1966-10-18 (2)OCTOBER 18. 120, - PUBLIC HARING ON PETITION OF DCR & MRGTAM L•oRP. Fulton - purpose is for the rezoning of the DCR property. I would like to say before we start Mr. Diehl and I do not constitute a quorum. Quorum is not required for hearing. Minutes will be passed on to the members that are not here. No decision tonight. Decision will be based on the Planning Board recommendation and the County recommendation. 8115 p.m. - Elaine read public notioe dated October 3. Fulton - we will now hear from those who are against this proposition. Mrs. Russell - I feel that spot zoning is bad. There are nice homes along Cooper Road and Route 9. Very much against any Indust?, going in there. Beautiful building lots on Smithtown Road. Who would want to build up there if there was industry on that property? Mr. Cortellino - the Town is contemplating without Planning Consultant. We are going through efforts of having the whole area reviewed. Should be referred to t*x to them. It did not state when the land was transferred. I could see a hardship for someone who t owned it for many years. If they just bought it, it was bought while it was zoned that way. Reason for Planning is to protect every landowner. Those who bought because it was residential should not have Planned Industry put in there. Diehl - when was that oonveyed? Do we have a record of that at this time? Pagones - it is not o,nveyed now. It is a question that my client, Megtam, has an option to purchase this property only for the sole purpose of industry. `4.. Fulton - I think DCR has owned it for at least three years. Elaine - deed from Schlicter to DCR was dated 1961. Mrs. Keelor - does the State become involved in this because of a certain -2 - stage on Route 9? Fulton - bounded by Fishkill. I don't think the State takes an active part in the zoning. Mrs. Keelor - Route 376 - I think the same company wanted half acre lots on this property. I think it's rather unusual that the sill is so bad you can't put homes in there. Why should industry be put In? Vandewinokel - there was a previous request for rezoning for multiple dwellings, we had it a few months ago. Quinn - that was withdrawal Fulton - approximately how many aores? Elaine - 170 aores. Ludewig - 157 acres in the Town of Wappinger. Anyone else to speak against? Anyone to speak for it? George Pagones - 1 represent Megtam Corp. which now has an option to purchase this property. The property that is under discussion is a swampy piece of property that anything with value has been sold off. Property is useless unless great de al of money is spent to clear it off and make it usable. Only thing to make it usable is commercial enterprise that can afford to have it cleared off. My people are in the process of establishing themselves in the Town of Wappinger with a commercial enterprise which would leave a deal of taxable real estate here in the Town of Wappinger. A1.1 I have to say at this time. Diehl - what type of enterprise? -3.. Pagones - something that would be suitable to the Planned Industry we are requesting now. Anything ' they build will have to come before the Planning Board. Wholesale warehouse type of thing. No plans until we have this property rezoned. Fulton - Anyone else to speak for it? Ed Rose - represent the people selling it. We promised Mr. Pagones we would cooperate in every way. It is my understanding that most of the land involved that fronts on Route 9 is at present commercial and what is or primary concern to the people buying it was that the back portion which is swamp and requires a great deal of fill , oan be must utilized and zoned under your Planned Industry. IT WOuldn't mean a great deal for pictures beoause whatever they put up would have to be approved as to landscaping, fireproofing, and any of the lots nearby be protected. Fences, hedges, or whatever that Board may require will have to be approved. Join in this application and ask for zoning ohange. Point out it is one of the few things', if you rezone, tends to aid to increase of school and land taxes without putting more children into the district. Aotually, the principal involved is Mr. Hanson who is in Saint Francis Hospital. He was hurt in a fall on Columbus day. He was going to be here to better answer your questions, but he oan't get out of bed. Mr. Russell - I just had something on my mind. I'm for new industry, but there is another problem out there. You're going to get a lot of commer- cial traffic and that is going to come up through Smithtown Road. Warehouse for coming in and out. Their purpose will not be to deliver 14„ up Cooper and Smithtown, just north and south. Pagones - most exits will be on Route 9r Approval will say where they have to put exits,entrancea, hedges, etc. In order to give everybody proteotion and for use of the swamp, they would have to go bank further near Smithtown Road. Mrs. Russell - noisy with trucks going in and out. I would rather see something as mks nine as that De Laval thing. How could we be assured that the thing would go up? Pagonse - anything they build would have to be approved by the Town of Wapptnger Planning Board. Mr. Tetro - zoned oommeroial, is unfit, but they are trying to change 170 acres. Curious as to sett =ha why 170 acres m$et be zoned commercial. A lot more than they need for one industry, unless by ohanoe some other industry was going to be moved in them. Diehl - good point, and I am sure the Planning Board will dig into that part of it. Mrs. Russell - there are some beautiful lots on that parcel. Affidavit of publication of, notice of public hearing Is sworn to by a member of the staff of the Wappingers and Southern Dutohess News under date of Ootober 7, and shows that publication was made on October 6. Comply with the Town law in that respect. Fulton - as I pointed out, we will get recommendation from Wappinger Planning Board and Dutohess County Planning Board on this request after which the Board will make its decision on this.
