Joseph Ruggiero, Supervisor Town of Wappinger 20 Middlebush Road Wappingers Falls, New York 12590 Re: Town Justice Court Prosecutions File No. 12951.0009 Dear Supervisor Ruggiero: At the Court date of June 10, 2003, the following matters were on the calendar: People v. Richard Simpson (File No. 19699.0010) This is a case where Mr. Simpson has been occupying a residence in the Town for many years without a Certificate of Occupancy. He had earlier entered a plea of guilty with an understanding that if we receive cooperation from him prior to the sentencing date, we would takt that into consideration when recommending a tine to the Judge. He was due to appear on July 10,2003 for sentencing. In the interim, we have received no cooperation from Mr. Simpson. He did not appear in Court for the sentencing. Judge Wolfson has issued him a letter telling him that ifhe doesn't appear at the next court date of July 8,2003, a warrant for his arrest will be issued. People v. Joseph Duffy (File No. 19699.0024) This was adjourned to August 12,2003 at 5:30 p.m. People v. Aris Kessler (File No. 19699.0033) This is a matter of an improper fence around a pool. It has been adjourned to July 8, 2003 to give the Defendant further time to repair the problem. O:\W APPINGE\Town Board\CRlMINAL FILES\062703-JR.doc " ., People v. Inter City Tire (File No. 19699.0035) This matter involved, among other things, an obstruction of fire exits under the State Fire Code. Inter City Tire by Chauncy Murphy, the Territory Manager of Sales, pled guilty to the charge of obstructing fire exits and was fined $100. The other outstanding issues regarding storage oftires and like were adjourned for contemplation of dismissal as long as they are cleaned up by the Defendant in a timely manner. People v. Alison Grunberg (File No. 19699.0037) This was a person selling flowers on Mother's Day weekend. She did not have a permit. She pled guilty and was fined $10. People v, Scaglione Qualitv Builders (File No. 19699.0036) Scaglione Quality Builders was cited for illegal open burning. They pled guilty and paid a $50 fine. People v. Raymond Menconeri (File No. 19699.0022) This involved changes in Mr. Menconeri's auto body shop site without site plan approval. He indicated that he had since changed his property back to what is approved under the site plan and that he is in the process of selling the property. He pled guilty to the charge of use without site plan approval. Sentencing has been adjourned until September 9, 2003 at 5 :30 p.m. Ifhe continues to use the property within site plan approval and sells the property, he will receive consideration in sentencing.
