The Workshop Meeting of the Town of Wappinger was held on October 10,
2000, at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York.
Supervisor Smith opened the meeting at 7:30 p.m.

A Public Hearing having been held on approval of an additional $160,000 for
99-1, the matter of its adoption was now placed before the board for their
consideration.
The following Resolution was offered by COUNCILMAN VALDATI who
moved its adoption and seconded by Mr. Bettina.
PUBLIC INTEREST RESOLUTION DATED OCTOBER 10, 2000
A RESOLUTION MAKING CERTAIN DETERMINATIONS IN RELATION
TO A PROPOSED WATER IMPROVEMENT, IN THE TOWN OF
WAPPINGER DUTCHESS COUNTY, NEW YORK, TO BE KNOWN AS
CENTRAL WAPPINGER EMERGENCY WATER IMPROVEMENT AREA,
IN SAID TOWN
WHEREAS, pursuant to proceedings heretofore had and taken in accordance
with the provisions of Article 12-C of the Town Law, and more particularly a
resolution dated September 13, 2000, the Town Board of the Town of
Wappinger, Dutchess County, New York has determined it to be in the public
interest to establish the Central Wappinger Emergency Water Improvement
Area and acquire and complete certain improvements therefor at a maximum
cost of $500,000;
WHEREAS, following the opening of bids for such improvements it was
determined that the maximum estimated cost of such improvements must be
increased to $660,000, an increase of $160,000; and
WHEREAS, an order was duly adopted by said Town Board on 25th day of
September, 2000 specifying the 10th day of October, 2000, at 7:30 P.M. local
time, at the Town Hall, 20 Middlebush Road, in Wappingers Falls, New York,
in said Town, as the time when and the place where said Town Board would
meet for the purpose of holding a public hearing to consider whether the
aforesaid increase in the maximum estimated cost is in the public interest
and to hear all persons interested in the subject thereof concerning the same;
and

WHEREAS, notice of the aforesaid public hearing was duly published and
posted in the manner and within the time prescribed by Article 12-C of the
Town Law, and proof of publication and posting have been duly presented to
said Town Board; and
WHEREAS, said public hearing was duly held at the time and place in said
order as aforesaid, at which all persons desiring to be heard were duly heard;
and
WHEREAS, said Town Board has duly considered the evidence given at said
public hearing; NOW THEREFORE, BE IT
RESOLVED, by the Town Board of the town of Wappinger, Dutchess County,
New York, as follows:
Section 1. It is hereby determined that it is in the public interest to
increase the maximum estimated cost of the water improvements hereinafter
described for the Wappinger Emergency Water Improvement Area from
$500,000 to $660,000;
Section 2. The proposed improvements shall consist of the
construction of new water wells together with interconnecting facilities,
water mains and original furnishings, equipment, machinery, apparatus,
appurtenances, and incidental improvements and expenses in connection
therewith, at a new maximum estimated cost of $660,000. The method of
financing of said cost shall be by the issuance of serial bonds of said Town of
Wappinger to mature in annual installments over a period not exceeding
forty years and such bonds shall be payable from assessments levied upon
and collected from the several lots and parcels of land deemed benefited from
said improvements and located in said benefited area, so much upon and
from each as shall be in just proportion to the amount of the benefit which
the improvements shall confer upon the same.
Section 3. It is hereby determined that the estimated expense of the
aforesaid improvements does not exceed one-tenth of one per cent of the full
valuation of the taxable real property in the area of said Town outside of
villages and, therefore, in accordance with the provisions of subdivision 13 of
Section 209-q of the Town Law, the permission of the State Comptroller is
not required for such improvement.
Section 4. Pursuant to subdivision 6(d) of Section 209-q of the Town
Law, the Town Clerk is hereby directed and ordered to cause a certified copy
of this resolution to be duly recorded within ten days of the date of adoption
in the Office of the Clerk of the County of Dutchess, New York, which when
so recorded, shall be presumptive evidence of the regularity of the

proceedings and action taken by the Town Board in relation to the aforesaid
improvement.
Section 5. It is hereby further determined that all of the cost of the
aforesaid improvement shall be borne wholly by property within the Central
Wappinger Emergency Water Improvement Area with no cost thereof to be
borne by the entire area of the Town outside of any village.
Section 6. This resolution shall take effect immediately.
The question of adoption of the foregoing resolution was duly put to a vote on
roll call which resulted as follows:

