The Regular Town Board Meeting of the Town of Wappinger was held on
October 23, 2000, at the town hall 20 Middlebush Road, Wappingers Falls,
New York. Supervisor Smith opened the meeting at 7:30 p.m.

MINUTES
The Minutes of the Town Board Meeting of September 25, 2000 and
Workshop meeting of October 10, 2000 having previously been forwarded to
the Board Members, was now placed before them for their consideration.

presented by the Town Clerk be and they are hereby approved.

Correspondence from Frank Buyakowski in regard to acceptance by the Town
of Wappinger, the 100 foot extension of Farms End Road as a Town Road.
Mr. Roberts explained that the easement was notarized by a New Jersey
Notary, and we don't know if it was notarized in New Jersey or New York
State. Mr. Roberts has sent out a letter. The alternative is, to schedule a
closing at the Supervisor's office, and then report back to the board at the
November meeting. If we have all the documents, it can then be accepted
with or without Virtue.

Several reports from Jay Paggi, Engineer to the Town.
The first report concerns Wappinger Water Improvement 99-1. At the
September 11th meeting, the Town Board accepted Mr. Paggi's
recommendation to seek an increase in the authorization for the above
referenced improvement in the amount of $160K. After approval of the
authorization, his office contacted the Contractors and advised them that the
contract was awarded. Upon reviewing the minutes, it was unclear that this
specific award of the Contract was granted by the Board. Mr. Paggi is
requesting the Town Board to reaffirm the award of the Contract for 99-1
(general construction) to Sun Up Enterprises for $238,000.00 and 99-1E
(electrical construction) to Hudson Valley Electrical Construction &
Maintenance, Inc. in the amount of $106,444.00, subject to the 20 day
estoppel period.
COUNCILMAN BETTINA moved to award the bid for the Wappinger Water
Improvement 99-1 to Sun Up Enterprises for $238,000.00 and 99-1E
(electrical construction) to Hudson Valley Electrical Construction &
Maintenance, Inc. in the amount of $106,444.00, they being the lowest
responsible bidders, subject to the 20 day estoppel period.

The next report concerns the interim plot plan as part of the Building Permit

At the August 14th meeting, Mr. Paggi was authorized to calculate the cost to
extend an existing storm pipe on the north side of Ketchamtown Road and
alleviate some drainage concerns in the area of the Nenni residence. Mr.
Paggi also calculated the cost of lowering the roadway to improve the existing
vertical and horizontal geometry of the road. The total construction and
professional costs for extending this pipe is approximately $55,000. Mr.
Paggi also determined the amount of the road that would need to be lowered
to improve the vertical and horizontal geometry of Ketchamtown Road in
that area. Of extreme importance here would be taking down the bank on the
north side of Ketchamtown road to improve the existing horizontal
deficiencies. We may have to infringe upon private property (undeveloped),
however, the cost of any negotiations or easement acquisition has not been
calculated. The construction costs and professional cost for the road
lowering in this area would be approximately $31,000. Discussion followed.
COUNCILMAN RUGGIERO moved to authorize Highway Superintendent,
Graham Foster to take care of the drainage problem, and refer the site
distance issue to Councilman Valdati, when he returns, because the
constituent resides in his ward.

The last report concerns cleaning the easements.
As requested, Mr. Paggi, in conjunction with Highway Superintendent,
Graham Foster has had numerous conversations and site visits with
contractors regarding the methods and budget costs for a major stream
cleaning project in the open ditch easements the Town has in various
locations throughout the Town. They used the Rockingham streams and
easements for an example with the contractors. As you know, access to these
easements is minimal and removal of the material from the easements is
critical, and would be a very laborious job. After doing a quick analysis of the
material, labor and equipment necessary to do the job, it was determined
that costs could range in excess of $140 a running foot to accomplish the

work. With the amount of footage in Rockingham alone, the cost of doing
that project could approach seven figures. Mr. Paggi also presented other
alternatives, as piping the ditches, hire local contractors for maintaining the
ditches, and public awareness, such as some type of fine/penalty to be
initiated and enforced. Discussion followed.
COUNCILMAN RUGGIERO moved to authorize the Highway
Superintendent, Graham Foster, and Engineer to the Town, Jay Paggi
prepare a list of easements for prioritizing for the December Workshop.

