NY, with a total bid of $160,000.00 which includes the Add Alternate #1. Add Alternate
#1. is for the replacement of the existing chain-link fence with a new chain-link fence.
Morris Associates has worked with Avello Brothers Contractors, Inc. on
numerous projects and has found their work to be acceptable and it is our opinion that
Avello Brothers Contractors, Inc. is qualified to perform the proposed work required for
this project. All portions of the bid prepared by Avello Brothers Contractors, Inc. appear

Change Order #1
Dear Mr. Co/sey and Town Board Members:
Enclosed please find a copy of the AlA Document G701 entitled Change Order.
The purpose of this change order is a result of a site investigation on October 19, 2009,
that revealed two areas of the tennis court subbase material deemed to be sub standard
for the purpose of rehabilitating the tennis courts. After the tennis.- courts were
reclaimed and during the regrading process there were two areas, with an approximate
area of 3,600 square feet, that were "spongy", which will require the removal of this
material to a depth of 24", the following is the replacement procedure:
1. Excavate and dispose of all unsuitable soils encountered.
2. Install a layer of non~woven geotextiJe fabric on top of suitable virgin
ground.
3. Install approximately 12" of 1 ~"crushed stone and compact.
4. Install a layer of non-woven geotextile fabric on top of the crushed stone.
5. Install approximately 12" of crushed item #4 sub-base on the top of the
fabric and stone layer.
6. grade and compact the areas of remediation.
We requested a cost from the contractor, Avella Brothers Paving Contractor, Inc.,
for this change and they submitted an additional cost of $24,610.00. There is an
additional lump sum amount for the regrading of the entire tennis court due to the
movement of equipment during operation of the material replacement of $2,875.00.
Therefore, the total change order is in the amount of $27,485.00. This cost is a "not to
exceed" cost. The actual cost billed will be per ton of material installed at the rate. of
$53.50 per ton.

work or labor to which it relates, or in any portion of the profits thereof.

(f) All work shall be completed within the time allotted, from the date specified in
the Notice to Proceed or set by the contract documents, mailed to the
undersigned by registered mail with return receipt requested to the legal
address of the bidder as indicated on his/her bid.

(g) If the bid documents contain any unlawful provision not an essential part of
the bid and which shall not appear to have been a controlling or material
inducement to the making thereof, the same shall be deemed of no effect
and will upon notice by either the Owner or the bidder be deemed stricken
from the bid documents without affecting the binding force of the remainder.

(h) Each and every provision of any law and clause required by law to be
inserted in the bid documents shall be deemed to be inserted herein and the
bid documents shall be read and enforced as though it were included herein:

No bid will be considered unless this Certification remains attached to and is submitted

By submission of this bid, each bidder and each person signing on behalf of any bidder
certifies, and in the case of a joint bid each party thereto certifies as to its own organization,

(1) The prices in this bid have been arrived at independently, without collusion,
consultation, communication, or agreement for the purpose of restricting
competition as to any matter relating to such prices, with any other bidder or with

Enclosed please find a copy of the AlA Document G701 entitled Change Order. The
purpose of this change order is a result of additional unsuitable material encountered during the
excavation approved in Change Order #1. .
The amount of additional material removed was 66 tons at a cost increase of $3,531.00
($53.50/ton). The amount previously approved in Change Order #1 was for 460 tons at a cost
of $24,610.00. Therefore, the new total amount will be $28,141.00 for the placement of the sub-
base.
Please place this on the agenda for the November 23, 2009 Town Board Meeting for
approval of Change Order #2.

Dear Mr. Colsey and Town Board Members: .
The above referenced project has been progressing at a steady pace, the progress to date has
been the reclamation of the existing surface, removal and replacement of the unsuitable subbase
material, installation of the curtain drain system, regrading in preparation of placement of asphalt material,
installation of the fence posts and placement of the base and top asphalt courses. Within the next week
the fence contractor will install the fence and gates.
The date of completion of the project as stated in the Notice to Proceed is November 26, 2009.
Due to the additional work of removal and replacement of the subbase material which added two weeks
to the contract schedule, the placement of the acrylic surface system will not be able to be applied due to
the weather. This .system requires at a minimum, temperatures during the day of 70 degrees for at least
5 days and no temperature below 50 degrees overnight.
Therefore, the contract completion date needs to be extended to May 30, 2010. Please place this
on the agenda for the December 14,2009 Town Board Meeting for approval of contract extension.
