The Regular Meeting of the Town Board of the Town of Wappinger was held
on September 25, 2000, at the town Call, 20 Middlebush Road, Wappingers
Falls, New York. Supervisor Smith called the Meeting to order at 7:30 P.M.

MINUTES
The Minutes of the Regular/Workshop Meeting of August 14, 2000, and
Workshop Meeting of September 11, 2000 having previously been forwarded
to the Board Members, were now placed before them for their consideration.
COUNCILMAN VALDATI moved that the above stated Minutes as
presented by the Town Clerk, be and they are hereby approved.

REPORTS OF OFFICERS
Reports for the month of August were received from the Town Justices,
Supervisor/Comptroller, Building Inspector, Receiver of Taxes, Zoning
Administrator.
COUNCILMAN VALDATI moved to accept the reports and place them on
file.

At this time, the Town Clerk announced that the Supervisors Tentative
Budget for the year 2001 was filed with her on Friday, September 22nd, and
she presented a copy of the Tentative Budget to each the Board Members.
SUPERVISOR SMITH announced that she tried to lower the taxes as much
as possible, but she thinks that there are things that can be done by the
Board, that could help. Mr. Terwilliger worked hard on it. She looks forward
to meeting with the board trying to improve it.
PETITIONS AND COMMUNICATIONS
Correspondence from Anne Saylor, Housing Coordinator, Dutchess County
Department of Planning informing the town that her office has reviewed
an application for an Owner -Occupied property Rehab Program for a property

on Quarry Drive, and it has been determined that the occupant is income
eligible for the program..

Correspondence from Judges Wolfson & Morse requesting permission to hire
an additional full time employee to their staff. Judge Wolfson & Judge Morse
were recognized by the board, and they explained that there has been no
increase in staff for the court office since 1989, but the caseload has increased
dramatically. Traffic violations are up by 77%, Criminal matters are up 71%,
and income is up 70%. In order for the court to operate as mandated by the
Office of Court Administration they must obtain adequate help. Since they
are unable to obtain an adequate part time clerk on the salary allowed, it is
essential that the justice court hire a full time clerk to relieve the staff.
SUPERVISOR SMITH explained that in her tentative budget, she has left
the court budget the same, mainly because the Justice Court saved a lot of
money going to computers. It will be up to the town board to look it over at a
budget meeting.

Correspondence from Ed Wisniewski requesting more STOP signs be posted
on Kent Road and lowering the speed limit.

Notification from Dutchess County Waste Water Authority proposing to
designate itself as Lead Agency for carrying out the State Environmental
Quality Review (SEQRA) process for a planned water main primarily along
an abandoned rail bed and some public highways from the Town of
Poughkeepsie to the Town of East Fishkill.
COUNCILMAN RUGGIERO moved to accept the correspondence and place
on file and send correspondence stating the Town of Wappinger has no
objection to them being Lead Agency.

Next is a request from Michael DiZillo for the return of his $800 application
fee due to the fact that his proposed subdivision application was denied,

therefore he is withdrawing his application. Attorney to the Town Al Roberts
informed the board that Mr. DiZillo did attend one meeting, it was discussed,
and immediately it was discovered there were a number of impediments to
him going forward and this subdivision should never have been presented.
Discussion followed.
COUNCILMAN VALDATI moved to release % of the application fee to Mr.
DiZillo and 1/ be retained to pay the cost of conducting the meeting, based on
the advice of council.

Correspondence from Helen Von Hagen regarding the problems she has
experienced with the Hindu Temple on Brown Road adjacent to her property.
The building was to have a buffer upon completion, and it appears that lately
they are having frequent social events which have been very noisy.
In response to the complaint, Zoning Administrator Tanya Lukianoff
explained that there had been a number of violations. The Zoning violations
have been addressed, Mark Liebermann, Fire Inspector was there on Friday,
to inspect the alarms and everything is OK. Tanya also looked at the site
plan, and the screening and planting has been taken care of The trees that
have been planted will take a few years to grow of sufficient size to create a
real buffer. As to complying to the site plan, they have. At this point, in
terms of zoning, they're remedied. The problem Ms. VonHagen is having
might not be the site problem itself. The parishioners are there later in the
evening, again this is not on day to day basis. Discussion followed. The
Zoning Administrator will send a letter to Ms. VonHagen informing her that
site problems have been remedied.