The next item for the Boards consideration is to accept the bids for the
Castlepoint Recreation Site for the Proposed Boat/Trailer, Parking Area,
Scott Drive/Carroll Drive Drainage Improvements, and the Sewer
Transmission /Treatment Improvement Area Phase 3A Contract No. 2.
Bids for the Castlepoint Recreation Site for the Proposed Boat/Trailer
Parking Area were opened on October 13, 2000. Sun Up Enterprises, Inc.
was the only bid received in the amount of $94,570. Mr. Paggi's office has
reviewed the bid and finds it to be in proper format and mathematically
correct. Since there was only one bid received, and said bid was in excess of
the project estimate, the Town Board may wish to consider other options
prior to awarding the Contract (i.e.: rebidding the job, informal bids, etc.).
Discussion followed
COUNCILMAN RUGGIERO moved to reject the bid and go out to rebid as
recommended by Mr. Paggi.

Bids for the Scott/Carroll Drive Drainage Improvements were opened on
October 13, 2000. The results are as follows:
• H. Osterhoudt Excavating, LLC $ 61,100.00
• Realife Land Improvement, Inc. $ 84,000.00
• Westbank Contracting, Inc. $ 97,370.00
• Sun Up Enterprises, Inc. $108,160.00
Mr. Paggi's office has reviewed the bids, and finds them to be in proper
format, and mathematically correct. Mr. Paggi recommends that the
Contract be awarded to the low bidder, H. Osterhoudt Excavating, LLC, in
the amount of $61,100.00.

Drive Drainage Improvements to H. Osterhoudt Excavating, LLC, in the
amount of $61,100.00, upon the recommendation of Mr. Paggi.

The last bid is for the Wappinger Sewer Transmission/Treatment
Improvement Area Phase 3A Contract No. 2. The bids were received and
opened on October 17, 2000 for the above referenced project. The results are
as follows:
• Grant Street Construction $ 948,000.00
• Advanced Excavating & Landscaping $1,181,400.00
• H. Osterhoudt Excavating, LLC $1,497,755.00
• Sun Up Enterprises, Inc. $1,697,337.20
All the bids were reviewed and found to be in order. Mr. Paggi's office also
checked the references provided by Grant Street Construction and received
nothing but positive recommendations. Mr. Paggi's office would recommend
the Board award the Contract to Grant Street Construction, Inc., as lowest
bidder.

Transmission/Treatment Improvement Area Phase 3A Contract No. 2. To
Grant Street Construction, Inc., upon the recommendation of Mr. Paggi.

At the October 10, 2000 Town Board meeting, Jay Paggi, Engineer to the
Town, in conjunction with Graham Foster, presented a proposed Change
Order that would remove the pavement spec from the Contract for the
Wappinger Sewer Transmission Treatment Improvement Phase 3A, Contract
No. 1. This would allow the Town to mill down the entire pavement and
relay two (2) courses of blacktop over the entire width of the roadway. As you
are aware the contractual obligation of the Contractor doing the sewer work
is to repave the ditch area only. Allowing the contractor to work as long as
possible into the first part of the winter has caused the potential for a small
problem, in that we must have the roads in a safe plowable condition for the
winter months. To accomplish this, Mr. Foster and the Contractor proposed
placing temporary pavement in the ditch lines only for this year. The
patches will be done in the ditch line areas so as to make the roads passable
and plowable. Mr. Foster thought this was an acceptable idea. With that in
mind, next year, after the total completion of the project, the entire roadway
could be milled down to an acceptable elevation, and have the entire width of
the roadway receive a binder course of blacktop. Later in the year the entire
width can be topped providing and entire new roadway for the subdivision.
Mr. Paggi has requested the Contractor provide the Town with a price to

install the temporary patching for the winter, and to haul away the entire
roadway next spring. Mr. Paggi believes that this price will come very close
to the contractual obligation of the Contractor to repave the ditch lines only,
and the sewer district will have met their obligations. At that point, the
repavement of the road could be done out of Highway Fund. This would be a
Change Order in Scope of Work only.

Town to prepare the Change Order as stated.

