Re: Town Justice Court Prosecutions
Dear Supervisor Ruggiero:
This is a status report regarding the Town of Wappinger Justice Court prosecutions:
People v. Geneva Holding:
Geneva Holding was cited by the Fire Inspector for three counts of blocking a fire exit.
They pled guilty and were fined $300.00.
feople v. Glenda Welch:
The Welchs continue to have an illegal apartment on their premises. This is the second
offense for the Welchs. They were fined $350.00 after pleading guilty. We should
double check in the next couple of months to make sure that there has not been a third
offense.
People v. Robin and Janet Hall:
Mr. Hall appeared on behalf ofthe owners of the property. He had cleaned up the junk
cars that were on the property. In consideration of that, he was fined $25.00.
People v. Raspler/Fine Homes Hopewell LLC (Old Hopewell Acres):
This involves a disturbance of wetlands on the property in question. We have adjourned
the matter to give the owners an opportunity to consult with the Army Corp. of Engineers
and the appropriate federal authorities regarding mitigation of the problem and
restoration of the wetlands. If the Army Corp. of Engineers and other federal authorities
recommend a specific course of action, we will keep the case open to insure that the
owners comply with that course of action. The matter is scheduled for December 9, 2003
at 5:30 p.m.
People v. Joseph Duffy and People v. Taurence:
These matters were adjourned to October 14,2003 at 5:30 p.m. I will be sending a
further memo to the Board regarding this matter in the near future.
People v. Raymond Menconeri:
Raymond has substantially cleaned up the site according to the inspection of Tatiana
Lukianoff and Susan Dao conducted on September 4,2003. On September 9, 2003 they
re-inspected the property and it was in compliance. The Zoning Department issued a
letter for Mr. Menconeri to use to complete the sale of the property indicating there were
no violations present on September 9,2003. That sale should be effective hopefully in
the near future. Mr. Menconeri pled guilty at an earlier date. Given the clean up, he was
fined $100.00.
People v. Kessler:
This matter involves an improper fence and gate around a swimming pool. A member of
the Kessler family contacted the Court in advance and advised that Mrs. Kessler was
hospitalized on the court date. The Court adjourned the matter to October 4,2003.
People v. Leemilts Petroleum:
This was also a debris on property issue. They pled guilty a.'1d were fined $25.00.
People v. Anna Thomas:
Anna Thomas did not appear. The Court issued a warning letter to appear on October 14,
2003.
People v. Jeff Hunt:
This matter was adjourned to November 18, 2003 at 5:30 p.m. Our firm has a conflict so
I will ask the Building and Zoning Department to handle this on their own on November
18, 2003 date.