Lane. Supervisor Smith explained that she referred this letter to Graham
Foster. Mr. Foster informed the board that Robinson Lane has since been
paved.

Next is to confirm the appointment of Robert VanTassel for Chelsea Fire
District, and reappointments of Yvonne Tompkins, Chelsea, and Michael
Cacace, Hughsonville Fire District, to the Town of Wappinger Fire
Prevention Bureau.

Correspondence from the NYS Office of Real Property denying maintenance
aid for 1999. The specifics concerning the municipality's noncompliance with
maintenance aid standards were:
1. Assessor's report was not filed in a timely manner
2. Calculated COD did not meet the COD standard.
The determination should not discourage you from actively pursuing
certification in the future. If you wish to appeal this decision, an appeal
mush be submitted in writing within 30 days from the date of the mailing of
this letter. Discussion followed

in attendance for a more detailed explanation.

to Mr. DeGeorge explaining Town professionals are opposed to a 4 -Way STOP
sign.

At this time Robert Gray, P.E. was recognized by the Board. Mr. Gray
explained that he represents Otto Klassen, and Mr. Klassen has a proposed
16 lot Subdivision in the Town of Fishkill which has a short connector road
of approximately 175' that will be constructed in the Town of Wappinger to
connect the subdivision to East Salem Road in the Town of Wappinger. The
proposed name for the road is Newton Drive. The road will be constructed to
meet or exceed the town road standards in the Town of Wappinger. Mr. Gray
is requesting a letter of acceptance by the Town of Wappinger after

construction provided that the road was built to town road specifications.
Discussion followed
COUNCILMAN BETTINA moved that the Town accept the portion of the
road that extends into Wappinger, contingent upon inspection and approval
of Highway Superintendent. Upon acceptance, authorize Supervisor to send
letter notifying that the road will be accepted by the Town of Wappinger
when construction is completed.

Several requests from Ralph Holt, Recreation Committee Chairman.
The first is a request for a P.O. in the amount of $650 payable to BSN Sports
for the purchase of a basketball backboard gooseneck post and steel net. This
work was approved at the July 10, 2000 Town Board Meeting to be installed
at the Castle Point Recreation Area The funds for this purchase are in A-
7110.2. The following are prices received for this purchase.
BSN $529.00 plus shipping
Flaghouse $829.00 plus shipping
Miracle Recreation $856.00 plus shipping
Anaconda Sports $640.00 plus shipping

galvanized steel bleacher with back and side rails. The fund for this

only, and does not include shipping.

At the Town Board meeting dated August 14, 2000, it was agreed to have the
Supervisor sign for, and the Town accept a $5,000 grant for the bridge work
at Reese Park. This brings the total grant money to $8,300.

To this total we have encumbered funds from 1999 of $4,900. This then
provides funding of $13,200 to construct the bridge. The expense side of this
proposal is a follows:
Recreation went out to bid for the construction of the bridge and the low
bidder was Ecological Specialties at $8,200. This bid did not include the
masonry work. We were then instructed to include both pieces of work in the
bid. Recreation did this and there were no responses to the bid request. It
appears nobody is interested in combining the effort. We do have a separate
bid to perform the masonry work. This bid is for $2,800.
Total Funds available (Grants & Encumbered Money $13,200
Projected costs

Recreation is requesting direction to either be allowed to go forward and
contract with the two vendors that have already submitted the low bids or to
again rebid the total project. Discussion followed.

Mr. Holt informed the board that he has received a request from Little
League to take a town position on two (2) very difficult items.
1. Provide Little League with a Town Position on a zero (0) tolerance ground
result to be enforce at our parks.
2. A local lawn service requesting they be allowed to maintain memorial
field at Robinson Lane (cut grass, provide additional clay, etc.)
Supervisor Smith announced that these requests should be placed on a
budget workshop.
COUNCILMAN VALDATI moved to place the requests on a budget
workshop.