A letter from William Poval Engineering for the Labieniec Subdivision
requesting the Town of Wappinger accept a R.O.W. on Diddell Road.
Approximately 0.5 acres of the Labieniec property are located in the Town of
Wappinger. As part of the subdivision, the owner is proposing to dedicate to
the Town of Wappinger and the Town of LaGrange, the respective 25 feet of
frontage measured from the center of each of the roads for road R.O.W.
COUNCILMAN BETTINA moved to accept the Deed to the road, and
authorize Supervisor to sign necessary recording papers.

The resignation of Christina DiPaola , Secretary for the Planning/Zoning
Board ,was received, effective October 23rd and a request for reimbursement
for unused Vacation days (5). Supervisor Smith informed the Board that she
placed an ad in the paper, and received 6-8 calls. When they were informed
there would be night meetings, they were not interested. Discussion
followed.

stenographer to take the minutes for the Planning Board/Zoning Board
Meetings, and hire a part time person to fill the position in the office.

Several requests for P.O.'s from Ralph Holt, Recreation Chairman.
The first is a request for a P.O. payable to Audio System for Seniors from
Dutchess Tel. Audio in the amount of $2,828. Three estimates were received,
all of which seem to provide a decent audio system, however it is our feeling
that Dutchess Tel Audio, Inc., offers the best system for our long term goals.
The vendors and their prices are:
1) Dutchess Tel -Audio, Inc. $2,828.00
2) Hugh's T.V. & Communications $2,760.00

3) Ballantine Communications $2,309.50
It was noted that the vendor with the highest estimate was recommended by
Mr. Holt, because he claimed it was a better system and would last longer.
Discussion followed. Attorney to the Town explained that an estimate is not
a bid and this procedure must be followed. All the specs must be uniform.

obtaining specs.

Next is a request for a P.O. payable to Sign Language for signs at Schlathaus
Park in the amount of $4,400. One of the signs (the one facing Myers
Corners Road) was destroyed during a storm earlier this year. Mr. Holt feels
that Sign Language is providing a better sign and it would provide the
stability that is needed. The funds are in account A-7110.4
The following are the prices that were received.

install approximately 154 feet of 6 foot high galvanized fence with a 8 ft.
double gate at the Montfort Road Barn recreation area. This would continue
the fencing project that we have been working on. The funds for this project
are in Recreation Account A-7110.2.
The quotes received for this project are as follows:

At the July 101h meeting, approval was given to move the children's play area
at Castle Point from the southwest corner to the northwest corner of the

recreation area. Also at that time, approval was given to place a single
basketball hoop and sufficient area for children to shoot baskets.
The following are quotes received to regrade, roll and blacktop the basket ball
area:

3) Blake Paving
$4,950.00
DeLeno Bros. is the only written quote that was received. Both R.G.H.
Construction and Blake Paving gave verbal quotes, but never followed up
with backup support. Since time is running out for blacktop work, Recreation
would like permission to obtain a P.O. in the amount of $4,000 payable to
DeLeno Bros. for this work. Discussion followed.

bids.

The Recreation Commission is asking for approval to enter into a contractual
agreement with the reverenced volunteer organization for help in providing
routine maintenance for our parks when needed, at present Reese Park. The
organization's contract has been reviewed by both the Town Attorney/
Recreation Commission and Community Transition Center Management and
now requires Board approval to proceed in formalizing this agreement.

Community Transition Center, and authorize the Supervisor to sign.