Next is to adopt the BOND RESOLUTION for a total of $660,000.
The following resolution was offered by COUNCILMAN RUGGIERO who

A RESOLUTION AUTHORIZING THE ISSUANCE OF AN ADDITIONAL
$160,000 SERIAL BONDS OF THE TOWN OF WAPPINGER, DUTCHESS
COUNTY, NEW YORK, TO PAY ADDITIONAL COSTS OF A WATER
IMPROVEMENT FOR CENTRAL WAPPINGER EMERGENCY WATER
IMPROVEMENT AREA OF THE TOWN OF WAPPINGER, DUTCHESS
COUNTY, NEW YORK
WHEREAS, pursuant to proceedings heretofore had and taken in accordance
with the provisions of Article 12-C of the Town Law, and more particularly
resolutions dated September 13, 1999 and October 10, 2000, said Town Board
has determined it to be in the public interest to establish the Central
Wappinger Emergency Water Improvement Area and to acquire and
complete certain improvements therefor at a maximum estimated cost of
$660,000;
WHEREAS, it is now desired to authorize the issuance of $160,000 serial
bonds of said Town to pay the costs of such water improvements for said
Area; and
WHEREAS, the capital project hereinafter described, as proposed, has been
determined to be a Type II Action pursuant to Section 617.5(c)(33) of the
regulations of the New York State Department of Environmental
Conservation promulgated pursuant to the State Environmental Quality
Review Act, the implementation of which as proposed, said regulations
provide will not have any significant effects on the environment; and

,,, RESOLVED, by the Town Board of the Town of Wappinger, Dutchess
County, New York as follows:
Section 1. For the class of objects or purposes of paying the cost of the
construction of new water wells together with interconnection facilities,
water mains and original furnishings, equipment machinery, apparatus
appurtenances and incidental improvements and expenses in connection
therewith, to serve a benefited area in said Town, to be known as Central
Wappinger Emergency Water Improvement Area, at a maximum estimated
cost of $660,000, there are hereby authorized to be issued $160,000 serial
bonds of said Town pursuant to the provisions of the Local Finance Law.
Section 2. It is hereby determined that the plan for the financing of
said class of objects or purposes is a follows:
a. by the issuance of $500,000 serial bonds of said Town authorized to
be issued pursuant to bond resolution dated September 13, 1999;
and
b. by the issuance of the additional $160,000 serial bonds of said Town
authorized to be issued pursuant to this bond resolution.
Section 3. It is hereby determined that the period of probable
usefulness of the aforesaid class of objects or purposes is forty years,
pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local
Finance Law. It is hereby further determined that the maximum maturity of
the serial bonds herein authorized will exceed five years, computed from July
6, 2000, the date of issuance of the first bond anticipation not issued for such
purpose.
Section 4. Subject to the provisions of the Local Finance Law, the
power to authorize the issuance of and to sell bond anticipation notes in
anticipation of the issuance and sale of the serial bonds herein authorized,
including renewals of such notes, is hereby delegated to the Supervisor, the
chief fiscal officer. Such notes shall be of such terms, form and contents, and
shall be sold in such manner, as may be prescribed by said Supervisor,
consistent with the provisions of the Local Finance Law.
Section 5. Such bonds shall be in fully registered form and shall be
signed in the name of the Town of Wappinger, Dutchess County New York,
by the manual or facsimile signature of its Supervisor, and a facsimile of its
corporate seal shall be imprinted or impressed thereon and may be attested
by the manual or facsimile signature of its Town Clerk.
Section 6. The powers and duties of advertising such bonds for sale,
conducting the sale and awarding the bonds, are hereby delegated to the
Supervisor, who shall advertise such bonds for sale, conduct the sale, and