At the Town Board meeting of June 26, 2000 Mr. Holt requested approval to
have the driveway at Schlathaus Park paved and to add a small parking area
for about 15 to 20 cars. He was working with an estimate of $28,000 to
perform the work. It was directed by the Town Board to work with the
Highway Department and see if the work could be completed using less
resource. After meeting with Mr. Foster, Highway Superintendent the
following has been proposed.
1. We have a contractor do the "prep" work for the area that is today just
grass and which will be dug up to a depth of 8 to 10 inches. This dirt will
be removed and item #4 trucked in and deposited in the excavated area.
In addition, the driveway itself has some work to be done before paving.
Item #4 will be spread and rolled and then paved; this will remove the
dangerous existing section coming in from All Angels Hill Road. The cost
for this effort is estimated to be $10,500.
2. Our Highway Department will see to the blacktopping, making the
necessary contacts to deliver the needed material. This will have an
estimated cost of $5,200 to pave 7,000 sq. ft. 3" thick.
The total cost for this project will be $15,700. Since the main contractor will
be working in this area during the month of August, Mr. Holt is seeking
approval to have the work completed. There are no resources in his budget
for this work, but there are funds in the Parkland trust which could be used.

Schlathaus Park driveway, and the funds to come out of Parkland trust.

Mr. Holt also explained that there is a real need to complete some road

paving at our Robinson Lane Park. In the past we have paved a section of
1400 ft. and over the years have added many patches. We would like to
repave that section and to pave for the first time, two other sections, one (1)
for 1100 ft. over a section that presently provides a dust trail following every
car that travels it and is terrible for all people watching a ball game or
playing in a ball game along the road. The second section takes the main
road and extends it to the creek 900 ft. We look to, and hope that our
Highway Department could fit this into their schedule. Their estimate of the
cost is $40,000. If resource is available, Mr. Holt would like have the work
done this year. If not, he would include it in his 2001 budget request. This
work is essential in the effort to upgrade our parks. Discussion followed.

Correspondence from Frank Buyakowski regarding the 100' extension of
Farms End Road. Attorney to the Town Al Roberts informed the Board that
he has not received all the proper papers for the easements yet.

Next are several requests to attend conferences and short courses. Tatiana
Lukianoff, Zoning Administrator and Sal Morello, Deputy Building Inspector
are requesting permission to attend the Planning & Zoning Conference 2000
in Ellenville, NY from October 15th to October 18th, and Linda Walters,
Deputy Court Clerk has requested permission to attend the NYS Association
of Magistrates Court Clerks Annual Conference in Ellenville, NY from
October 15th to October 18th.
COUNCILMAN VALDATI moved to authorize Tatiana Lukianoff, Zoning
Administrator, Sal Morello, Deputy Building Inspector, and Linda Walters,
Deputy Court Clerk to attend the requested conferences in Ellenville, NY
from October 15th to October 18th, and their legitimate expenses be a town
charge.

Reports from Mike Tremper of CAMO. The first concerns the Fleetwood
Water District/Village of Fishkill pump station off line. Mr. Tremper
informed the board that he was contacted on August 22, 2000 at 10:30 am by

Mike Takacs of Civil Technologies, the Village of Fishkill engineering firm.
Mr. Takacs stated that on August 23, 2000, the village of Fishkill pump
station, which provides the Fleetwood Water District with water, will be off
line for approximately 4-5 hours.

The next report concerns the tree removal at Atlas Well field. On Tuesday,
August 22, 2000 CAMO receive a call from Central Hudson requesting that
they open the gate to the Atlas Well Field on the morning of August 23, 2000,
as they would be trimming trees along the power lines that lead into the well
field. The gates were opened as requested and assumed that Central Hudson
removed any trees that they determined were jeopardizing the power supply
to the well field.

The last report concerns the driveway to Cider Mill Loop storage tank. On
January 22, 2000, CAMO sent a letter to the Mr. Leczinski of 17 Cider Mill
Loop, requesting that he no longer share the use of the Town's driveway to
the Cider Mill Loop storage tank. The homeowner has since had the
driveway sealed and it was blocked off for a period of time. In the past, Mr.
Leczinski has been informed that the Town is concerned with liability issues.
If the town's position has not changed and Mr. Leczinski should not use or
maintain the road at any time of the year, Mr. Tremper recommends that he
be informed of this by a Town Official, other than himself.
COUNCILMAN VALDATI moved to authorize Supervisor Smith send Mr.
Leczinski a letter advising him that he is not to use or maintain the Town
driveway.