RESOLUTIONS
The following resolution was moved by COUNCILMAN RUGGIERO and
seconded by COUNCILMAN BETTINA
WHEREAS, the Town has heretofore entered into a certain Agreement dated
June 3, 1999 with the Tri -Municipal Sewer Commission, hereinafter referred
to as the "Commission", for the construction of a 375K gallon per day
expansion of the Tri -Municipal Waste Water Treatment Facility and the
construction of sewer trunk lines, all of which is more particularly described
in "Revision R6 to the 1974 Wastewater Facilities report - Town of
Wappinger Expansion Phase 3 Revised April 1998" (the "PROJECT"); and
WHEREAS, the Agreement dated June 3, 1999 gave the Town the option of
financing the cost of the PROJECT through the New York State Revolving
Loan Fund (hereinafter referred to as SRF; and
WHEREAS, the Agreement dated June 3, 1999 provided that if the Town
elected to finance the PROJECT through SRF, that requisitioned
construction progress payments would be made directly to the Commission;
and
WHEREAS, the SRF is managed by the New York State Environmental
Facilities Corporation (hereinafter referred to as EFC); and
WHEREAS, the Town expects to close on a Short Term Project and Loan
Financing Agreement (Short Term PFLA) with EFC in November, which
designated the Town as the loan recipient and which Short Term PFLA is
designated C-5306-04-00; and
WHEREAS, Short Term PFLA will be issued for the express purpose of
financing in part PROJECT called for in the Agreement with the Commission
dated June 3, 1999; and
WHEREAS, pursuant to said Agreement the Commission is to be designated
the Town's agent and loan administrator for the requisitioning of
construction progress payments and payment of other costs called for in the
construction of said PROJECT; and
WHEREAS, the Project budget for said Tri -Municipal PROJECT totals in all
to $4.5M; and
WHEREAS, there will be a shortfall of funds for said PROJECT in the
amount of $1.386M; and
WHEREAS, the Town has qualified and contemplates issuing a Long Term
PFLA on or about July 30, 2001 to consolidate all outstanding Short Term
PFLA's for this Project and the Short Term BAN of $1,386,156, heretofore
deposited with the Commission in escrow; and

WHEREAS, the Town, pursuant to its agreement with the Commission dated
June 3, 1999, has agreed that it will designate the Commission as the direct
recipient of any loan proceeds issued pursuant to a Long Term Project
Financing and Loan Agreement; and
WHEREAS, THE Town and Commission have agreed upon terms and
conditions of an agreement which will implement the procedures required for
requisitioned loan proceeds to be disbursed pursuant to the Short Term
PFLA designated C-5306-04-00 and for the designation of the Commission as
agent of the Town for the receipt of loan proceeds of the Long Term PFLA (a
copy of which Agreement is attached to and made a part hereof).
NOW THEREFORE, BE IT RESOLVED as follows:
1. The recitations above made are hereby adopted and incorporated as if
fully set forth herein.
2. The Town hereby authorizes the COMMISSION to designate a member or
other person to act as an authorized signatory on bank account
established at Fleet Bank, Middlebush Road, Wappingers Falls, New
York, which account is dedicated to the receipt and disbursement of loan
proceeds to be issued by EFC pursuant to a Short Term Financing Loan
Agreement between the Town and EFC for SRF Project No. C-5306-04-00;
the proceeds of said account may be disbursed by the Commission only for
costs and expenses incurred pursuant to the Agreement dated June 3,
1999 by and between the Town and the commission.
3. On or after the closing of the Long Term PFLA for the July 3, 2001 Pooled
SRF Financing for SRF Project No. between the Town and EFC, the
Town hereby designates the Commission as its agent and loan
administrator for the receipt of loan proceeds disbursed pursuant to the
Long Term PFLA to be disbursed by the Commission only for the purposes
set forth in the Agreement dated July 3, 1999 between the town and the
Commission for the balance of monies due with respect to the payment in
full of all expenses for the PROJECT to be constructed pursuant to the
Agreement dated June 3, 1999 and known as Contract No. 3A-6 (Town of
Wappinger designation).
4. The Town further authorizes the Commission to act as its agent and loan
administrator to requisition funds directly from EFC for receipt of the
loan proceeds to be disbursed pursuant to the Long Term PFLA above
referenced regarding all other uncompleted projects being financed
pursuant to the Long Term PFLA, namely, projects for Contract Nos. 3A-
1; 3A-2; 3A-3; 3A-4; and 3A-5 (Town of Wappinger designations).

5. The Town Board further authorizes and directs the Supervisor, Constance
O. Smith, to execute an Agreement between the Town and the
Commission for the implementation of the procedures above referenced, in
substantially the same form as the form of Agreement annexed hereto,
authorizing the Supervisor and the Attorney to the Town to amend the
provisions of the Agreement to conform to the regulations of EFC, if
necessary.