award the bonds in such manner as she shall deem best for the interests of
said Town, including, but not limited to the power to sell said bonds to the
New York State Environmental Facilities Corporation; provided, however,
that in the exercise of these delegated powers, she shall comply fully with the
provisions of the Local Finance Law and any order or rule of the State
Comptroller applicable to the sale of municipal bonds. The receipt of the
town shall be a full acquittance to the purchaser of such bonds, who shall not
be obliged to see to the application of the purchase money.
Section 7. All other matters, except as provided herein relating to such
bonds, including determining whether to issue such bonds having
substantially level or declining annual debt service and all matter related
thereto, prescribing whether manual or facsimile signatures shall appear on
said bonds, prescribing the method for the recording of ownership of said
bonds, appointing the fiscal agent or agents for said bonds, providing for the
printing and delivery of said bonds (and if said bonds are to be executed in
the name of the town by the facsimile signature of the Supervisor, providing
for the manual countersignature of a fiscal agent or of a designated official of
the Town), the date, denominations, maturities and interest payment dates,
place or places of payment, and also including the consolidation with other
issues, shall be determined by the Supervisor. It hereby determined that it is
to the financial advantage of the Town not to impose and collect from
registered owners of such serial bonds any charges for mailing, shipping and
insuring bonds transferred or exchanged by the fiscal agent, and accordingly,
pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such
charges shall be so collected by the fiscal agent. Such bonds shall contain
substantially the recital of validity clause provided for in section 52.00 of the
Local Finance Law and shall otherwise be in such form and contain such
recitals in addition to those required by section 52.00 of the Local Finance
Law, as the Town shall determine.
Section 8. The power to issue and sell notes to the New York State
Environmental Facilities Corporation pursuant to Section 169.00 of the Local
Finance Law is hereby delegated to the Supervisor. Such notes shall be of
such terms, form and contents as may be prescribed by said Supervisor
consistent with the provisions of the Local Finance Law.
Section 9. The Supervisor is hereby further authorized, at her sole
discretion, to execute an application, a project financing and loan agreement,
and any other agreements with the New York State Department of
Environmental conservation and/or the New York State Environmental
Facilities Corporation, including amendments thereto, and including any

instruments (or amendments thereto) in the effectuation thereof, in order to
effect the financing or refinancing of the class of objects or purposes described
in Section 1 hereof, or a portion thereof, by a serial bond or note issue of said
Town in the event of the sale of same to the New York State Environmental
Facilities Corporation.
Section 10. The intent of this resolution is to give the Supervisor
sufficient authority to execute those agreements, instruments or to do any
similar acts necessary to effect the issuance of the aforesaid serial bonds or
notes without resorting to further action of this Town Board.
Section 11. The faith and credit of said Town of Wappinger, Dutchess
County, New York, are hereby irrevocably pledged to the payment of the
principal of and interest on such bonds as the same respectively become due
and payable. There shall be annually apportioned and assessed upon the
several lots and parcels of land within said Town of Wappinger Central
Wappinger Emergency Water Improvement Area which the Town Board
shall determine and specify to be especially benefited by the improvements,
an amount sufficient to pay the principal and interest on said bonds as the
same become due, but if not paid from such source, all the taxable real
property in said Town shall be subject to the levy of advalorem taxes without
limitation as to rate or amount sufficient to pay the principal of and interest
on said bonds as the same shall become due.
Section 12. The validity of such bonds and bond anticipation notes
may be contested only if.
1) Such obligations are authorized for an object or purpose for which said
Town is not authorized to expend money, or
2) The provisions of law which should be complied with at the date of
publication of this resolution are not substantially complied with, and an
action, suit or proceeding contesting such validity is commenced within
twenty days after the date of such publication, or
3) Such obligations are authorized in violation of the provisions of the
Constitution.
Section 13. This resolution shall constitute a statement of official
intent for purposes of Treasury Regulations Section 1.150 - 2. Other than as
specified in this resolution, no monies are, or are reasonably expected to be,
reserved, allocated on long-term basis, or otherwise set aside with respect to
the permanent funding of the object or purpose described herein.
Section 14. This resolution which takes effect immediately shall be
published in full in the Southern Dutchess Newspaper, the official

newspaper, together with notice of the Town Clerk in substantially the form
provided in Section 81.00 of the Local Finance Law.

for the proposed water improvement 1999-2(R) the matter of its adoption was
now placed before the board for their consideration.