Next are several reports from Jay Paggi, Engineer to the Town.
The first is in reference to a meeting that was held at the Tri -Municipal
Sewer Commission on August 22, 2000 for the Wappinger Sewer
Transmission/Treatment Improvement/Phase 3A Tri -Municipal Sewer
Construction had to do with an update given by the Tri -Municipal Sewer
Commission on their progress. In his letter of August 30, 2000 on Wappinger
Sewer Transmission /Treatment Improvement/Phase 3A, Contract I Mr.
Paggi informed the board that it was necessary to cross the gas main that

exists on the south side of Old Hopewell Road. Central Hudson was very
cooperative in the relocation of the gas main. The only cost the town will
incur is the additional time for the contractor to demobilize and remobilize.
Perhaps a letter should be sent to Central Hudson thanking them for their
cooperation.
COUNCILMAN BETTINA moved to accept Mr. Paggi's report, and authorize
the Supervisor to send Central Hudson a letter thanking them for their
cooperation.

September workshop for the increase and authorization necessary for
Contract 99-1, the general construction contract and 99-1E the electric

Also sent on September 12th were the Map, Plan and Report for the increase
in authorization and the short form SEQRA document for the boards review.

ORDER CALLING
PUBLIC HEARING
WHEREAS, pursuant to proceedings heretofore had and taken in accordance
with the provisions of Article 12-C of the Town Law, and more particularly a
resolution dated September 13, 1999, the Town Board of the Town of
Wappinger, Dutchess County, New York, has determined it to be in the
public interest to establish the Central Wappinger Emergency Water
Improvement Area and to acquire and complete certain improvements
therefor at a maximum estimated cost of $500,000.

WHEREAS, following the opening of bids for such improvements it was
determined that he maximum estimated cost of such improvements must be
increased to $660,000, an increase of $160,000; and
WHEREAS, said increased maximum estimated cost of $660,000 is not
greater than one tenth of one per centum of the full valuation of taxable real
property in the area of the Town of Wappinger outside of any villages and
therefore an application to the Office of the State Comptroller for approval of
establishment of said Central Wappinger Emergency Water Improvement
Area will not be required; and
WHEREAS, said increased maximum estimated cost is proposed to be
financed by the issuance by the Town of Wappinger of its serial bonds with a
maximum maturity not in excess of the forty year period prescribed by the
Local Finance Law; and
WHEREAS, it is proposed that the cost of the aforesaid improvements shall
be borne by the real property in said Central Wappinger Emergency Water
Improvement Area by assessing, levying upon and collecting from the several
lots and parcels of land within such Central Wappinger Emergency Water
Improvement Area, outside of any village, which the Town Board shall
determine and specify to be especially benefited by the improvements, an
amount sufficient to pay the principal and interest on such serial bonds, and
bond anticipation notes issued in anticipation of the issuance of serial bonds,
as the same become due and payable; and
WHEREAS, the aforesaid improvements have been determined to be a Type
II Action pursuant to Section 617.5(c)(33) of the regulations of the New York
State Department of Environmental Conservation promulgated pursuant to
the State Environmental Quality Review Act, the implementation of which as
proposed, said regulations provide will not result in any significant
environmental effects; and
WHEREAS, it is now desired to call a public hearing for the purpose of
considering whether said increase in the maximum estimated cost is in the
public interest, and to hear all persons interested in the
subject thereof concerning the same, all in accordance with the provisions of
Section 209-q(5) of the Town Law; NOW THEREFORE, BE IT
ORDERED, by the Town Board of the Town of Wappinger, Dutchess County,
New York, as follows:
Section 1. A public meeting of the Town Board of the Town of
Wappinger, Dutchess County, New York, shall be held at the Town Hall, 20
Middlebush Road, in Wappingers Falls, New York, in said Town on the 10th
of October, 2000 at 7:30 o'clock p.m., Prevailing Time, to consider whether

also to post a copy thereof on the town signboard maintained by the Town
Clerk, not less than ten days (10) nor more than twenty (20) days before the
day designated for the hearing as aforesaid, all in accordance with the
provisions of Section 209-q of the Town Law.