WAPPINGER, DUTCHESS COUNTY, NEW YORK, TO BE KNOWN AS
WAPPINGER WATER IMPROVEMENT ARE - 1999-2(R) IN SAID TOWN
WHEREAS, a map, report and plan, including an estimate of cost, dated
August 11, 1999, together with an amendment thereto, dated September 15,
2000, have been duly prepared in such manner and in such detail as has
heretofore been determined by the Town Board of the Town of Wappinger,
Dutchess County, New York, relating to the implementation of a cost-
effective method of addressing existing source, supply and storage problems
in specified areas of said Town, by the construction of new water wells
together with interconnection facilities, water mains and original
furnishings, equipment, machiner apparatus,

the subject matter thereof, and
WHEREAS, the capital improvements proposed in connection with the
establishment of the Wappinger Water Improvement Area - 1999-2(R) as
hereinabove described, are at maximum estimated cost of $8,590,000; and

WHEREAS, said maximum estimated cost is greater than one-tenth of one
per centum of the full valuation of taxable real property in the area of the
Town of Wappinger outside of any villages and therefor an application to the
Office of the State Comptroller for approval of establishment of said
Wappinger Water Improvement Area - 1999-2(R) will be required; and
WHEREAS, said maximum estimated cost is proposed to be financed by the
issuance by the Town of Wappinger of its serial bonds with maximum
maturity not in excess of the forty year period prescribed by the Local
Finance Law; and
WHEREAS, it is proposed that the cost of the aforesaid improvements shall
be borne by the real property in said Wappinger Water Improvement Area -
1999-2(R) by assessing, levying upon and collecting from the several lots and
parcels of land within such Wappinger Water Improvement Area - 1999-2(R),
outside of any village, which the Town Board shall determine and specify to
be especially benefited by the improvements, an amount sufficient to pay the
principal and interest on serial bonds and bond anticipation notes issued in
anticipation of the issuance of serial bonds, as the same become due and
payable; and
WHEREAS, the aforesaid improvements have been determined to be an
Unlisted Action pursuant to the regulations of the New York State
Department of Environmental Conservation promulgated pursuant to the
State Environmental Quality Review Act, the implementation of which as
proposed, the Town Board of said Town has determined will not result in any
significant environmental effects; and
WHEREAS, an order was duly adopted by said Town Board on September 25,
2000, reciting a description of the boundaries of the proposed Wappinger
Water Improvement Area - 1999-2(R), the improvements proposed, the
maximum amount proposed to be expended for said improvements, the
proposed methods of financing to be employed, the fact that said map, plan
and report, including an estimate of cost, as amended, were on file in the
Town Clerks office for public inspection and specifying the 10th day of
October, 2000 at 7:40 o'clock P.M., local time, at the Town Hall, 20
Middlebush Road, in Wappingers Falls, New York, in said Town, as the time
when and the place where said Town Board would meet for the purpose of
holding a public hearing to consider the establishment of Wappinger Water
Improvement Area - 1999-2(R) and said map, plan and report, as amended,
filed in relation thereto and to hear all persons interested in the subject
thereof concerning the same; and

WHEREAS, notice of the aforesaid public hearing was duly published and
posted in the manner and within the time prescribed by Article 12-C of the
Town Law, and proof of publication and posting have been duly presented to
said Town Board; and
WHEREAS, said public hearing was duly held at the time and place in said
order as aforesaid, at which all persons desiring to be heard were duly heard;
and
WHEREAS, Town Board has duly
said considered said map, plan and report
and the evidence given at said public hearing and adopted a resolution on
October 10, 2000 making certain determinations in connection therewith;
WHEREAS, an application to the State Comptroller for permission to
establish Wappinger Water Improvement Area - 1999-2(R) has been prepared
and, pursuant to regulations of the State Comptroller, must be reviewed and
approved by the Town Board prior to submission;
WHEREAS, inasmuch as the application to the State Comptroller is required
to be filed within ten days of adoption of this resolution making the
determinations required by Section 209-q of the Town Law and more than
ten days have passed since October 10, 2000, it will be necessary to repeat
such determinations; NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Wappinger, Dutchess
County, New York as follows:
Section 1. It is hereby determined that it is in the public interest to
establish said Wappinger Water Improvement Area - 1999-2(R) and to make
the improvements hereinafter described and such improvements are hereby
authorized. The Proposed area hereby determined to be benefited by said
Wappinger Water Improvement Are - 1999-2(R) is that area specified in
Appendix A annexed hereto and made apart hereof. No real property
determined to be benefited by said Wappinger Water Improvement Area -
1999-2(R) has been excluded from Appendix A, and all of the real property
benefited by said Wappinger Water Improvement Area - 1999-2(R) has been
included in Appendix A.
Section 2. The proposed improvements shall consist of the
implementation of a cost effective method of addressing existing source,
supply and storage problems in specified areas of said Town, by the
construction of new water wells together with interconnecting facilities,
water mains and original furnishings, equipment, machinery, apparatus,
appurtenances, and incidental improvements and expenses in connection
therewith, to integrate certain specified existing Water Districts and