PUBLIC INTEREST RESOLUTION DATED OCTOBER 10, 2000
A RESOLUTION MAKING CERTAIN DETERMINATIONS IN RELATION
TO A PROPOSED WATER IMPROVEMENT, IN THE TOWN OF
WAPPINGER, DUTCHESS COUNTY, NEW YORK, TO BE KNOWN AS
WAPPINGER WATER IMPROVEMENT ARE - 1999-2(R) IN SAID TOWN
WHEREAS, a map, report and plan, including an estimate of cost, dated
August 11, 1999, together with an amendment thereto, dated September 15,
2000, have been duly prepared in such manner and in such detail as has
heretofore been determined by the Town Board of the Town of Wappinger,
Dutchess County, New York, relating to the implementation of a cost-
effective method of addressing existing source, supply and storage problems
in specified areas of said Town, by the construction of new water wells
together with interconnection facilities, water mains and original
furnishings, equipment, machinery, apparatus, appurtenances, and
incidental improvements and expenses in connection therewith, to integrate
certain specified existing Water Districts and Improvements Areas in said
Town to form a connected system to serve a benefited area in said Town to be
known as Wappinger Water Improvement Area - 1999-2(R) whose boundaries
shall consist of the area specified in Appendix A as attached hereto and
hereby made a part hereof, as more fully shown upon a map on file in the
office of the Town Clerk, which map is available for inspection by any person
or person interested in same during regular office hours at said office; and
WHEREAS, said map, plan and report, including estimate of cost and
amendment were prepared by Paggi, Martin & DelBene, LLP, competent
engineers, duly licensed by the State of New York and have been filed in the

office of the Town Clerk of said Town, where the same are available during
regular office hours for examination by any person or persons interested in
the subject matter thereof; and
WHEREAS, the capital improvements proposed in connection with the
establishment of the Wappinger Water Improvement Area - 1999-2(R) as
hereinabove described, are at maximum estimated cost of $8,590,000; and
WHEREAS, said maximum estimated cost is greater than one-tenth of one
per centum of the full valuation of taxable real property in the area of the
Town of Wappinger outside of any villages and therefor an application to the
Office of the State Comptroller for approval of establishment of said
Wappinger Water Improvement Area - 1999-2(R) will be required; and
WHEREAS, said maximum estimated cost is proposed to be financed by the
issuance by the Town of Wappinger of its serial bonds with maximum
maturity not in excess of the forty year period prescribed by the Local
Finance Law; and
WHEREAS, it is proposed that the cost of the aforesaid improvements shall
be borne by the real property in said Wappinger Water Improvement Area -
1999-2(R) by assessing, levying upon and collecting from the several lots and
parcels of land within such Wappinger Water Improvement Area - 1999-2(R),
outside of any village, which the Town Board shall determine and specify to
be especially benefited by the improvements, an amount sufficient to pay the
principal and interest on serial bonds and bond anticipation notes issued in
anticipation of the issuance of serial bonds, as the same become due and
payable; and
WHEREAS, the aforesaid improvements have been determined to be an
Unlisted Action pursuant to the regulations of the New York State
Department of Environmental Conservation promulgated pursuant to the
State Environmental Quality Review Act, the implementation of which as
proposed, the Town Board of said Town has determined will not result in any
significant environmental effects; and
WHEREAS, an order was duly adopted by said Town Board on September 25,
2000, reciting a description of the boundaries of the proposed Wappinger
Water Improvement Area - 1999-2(R), the improvements proposed, the
maximum amount proposed to be expended for said improvements, the
proposed methods of financing to be employed, the fact that said map, plan
and report, including an estimate of cost, as amended, were on file in the
Town Clerks office for public inspection and specifying the 10th day of
October, 2000 at 7:40 o'clock P.M., local time, at the Town Hall, 20
Middlebush Road, in Wappingers Falls, New York, in said Town, as the time