At this time Environmental Consultant Matt Rudikoff was recognized, to give
a short report on SEQRA. He explained that all the aspects of the site have
no impact. He also received confirmation from the New York State Office of
Parks and Recreation that all of the archeology work that was done gave a
green light and cleared the way to consider the Negative Declaration.
Adding addendum #1 to the EAF that was previously done, your
consideration of the resolution as amended, and the Negative Declaration, he
would recommend is appropriate at this time.

TOWN OF WAPPINGER WATER IMPROVEMENT 1999-2(R)
ISSUANCE OF A SEQR NEGATIVE DECLARATION
TYPE I ACTION, COORDINATED ENVIRONMENTAL REVIEW
WHEREAS, the Town of Wappinger currently owns, operates and maintains
numerous water districts within the central portion of the town, including:
• Central Wappinger Water Improvement Area;
• North Wappinger Water District;
• Ardmore Water District;

• Myers Corners II Water District;
• Cranberry Hills Water Improvement; and
WHEREAS, the Town of Wappinger Town Board ("Town Board") is
considering implementation of a cost-effective method of addressing existing
source, supply and storage problems associated with the Town of Wappingers
largest water district, the Central Wappinger Water Improvement; and
WHEREAS, existing components of each separate water improvement area
(and system) will be integrated to form a connected system under a new
comprehensive water improvement area to be known as the "Wappinger
Water Improvement". The existing water supply sources serving the above
individual districts will remain and planned improvements will be made to
address current and future issues of supply and demand; and
WHEREAS, the Town Board has evaluated the existing Central Wappinger
Water Improvement, related Districts and projected water demands,
contained in part in the Wappinger Water Improvement Engineer's Report
prepared by Paggi, Martin & DelBene, LLP, and has determined that the
Improvement proposed properly and efficiently fulfill the existing and future
needs identified by the Engineer's Report, and
WHEREAS, the proposed action includes the following major components at
the following project locations:
• At the Atlas Wellfield, the installation of four (4) additional new water
supply wells, the construction of an approximately 10 -foot deep, 40'x40'
"Clear Well" chlorine detention facility, the installation of an emergency
back-up electrical power generator, and the installation of high lift
pump(s)/controls and meter;
• At the Hilltop Wellfield, construction of an approximately 10 -foot deep,
40'x40' "Clear Well" chlorine detention facility and installation of an
emergency back-up electrical power generator;
• At the Cider Mill Loop Water Storage Tank site, the construction of
second elevated water storage tank (42 feet high, 73 -foot diameter,
"Aquastore" or equal, 1.3 million gallon capacity) adjacent to the existing
storage tank, as well as installation of telemeter/controls and inspection
repairs of the existing 1.0 million gallon, 38 -foot high elevated water
storage tank;
• At the Rockingham Water Storage Tank site the demolition of the existing
0.3 million gallon, 40 -foot high, 36 -foot diameter elevated water storage
tank and the construction of a new elevated water storage tank (79- foot
high, 36 -foot diameter, "Aquastore" or equal, 0.6 million gallon capacity)
over the same footprint as the existing tank, after its demolition;

