PAOLONI SUPERVISOR'S OFFICE 20 MIDDLEBUSH ROAD WAPPINGERS FALLS, NY 12590 (845) 297-2744 FAX: (845) 297-4558 RECE'V~') APR 1 7 2007 TOWN CLERK TOWN OF WAPPINGER LOCAL STATE OF EMERGENCY DECLARED Executive Order No. 2007-2 WHEREAS, during the period of April1Sth & April 16th, the Town of Wappinger received heavy rain as of a result of a Nor'easter storm; and WHEREAS, Executive Order 2007-1 was issued on April 16, 2007 in response to this storm, and WHEREAS, Paulette Lane and Joan Lane have been severely flooded and the properties of that area have been inundated with water, and WHEREAS, George Kolb, Town of Wappinger Director of Code Enforcement has deemed a commercial property, the site of the business known as the Bookworm, located at 1797 Route 376, to be in danger of collapse due to the storm which has caused the building to shift with the potential to collapse into the Wappinger Creek, and WHEREAS, the National Weather Service in Albany has issued a flood warning for the Wappingers Creek until late Monday evening, April 16, 2007, which forecasts said creek to rise above flood stage levels, and WHEREAS, the Hunter Creek and Sprout Creek has risen above their creek banks causing flooding in various areas and properties throughout the Town of Wappinger, THEREFORE, I, JOSEPH RUGGIERO, SUPERVISOR OF THE TOWN OF WAPPINGER, under the powers granted to me by the State of New York in Article 2B of Executive Law, do hereby declare a State of Emergency exists in the Town of Wappinger, AND PURSUANT TO EXECUTIVE LAW, I, JOSEPH RUGGIERO, SUPERVISOR OF THE TOWN OF WAPPINGER, issue the following Executive Order: 1. The recitations above set forth are incorporated in this Executive Order as if fully set forth and adopted herein. .. 2. I herby expand the disaster area to include Paulette Lane and Joan Lane and the property and building located at 1797 Route 376 in the Town of Wappinger. 3. I hereby authorize the Town of Wappinger Highway Department, CAMO Pollution Control and the Town of Wappinger Patrol to take whatever steps are necessary to protect life and property, public infrastructure, and provide any other emergency assistance as deemed necessary. 4. The Town of Wappinger Highway Department, Town Code Enforcement Officials and any other Emergency Services Personnel are hereby authorized to access private property within said disaster area for purposes which they deem necessary to assist residents of the Town of Wappinger and in carrying out this Executive Order. 5. I hereby authorize Sun Up Construction to perform any work necessary to secure and make safe the property and building located at 1797 Route 376. 6. I hereby suspend the Town of Wappinger Procurement Policy to carry out Executive Order 2007-1 and Executive Order 2007-2 in dealing with this State of Emergency.