when and the place where said Town Board would meet for the purpose of
holding a public hearing to consider the establishment of Wappinger Water
Improvement Area - 1999-2(R) and said map, plan and report, as amended,
filed in relation thereto and to hear all persons interested in the subject
thereof concerning the same; and
WHEREAS, notice of the aforesaid public hearing was duly published and
posted in the manner and within the time prescribed by Article 12-C of the
Town Law, and proof of publication and posting have been duly presented to
said Town Board; and
WHEREAS, said public hearing was duly held at the time and place in said
order as aforesaid, at which all persons desiring to be heard were duly heard;
and
WHEREAS, said Town Board has duly considered said map, plan and report
and the evidence given at said public hearing; NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Wappinger, Dutchess
County, New York as follows:
Section 1. It is hereby determined that it is in the public interest to
establish said Wappinger Water Improvement Area - 1999-2(R) and to make
the improvements hereinafter described and such improvements are hereby
authorized. The Proposed area hereby determined to be benefited by said
Wappinger Water Improvement Are - 1999-2(R) is that area specified in
Appendix A annexed hereto and made apart hereof.
Section 2. The proposed improvements shall consist of the
implementation of a cost effective method of addressing existing source,
supply and storage problems in specified areas of said Town, by the
construction of new water wells together with interconnecting facilities,
water mains and original furnishings, equipment, machinery, apparatus,
appurtenances, and incidental improvements and expenses in connection
therewith, to integrate certain specified existing Water Districts and
Improvement Areas in said Town to form a connected system to serve a
benefited area in said Town to be known as Wappinger Water Improvement
Area - 1999-2(R), at a maximum estimated cost of $8,590,000. The method of
financing of said cost shall be by the issuance of serial bonds of said Town of
Wappinger to mature in annual installments over a period not exceeding
forty years and such bonds shall be payable from assessments levied upon
and collected from the several lots and parcels of land deemed benefited from
said improvements and located in said benefited area, so much upon and

Section 3. It is hereby determined that the estimated expense of the
aforesaid improvements exceed one-tenth of one percent of the full valuation
of the taxable real property in the area of said Town outside of villages and,
therefore, in accordance with the provisions of subdivision 13 of Section 209-q
of the Town Law, permission of the State Comptroller is required for such
improvements.
Section 4. It is hereby further determined that all of the cost of the
aforesaid improvements shall be borne wholly by property within the
Wappinger Water Improvement Area - 1999-2(R) with no cost thereof to be
borne by the entire area of the town outside of any village.
Section 5. Pursuant to subdivision 13(b) of Section 209-q of the Town
Law, the Town Clerk is hereby directed and ordered to file a certified copy of
the resolution in the Office of the State Department of Audit and Control in
Albany, New York, together with an application for the approval of the State
Comptroller to the providing of the improvements as described herein. It is
hereby further determined that said application shall be executed and
verified by the Supervisor and shall be completed in the form and contain
such information as shall be prescribed by the State Comptroller.
Section 6. Pursuant to subdivision 6(d) of Section 209-q of the Town
Law, the Town Clerk is hereby directed and ordered to cause a certified copy
of this resolution to be duly recorded within ten days of the date of receipt of
notification of the approval of the State Comptroller, in the Office of the
Clerk of the County of Dutchess, New York, which, when so recorded, shall be
presumptive evidence of the regularity of the proceedings and action taken by
the Town Board in relation to the aforesaid improvements.
Section 7. This resolution shall take effect immediately.

WHEREAS, it is now desired to authorize the issuance of $8,590,000 serial
bonds of said Town to pay the cost of a water improvement for said Area; and
WHEREAS, the aforesaid improvements have been determined to be an

hereby authorized to be issued $8,590,000 serial bonds of said Town pursuant
to the provisions of the Local Finance Law.
Section 2. It is hereby determined that the plan for the financing of
said class of objects or purposes is by the issuance of the $8,590,000 serial
bonds of said Town authorized to be issued pursuant to this bond resolution.
Section 3. It is hereby determined that the period of probable
usefulness of the aforesaid class of objects or purposes is forty years,
pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local