• At the Rockingham Wellfield site, the development of a new water supply
well and the connection of same to the water system;
The proposed action also includes the acceptance of a parcel of land
(proposed Lot No. 7 of Meadowood Subdivision) and the development of
two (2) new water supply wells and appurtenant facilities and the
connection of same to the water system;
• The proposed action also includes the installation of a dedicated water
supply line, substantially within an existing water line easement (and
parallel to an existing water main) or along developed street rights-of-
way, consisting of approximately 18,500 linear feet (LF) which will
provide a direct connection from the Atlas Wellfield water source supply
with Cider Mill Loop Water Storage Tank Site;
• The proposed action also included the installation of a Pressure Reducing
Station (PRS) within an existing water supply facility building, just north
of Myers Corners Road. The function of the PRS is to reduce the pressure
of the water entering the system;
• The proposed action also includes the installation of individual water
meters for users in the North Wappinger Water District and the
installation of pumps generators and related controls and systems
appurtenant to the water system; and
WHEREAS, the proposed action as such, involves and "Improvement"
pursuant to Article 12 of New State Town Law; and
WHEREAS, the proposed action will be financed through the issuance of
bonds under Local Finance Law and/or through the New York State Drinking
Water Revolving Fund (NYSDWRF); and
WHEREAS, on May 8, 2000, at a regular meeting, the Town Board classified
the proposed action as an Unlisted action, pursuant to SEQR 6 NYCRR Par
617; and
WHEREAS, on May 8, 2000, the Town Board further declared its intent to
serve as lead agency for a coordinated environmental, review of the proposed
Unlisted action and authorized the circulation of a Notice to other involved
agencies of its intent to serve as lead agency, indicating that a lead agency
must be designated within 30 days, as set forth in SEQRA 6 NYCRR Part
617.6; and
WHEREAS, the Town Board not having received any objections to its
serving as lead agency, declared itself to be lead agency with all the duties
and discretion lawfully attendant thereto, for the coordinated environmental
review and evaluation of the proposed Unlisted action; and

WHEREAS, the Town Board, as lead agency, caused the preparation of an
Expanded Full Environmental Assessment Form (EAF), as prepared by
Matthew D. Rudikoff Associates, Inc., dated July 25, 2000; and

Expanded EAF, which is attached and made a part hereof, and
WHEREAS, in addition to the Expanded EAF dated July 25, 2000, revised
August 30, 2000, and EAF Addendum No 1 dated September 19, 2000 the
Town Board, as lead agency, has reviewed and considered the following in
support of the proposed action:

WHEREAS, the Town Board, as lead agency, has considered the materials
prepared in evaluating the environmental aspects of the proposed action, has

other documentation and information as considered necessary, and has
considered and evaluated pertinent materials related to the proposed action;
NOW THEREFORE BE IT RESOLVED, that the Town of Wappinger
Town Board, as lead agency, hereby determines, pursuant to SEQRA 6
NYCRR Part 617, that the proposed Unlisted action will not have a
significant adverse effect (Negative Declaration) on the environment and
preparation of an Environmental Impact Statement will not be required; and
BE IT FURTHER RESOLVED, that the Town Board, as lead agency, relies
on the reasons included in the Negative Declaration attached hereto and
made a part hereof in making said Determination of Non -Significance; and

ORDERED, by the Town Board of the Town of Wappinger, Dutchess County,

Section 1. A public meeting of the Town Board of the Town of
Wappinger, Dutchess County, New York, shall be held at the Town Hall, 20
Middlebush Road, in Wappingers Falls, New York, in said Town on the 10th
of October, 2000 at 7:40 o'clock p.m., Prevailing Time, to consider the

Supervisor Smith informed the board that there was a strong possibility that
someone will be donating 47.9 acres of property to the Town of Wappinger.
The owner is in the process of getting an appraisal in order to get a Tax Right
Off. At this time she needs authorization to retain Chazen to perform the
Environmental Impact Phase I. Supervisor Smith contacted Chazen and
was informed that the cost for the study would be around $1,600. She wishes
to wait until after the appraisal is completed before retaining Chazen.

Chazen Environmental to perform the Environmental Impact Phase I after
the appraisal is completed.

Next is to authorize the Attorney to the Town and Engineer to the Town to do
the necessary work for the Senior Center and Robinson Lane Light Bonding.
COUNCILMAN VALDATI felt the board was moving to quickly on this issue.
He feels the board should sit down with the Planner and discuss this, area by
area, use by use. He does not feel comfortable going from the architects
conception right to bonding. He wishes to be assured that what has been
proposed to the taxpayers, is affordable. COUNCILMAN RUGGIERO was
under the impression that what Mr. Swartz presented was a very thorough
presentation. Unless you wish to scale down the building or make changes,
what more discussion is needed. SUPERVISOR SMITH explained, that we
do need to got out to bond, and we do need four votes. If anyone has more
questions and needs more assurance, then perhaps we should have a
workshop for further discussion.

