Dear Mr. Salem:
Reference is made to your undated letter received via fax on December 12, 2003. This
letter is to place you and your client on notice that I do not concur with the advice you
have given your client and that I am under instructions by the Town to take whatever
measures are necessary to enforce the "open space" restriction on the subject parcels.
I know of no constitutional right to occupy a home without a Certificate of Occupancy. I
know of no constitutional right to build on property designated as "open space". I know
of no constitutional right to construct a residence on property designated as "open space"
on a Filed Subdivision Map - whether or not your title company discloses such notation
in their title report to you and your client.
Any efforts to file a criminal complaint and seek its enforcement will be vigorously
opposed and I strongly suggest you research these legal issues before attempting such a
frivolous action.

Accordingly, the offer made in my letter of December 2,2003 to compromise the matter
is hereby withdrawn.
If your clients attempt to occupy the house, a separate action will be brought to remove
them from same.