Finance Law. It is hereby further determined that the maximum maturity of
the serial bonds herein authorized will exceed five years.
Section 4. Subject to the provisions of the Local Finance Law, the
power to authorize the issuance of and to sell anticipation notes in
anticipation of the issuance and sale of the serial bonds herein authorized,
including renewals of such notes, is hereby delegated to the Supervisor, the
chief fiscal officer. Such notes shall be of such terms, form and contents, and
shall be sold in such manner, as may be prescribed by said Supervisor,
consistent with the provisions of the Local Finance Law.
Section 5. Such bonds shall be in fully registered form and shall be
signed in the name of the Town of Wappinger, Dutchess County, New York,
by the manual or facsimile signature of its Supervisor, and a facsimile of its
corporate seal shall be imprinted or impressed thereon and may be attested
by the manual or facsimile signature of its Town Clerk.
Section 6. The powers and duties of advertising such bonds for sale,
conducting the sale and awarding the bonds, are hereby delegated to the
Supervisor, who shall advertise such bonds for sale, conduct the sale, and
award the bonds in such manner as she shall deem best for the interests of
said Town, including, but not limited to the power to sell said bonds to the
New York State Environmental Facilities Corporation; provided, however,
that in the exercise of these delegated powers, she shall comply fully with the
provisions of the Local Finance Law and any order or rule of the State
Comptroller applicable to the sale of municipal bonds. The receipt of the
Town shall be a full acquittance to the purchaser of such bonds, who shall not
be obliged to see to the application of the purchase money.
Section 7. All other matters, except as provided herein relating to such
bonds, including determining whether to issue such bonds, including
determining whether to issue such bonds having substantially level or
declining annual debt service and all matter related thereto, prescribing
whether manual or facsimile signatures shall appear on said bonds,
prescribing the method for the recording of ownership of said bonds,
appointing the fiscal agent or agents for said bonds, providing for the
printing and delivery of said bonds (and if said bonds are to be executed in
the name of the Town by the facsimile signature of the Supervisor, providing
for the manual countersignature of a fiscal agent or of a designated official of
the Town), the date, denominations, maturities and interest payment dates,
place or places of payment and also including the consolidation with other
issues, shall be determined by the Supervisor. It is hereby determined that it
is to the financial advantage of the Town not to impose and collect from

registered owners of such serial bonds any charges for mailing, shipping and
insuring bonds transferred or exchanged by the fiscal agent, and accordingly,
pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such
charges shall be so collected by the fiscal agent. Such bonds shall contain
substantially the recital of validity clause provided for in section 52.00 of the
Local Finance Law and shall otherwise be in such form and contain such
recitals in addition to those required by section 52.00 of the Local Finance
Law as the Town shall determine.
Section 8. The power to issue and sell notes to the New York State
Environmental Facilities Corporation pursuant to Section 169.00 of the Local
Finance Law is hereby delegated to the Supervisor. Such notes shall be of
such terms, form and contents as may be prescribed by said Supervisor
consistent with the provisions of the Local Finance Law.
Section 9. The Supervisor is hereby further authorized, at her sole
discretion, to execute an application, a project financing and loan agreement,
and any other agreements with the New York State Department of
Environmental Conservation and/or the New York State Environmental
Facilities Corporation, including amendments thereto, and including any
instruments (or amendment thereto) in the effectuation thereof, in order to
effect the financing or refinancing of the class of objects or purposes described
in Section 1 hereof, or a portion thereof, by a serial bond or note issue of said
Town in the event of the sale of same to the New York State Environmental
Facilities Corporation.
Section 10. The intent of this resolution is to give the Supervisor
sufficient authority to execute those agreements, instruments or to do any
similar acts necessary to effect the issuance of the aforesaid serial bonds or
notes without resorting to further action of this Town Board.
Section 11. The faith and credit of said Town of Wappinger, Dutchess
County, New York, are hereby irrevocably pledged to the payment of the
principal of and interest on such bonds as the same respectively become due
and payable. There shall be annually apportioned and assessed upon the
several lots and parcels of land within said Town of Wappinger, Wappinger
Water Improvement Area - 1999-2(R) which the Town Board shall determine
and specify to be especially benefited by the improvements, an amount
sufficient to pay the principal and interest on said bonds as the same become
due, but if not paid from such source, all the taxable real property in said
Town shall be subject to the levy of advalorem taxes without limitation as to
rate or amount sufficient to pay the principal of and interest on said bonds as
the same shall become due.

Section 12. The validity of such bonds and bond anticipation notes
may be contested only if:
1) Such obligations are authorized for an object or purpose for which said
Town is not authorized to expend money, or
2) The provisions of law which should be complied with at the date of
publication of this resolution are not substantially complied with, and an
action, suit or proceeding contesting such validity is commenced within
twenty days after the date of such publication, or
3) Such obligations are authorized in violation of the provisions of the
Constitution.
Section 13. This resolution shall constitute a statement of official
intent for purposes of Treasury Regulations Section 1.150. - 2. Other than as
specified in this resolution, no monies are, or are reasonably expected to be,
reserved, allocated on a long-term basis, or otherwise set aside with respect
to permanent funding of the object or purpose described herein.
Section 14. This resolution which takes effect immediately shall be
published in full in the Southern Dutchess Newspaper, the official
newspaper, together with a notice of the Town Clerk in substantially the
form provided in Section 81.00 of the Local Finance Law.

