEIS Community Center. COUNCILMAN VALDATI moved to authorize Supervisor Smith to contact the surrounding involved agencies and advise them of the Towns intention to become Lead Agency. Seconded by Mr. Ruggiero Motion Unanimously Carried Next are the bid results from Donald Swartz, R.A. that were opened on April 17th, 2001, for the Town Hall Entrance Canopy. CONTRACT NO. 1 GENERAL CONSTRUCTION The scope of work for the General Construction base bid represents the cost for all labor and materials to construct the canopy (exclusive of electrical improvements). The scope of work for Alternate No. 1 includes re -roofing of a portion of the adjacent meeting room roof from the ridge east to the new canopy, and from the north fascia south to the skylights. CONTRACT NO. 2 GENERAL CONSTRUCTION 2 05/14/2001.WS 3 The scope of work for the Electrical Construction base bid represents the cost for all labor and materials to purchase and install lighting in the canopy as detailed on the construction documents. The bid results are as follows: Company Base Bid Rondout Electric $2,800.00 Braggs Electric 3,950.00 Chris Bar Electric 2,600.00 Mr. Swartz has reviewed the bids and finds them to be in proper order and recommends that Contract No. 1 be awarded to the low bidder, Southern Dutchess Construction in the amount of $79,600.00 and Contract No. 2 be awarded to the low bidder, Chris Bar Electric, in the amount of $2,600.00. COUNCILMAN VALDATI moved to award the bid for the Town Hall Entrance Canopy, Contract No. 1 to Southern Dutchess Construction in the amount of $79,600.00 and Contract No. 2 to Chris Bar Electric, in the amount of $2,600.00, upon recommendation of Mr. Swartz. Seconded by Mr. Bettina Motion Unanimously Carried Next is the proposed Local Law on the Pooper Scooper. Al Roberts, Attorney to the Town went over the contents of the Local Law. Basically it prohibits the owner to allow the dog to defecate or urinate on public or private property, and the only exception, is the area between the curb line from the shoulders of the road, provided the owner scoops it up and takes it away. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts to draft this Local Law in final form. Seconded by Mr. Bettina Motion Unanimously Carried Next item for discussion is the Meadowood Agreement. Mr. Roberts, Attorney to the Town informed the board that he attempted to reach Mr. Domber and his attorney this morning, and neither were available. They have not changed their position. However, Mr. Roberts does wish to clarify one issue. Mr. Domber was not asking for the wells back after two years. The town would still continue to own them. He wanted to make the necessary improvements to the town's system so that his properties could be served. Discussion followed. COUNCILMAN RUGGIERO moved to take this issue to Executive Session at the close of the meeting. Seconded by Mr. Valdati Motion Unanimously Carried 3 05/14/2001.WS Next on the agenda is the Thalman/Redl rezone contract. Al Roberts, Attorney to the Town explained that the Planning Boards recommendation was to rezone the section of Route 9 from New Hackensack Road, North to the Wappinger Creek Bridge, to HB. Because these properties are in close proximity of each other, he feels the rezone should all be done at one time, not piece meal. Discussion followed. COUNCILMAN RUGGIERO moved to authorize the Town Planner, Dan Wery to review the application for rezone, taking into consideration the Planning Board comments for general area from New Hackensack Road and UP. Seconded by Mr. Bettina Motion Unanimously Carried Comptroller, Jerry Terwilliger was authorized to research the salary study He explained that all the jobs were evaluated, assigned a grade, and establish a salary for that grade. He can't conceivably see how we can adjust everyone's salary on the anniversary date. The initial study gave us a minimum, a midpoint and a maximum salary for the jobs that were described and suggested we formulate a step system which he has done. He tried to fit everyone according to longevity, into a step within the grade. There is also a probationary period set by the Dutchess County Personnel, and at that point Supervisor Smith must fill out a form and send it to them. That time would count as dead time in the step system until the following year. That is what he has predicated the schedules on. Discussion followed. COUNCILMAN RUGGIERO moved to implement anniversary dates or starting dates, beginning the year 2001. Seconded by Mr. Valdati Motion Unanimously Carried Northeast Computer Services presented the following cost breakdown for a WebSite for Town of Wappinger. 1. Development of WebSite 2. Establishment of Domain Name 3. Domain Hosting fee 4. FTP transfer software 5. Dialup account 6. Modifications to WebSite Discussion followed. NO ACTION TAKEN. $2,500 one time fee $150 every two years $ 24 per month or $229 per yr. $ 65 one time fee $ 180 per year $ 85 per hr. as needed basis Due to septic tank failure, Mr. & Mrs. Timothy Smith of 23 Edgehill Drive, are requesting permission to hook into town sewer as a tenant. Supervisor Smith checked, and there is sewer available COUNCILMAN RUGGIERO moved to allow Mr. & Mrs. Smith of 23 Edgehill Drive, to hook into town sewer as a tenant. 0 Seconded by Mr. Valdati 05/14/2001.WS Motion Unanimously Carried Due to costly repairs that must be addressed in order to maintain proper operation of their facility, TurnKey Property Management, Inc. is requesting permission to hook White Gates Condominiums into the town sewer lines as soon as possible. AS PER ENGINEER TO TOWN, no sewers will be available for another year. NO ACTION TAKEN Correspondence from Richard N. Carlson, Land Surveyor, notifying the Supervisor, that his client, Edward Torregrossa proposes to build a home on the east side of All Angels Hill Road. Upon submission for septic approval at the Dutchess County Health Department, Mr. Carlson is requesting a letter from the Town of Wappinger indicating that water is available to serve this property. COUNCILMAN RUGGIERO moved to authorize Supervisor Smith to send letter to the Health Department advising, water is available. Seconded by Mr. Valdati Motion Unanimously Carried Notification from Dick Polich, founder of Polich Art Works informing the Town of the possibility of relocating his business to the American Lumber site on Chelsea Road. COUNCILMAN BETTINA moved to authorize Town Planner to investigate this business. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN RUGGIERO received phone calls from two constituents in regard to drainage problems. One is at 5 Baldwin Place and the other at 6 Dana Place. COUNCILMAN BETTINA moved to authorize Jay Paggi, Engineer to Town to investigate the problems and report back to the board with his findings. Seconded by Mr. Ruggiero Motion Unanimously Carried At this time, 10:03 p.m. COUNCILMAN RUGGIERO moved to go into Executive Session to confer with Council regarding Highway Truck bids, and Robinson Lane guide rails, seconded by Mr. Paoloni and unanimously carried. The meeting reconvened at 10:35 p.m. with all board members present. COUNCILMAN VALDATI moved to reject all Highway truck bids and authorize Highway Superintendent to rebid. Seconded by Mr. Bettina. Motion Unanimously Carried 5 05/14/2001.WS COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts to send letter advising residents to move boulders off highway. Seconded by Mr. Paoloni Motion Unanimously Carried There was no other business to come before the board.