Area - 1999-2(R), at a maximum estimated cost of $8,590,000. The method of
financing of said cost shall be by the issuance of serial bonds of said Town of
Wappinger to mature in annual installments over a period not exceeding
forty years and such bonds shall be payable from assessments levied upon
and collected from the several lots and parcels of land deemed benefited from
said improvements and located in said benefited area, which land has been
determined in Section 1, above, to be described in Appendix A hereto, so
much upon and from each as shall be in just proportion to the amount of the
benefit which the improvement shall confer upon the same.
Section 3. It is hereby determined that the estimated expense of the
aforesaid improvements exceed one-tenth of one percent of the full valuation
of the taxable real property in the area of said Town outside of villages and,
therefore, in accordance with the provisions of subdivision 13 of Section 209-q
of the Town Law, permission of the State Comptroller is required for such
improvements.
Section 4. It is hereby further determined that all of the cost of the
aforesaid improvements shall be borne wholly by property within the
Wappinger Water Improvement Area - 1999-2(R) with no cost thereof to be
borne by the entire area of the town outside of any village.
Section 5. Pursuant to subdivision 13(b) of Section 209-q of the Town
Law, the Town Clerk is hereby directed and ordered to file a certified copy of
the resolution in the Office of the State Department of Audit and Control in
Albany, New York, together with an application for the approval of the State
Comptroller to the providing of the improvements as described herein
substantially in the form attached as Appendix B (the "Application"). The
Application shall be executed and verified by the Supervisor. It is hereby
determined that the Application was prepared at the direction of the Town
Board; that the Town Board believes the contents of the Application are
accurate; and that the Town Board has determined that the Wappinger
Water Improvement Area - 1999-2(R) is in the public interest and will not
constitute an undue burden on the property which will bear the cost thereof,
that all real property to be assessed to pay the cost thereof will be benefited
thereby and that no benefited property has been excluded.
Section 6. Pursuant to subdivision 6(d) of Section 209-q of the Town
Law, the Town Clerk is hereby directed and ordered to cause a certified copy
of this resolution to be duly recorded within ten days of the date of receipt of
notification of the approval of the State Comptroller, in the Office of the
Clerk of the County of Dutchess, New York, which, when so recorded, shall be

presumptive evidence of the regularity of the proceedings and action taken by
the Town Board in relation to the aforesaid improvements.
Section 7. This resolution shall take effect immediately.

The resolution was thereupon declared duly adopted
Next is to adopt the Preliminary Budget for the year 2001 and to set a Public
Hearing. The Preliminary Budget was filed with the Town Clerk on
October, 23rd, 2000. Comptroller, Jerry Terwilliger explained that the
Tentative Budget that came out last month set the Village tax rate at $1.42
and the Town wide rate at $3.79 for Homestead. The Preliminary Budget
sets the Village rates at a $1.23 and the Town wide rate is $2.75 for the
Homestead. That was accomplished by significantly reducing the
blacktopping budget from the highway fund. The non Homestead rates in the
Tentative Budget were $2.95 for the Village and $7.80 for the Town. In the
Preliminary Budget the Homestead rates are $2.54 for the Village and $5.66
for the Town. The Town Homestead rate is a 7Y2% increase. The assessment
on the non Homestead property has been reduced significantly from last year
and the increase in percentages is related to that. Discussion followed.
At this time 9:05 p.m., COUNCILMAN RUGGIERO moved to have a 10
minute recess in order to go over some of these figures with Mr. Terwilliger,
before adopting the Preliminary Budget.

A Public Hearing was held by the Town Board of the Town of Wappinger on
October 23, 2000 at the Town Hall, 20 Middlebush Road, Wappingers Falls,
New York for the purpose of making recommendations and suggestions for
the use of Community Development Funds for the year 2001. Supervisor
Smith opened the meeting at 7:27 p.m.