Correspondence from Jay Paggi, Engineer to the Town requesting approval of
several change orders for the Wappinger Sewer Transmission/Treatment
Improvement Phase 3A, Contract. The first is for $11,992.29, an additional
cost experienced by the contractor due to interference with a Central Hudson
gas main. The second is for $6,520.77 due a water main veering out from the
assumed location due to the existence of the rock and was to close to the
proposed sewer line, and therefore, damaged. The existing water main pipe
was not able to be traced, therefore, making a precise location is very
difficult. The amount of time, materials and equipment for the Contractor
has in repairing the main, and the utilization of CRMO Pollution Control as
their subcontractor equals $6,520.77. Mr. Paggi recommends the change
orders be approved.

Next is Mr. Paggi's report on the Wappinger Sewer Transmission/Treatment
Improvement Phase 3A Contract No. 1 Proposed Change Order No. 1. The
current specifications call for the contractor to replace the pavement that was
removed for the installation of the sanitary sewer with two (2)2 %"
lifts of binder course blacktop. At that time is was decided to have the
Highway Department to top the entire roadway with approximately 1 of
blacktop. During the early stages of excavations within the Wappingers Park
Subdivision, Mr. Foster observed that the roadway, residents, and his
department might better be served by deleting the installation of the above
trench replacement pavement and allowing his Department to grind down
the entire roadway and remove approximately 5"-7" of material, and then
binder the entire width of the roadway. This will allow the existing
unsuitable pavement to be removed and replaced with the new road. The
sections of road completed this year could then be entirely bindered, and next
construction season, after the entire project is completed, Highway will put
down a top course across the entire roadway. After review with Mr. Foster,
and the contractor, Mr. Paggi's office endorsed Mr. Fosters proposal without
reservations. The Town is under contract with Merritt Construction, Inc. to
repave the trench with two (2) layers of binder type blacktop, including the
installation of approximately 12" of sub -base material (which is and will be
continued to be installed). The unit price bid for this trench replacement
pavement will need to be re -negotiated with the contractor, Merritt
Construction, Inc. The current unit price for this installation is $32.00/S.Y.
The contractor has submitted a revised unit price of $11.62/S.Y. The net
result to the original contract called for 3,605 s.y. of asphalt restoration at
$32.00/S.Y., aggregating $115,360.00. If the new unit price is accepted, the
amount of the item will be 3,605 s.y. at $11.62/S.Y. aggregating
approximately $41,890.10. Mr. Paggi, in conjunction with Mr. Foster, and
Mr. Merritt, President of Merritt Construction, Inc., endorses this change
order and would like the Town Board to authorize the same. Discussion
followed. It was the consensus of the board that Mr. Paggi talk to the
contractor first to see if these changes can be made.

At the August 14, 2000 Architect Don Swartz gave a presentation on the
proposed Senior Center Building. Supervisor Smith explained that one of
the issues that needed to be addressed was the financial cost. At the last
meeting Mr. Valdati wished to be assured that what had been proposed by
Mr. Swartz would be affordable to the taxpayers and wished to further
discuss this issue. Mr. Swartz went over the plans again and explained it
was designed with the assistance of the Recreation Department in terms of
their needs. Parking spaces (110) was one of the issues discussed.
Supervisor Smith felt more parking spaces would be needed. Mr. Valdati
wished to discuss the difference in projects from the 1999 proposed project
that was coming in around $550,000, versus the 2000 proposed project
coming in at $2,496,000. Mr. Paggi explained that the first estimate was
prepared by Mr. Holt and Mr. Ennesser. Mr. Holt was an accountant, not an
architectural engineer. Most of the difference is solely based on the fact that
there was no professional guidance when the first estimate was prepared.
Also the cost per sq. ft. has risen, due to the economy, etc. Discussion
followed.
COUNCILMAN RUGGIERO moved authorize Attorney to Town, Al Roberts,
Engineer to the Town Jay Paggi, and Don Swartz to work on preparing the
bonding resolution for the Town Community Center, and to also include
Robinson Lane Lighting, to cap at $2.7 million. Also authorize Jay Paggi and
Don Swartz to prepare the necessary bids and specs for the proposed facility.