was only one resident, the instructor, Mr. Paoloni, and herself, in
attendance. It was an excellent presentation.
Some time ago, Mr. Bettina asked SUPERVISOR SMITH to look into the
installation of lights for Chelsea. She went to Central Hudson for some
quotes. She then sent out letters to the residents and explained if they
could not attend the meeting on the 161h to call her. Some called, some came
to the meeting. Supervisor Smith called the ones that did not attend or call.
There were 13 that were unreachable or unlisted, Nineteen (19) were
against, two (2) were for lights, and two (2) did not know at this time. She
sent out letters to the residents informing them there would be no street
lights installed at this time.

A report was submitted from the Zoning Administrators Office for the month
of August on the schedule of Bonds and Letters of Credit on the various
subdivisions, the amounts, expiration dates and call up dates. Also a letter of
Acceptance from Premier National Bank for James Klein in the amount of
$13,750 until November 19, 2000.

At this time, it is necessary to renew the Agreement between the Town and
the County for the rental of equipment for the control of Snow and Ice on
County Roads for the 2000-2001 season and authorize the Town Clerk to
sign.
The following Resolution was offered by COUNCILMAN VALDATI, who
moved its adoption, and authorized the Town Clerk to sign.
WHEREAS, the Town Superintendent of Highways has been requested by
the County of Dutchess to participate in the regional County Highway Snow
and Ice Control Program within the boundaries of the Town, and
WHEREAS, and logically, an earlier of sooner response factor can be
provided by Town units and personnel within the locale thereby benefiting ,
the overall safety and welfare of town residents and local community
interest, and
WHEREAS, such participation by the Town in removing snow from
designated County Highways, and by sanding and salting or otherwise
treating them for the purpose of maintaining highway safety and
accessibility for emergency services, is specifically authorized by Article 6,
Section 135 of the New York State Highway Law, now, therefore, be it
RESOLVED, that the Town Highway Superintendent be and is herein
authorized to perform such work as its found necessary at hourly rates as

throughout the County; and
WHEREAS, in order to enable appropriate responses from emergency
personnel, E-911 Project Coordinators have requested each municipality to
name private roads in each Town; and
WHEREAS, the names of private roads will enable E-911 to input
appropriate information into their response system; and
WHEREAS, the Town has conceptually agreed with E-911 for the names of
private roads, which are annexed hereto as Schedule "A";
NOW THEREFORE, BE IT RESOLVED, that the Town of Wappinger hereby
adopts the names on the attached Schedule as private road names in said
Town; and be it further
RESOLVED, that the Town Board specifically states that these roads are not
being named and are not being accepted for dedication as public roads in and
for the Town of Wappinger, but only to provide a means of identifying private
roads for emergency response purposes; and be it further

GRAHAM FOSTER, Highway Superintendent. At the last Board meeting
Jay Paggi was authorized to come up with an estimate to take care of a
complaint on Ketchamtown Road. He wishes to have a copy of the complaint
letter. He is getting ready to pave the road, and if there is something that
needs to be addressed first, he would like take care of it.

COUNCILMAN PAOLONI informed the Board that residents have requested
Planning Board Member, Bill Parsons abstain from any decisions pertaining
to GALS, Inc., located on All Angels Hill Road.

COUNCILMAN BETTINA would like to set up a meeting with Fishkill

Lane Lighting at the October 10th workshop.
SUPERVISOR SMITH reminded the board that because Columbus Day falls
on Monday October 9th, the workshop will be held October 10th.

COUNCILMAN BETTINA would like a workshop on the Osborne Hill water
problem. Either extend the district or create a district. Supervisor Smith
has tried to contact the Mayor to set up the initial meeting with no success.
Councilman Bettina would like Supervisor Smith to send the Mayor a letter.
A representative for Roger Akeley, John Clark from the Dutchess County
Department of Planning gave a short presentation on Greenway. They are
asking communities to consider adoption in a fairly similar pattern so they
may qualify as a Compact member. Discussion followed.
COUNCILMAN RUGGIERO moved to refer to Town Planner, Dan Wery to
review and make proposals for the Town Board.
