Dear Mr. Ruggiero:
On behalf of New York City Department of Environmental Protection, a letter dated July
13, 2004 was sent to you informing you of the Department's project investigating the
feasibility of withdrawing water from the aquifer beneath the bed of the Hudson River.
We are pleased to inform you that work on this project began on the river on October 4,
2004. The contractor performing the work has requested to extend his work hours in an
effort to expedite the work. It is our understanding from our conversation with Gloria J.
Morse that Chapter 166-2 of your town code prohibits construction or demolition noises
between 7:00pm and 7:00am. Therefore, please consider this letteras notice of intention
to allow the contractor to work between the hours of 7:00am and 7:00pm. We have
reached out to other parties who may be concerned with this change in work hours, and
no objections have been raised. As progress continues, Malcolm Pimie, Inc., acting on
behalf ofthe City of New York, will keep you informed of the project's progress.