A Public Hearing was held by the Town Board of the Town of Wappinger
on October 10, 2000 at the town hall, 20 Middlebush Road, Wappingers Falls,
New York on the proposed increase in Estimated Maximum Cost of Water
Improvement in the Central Wappinger Emergency Water Improvement
Area in the Town of Wappinger, Dutchess County New York pursuant to
Article 12-C of the Town Law.

The Town Clerk offered for the record, the Affidavit of Posting and
Publication duly signed and notarized. (These Affidavits are attached hereto
and made part thereof the Minutes of this Hearing).
Supervisor Smith announced this Public Hearing is to authorize the
additional $160,000 for the Central Wappinger Water Emergency Water
Improvement Area. Engineer to the Town, Jay Paggi informed the board
that on September 12th he had sent the board a copy of the amendment to the
map, plan and report for the necessary increase and authorization for the
proposed Wappinger Water Improvement 99-1. In August of 1999 the Town
Board authorized Emergency Water Improvement 99-1 in the amount of
$500;000 to construct two wells at the Atlas Well Field and tie them into the
existing distribution system. During the latter part of 1999 and the first part
of 2000 the wells were drilled. In February of 2000 he prepared the
necessary contract documents and the necessary permits with the DEC. The
bids were received on August 14th and they included the completion of two
wells and the construction of a new transmission main to connect the two
wells and new necessary electric service to bring an underground power
supply back to the two new wells. When the bids were received, it was
obvious that there was a short fall in the dollars estimated back in August of
1999. After the analysis was completed it was evident that there was
$160,000 shortfall. Due to the necessity of completing this work, in the
existing current construction environment in the area, and after considerable
research he made a recommendation to the board that the bids were
consistent with construction costs in the Hudson Valley. He therefore

recommended that the bids be awarded and the board seeks the additional
funds. Mr. Paggi said the cost per benefit unit cost would increase from
approximately $9.00 per benefit unit to $12.00. A benefit unit is a typical
single family dwelling on a lot less than two acres.
Supervisor Smith asked if there were any questions or comments from the
audience in regards to the increase of $160,000. Joseph Camilleri of 5 Phyllis
Drive was recognized and he wished to know if the $12.00 benefit unit was a
yearly basis or a one time. Mr. Paggi answered that it was on a yearly basis
based on retiring a twenty year bond.
There were no other questions or comments.
COUNCILMAN BETTINA moved to close the Public Hearing, seconded by
Mr. Ruggiero and unanimously carried.

A Public Hearing was held by the Town Board of the Town of Wappinger
on October 10, 2000 at the town hall, 20 Middlebush Road, Wappingers Falls,
New York on the proposed Water Improvement in the Town of Wappinger
Pursuant to Article 12-C of Town Law to be Known as Wappinger Water
Improvement Area 1999-2(R).
Supervisor Smith opened the meeting at 7:40 p.m.

The Town Clerk offered for the record, the Affidavit of Posting and
Publication duly signed and notarized. (These Affidavits are attached hereto
and made part thereof the Minutes of this Hearing).
Supervisor Smith announced that this Public Hearing was to accept the
amended map, plan and report for the Wappinger Water Improvement Area
1999-2(R). Jay Paggi, Engineer to the Town gave a presentation. The total
project cost for this work on the original map, plan and report was originally
for $7.9 million. The addition of the completion of the Rockingham well and
the Domber well increased the cost to $8.59 million.
Supervisor Smith asked if there were any questions or comments from the
audience. Vic Fanuele wished to know if all the wells that were being dug
were going to be interconnected. Mr. Paggi answered "yes". Mr. Paggi also
explained that a separate district will be authorized by the Town for the 40
plus lots in the Domber subdivision, and they will tie into the line on Balfour
Drive in Rockingham. Mr. Paggi announced that after we go out to bond, this
project will take three years.
There were no more questions or comments.
COUNCILMAN BETTINA moved to close the Public Hearing, seconded by
Mr. Paoloni and unanimously carried.
