Executive Order No. 2006-3
WHEREAS, the Town of Wappinger owns a 99 acre estate located on Wheeler Hill
Road in the Town of Wappinger known as "Carnwath Estate" or "Carnwath Farms"; and
WHEREAS, two of the primary structures on the property are the so called "dormitory
building" a large, concrete and brick building and a related attached structure formerly used as a
religious chapel; and
WHEREAS, the boiler! heating system providing heat and hot water to the
aforementioned buildings has broken down and is not operating; and
WHEREAS, the Town has had two plumbing companies examine the boiler/ heating
system and both have determined that the boiler/heating system is extremely old, with
replacement parts unobtainable, and both plumbing companies have recommended that the
boilerlheating system be replaced as soon as possible; and
WHEREAS, the dormitory building is partially occupied by the Dutchess County Sports
Museum; and
WHEREAS, the potential for severe cold and freezing temperature is imminent at this
time of year, and a severe cold spell could seriously damage the plumbing system and pipes for
the aforementioned buildings; and
WHEREAS, both plumbing companies have recommended to the Supervisor that
immediate repairs be performed and that the boiler/heating system serving the dormitory
building and former chapel located at the Carnwath Estate be immediately replaced before cold
weather sets in.
THEREFORE, I, JOSEPH RUGGIERO, SUPERVISOR OF THE TOWN OF
WAPPINGER, under the powers granted to me by the State of New York in Article 2-B 924 of
the Executive Law, do hereby declare that a State of Emergency exists in the Town of
Wappinger with respect to the dormitory building and former chapel located at the Carnwath
Estate and that immediate measures are required to cure the aforementioned dangerous
conditions.

AND PURSUANT TO EXECUTIVE LAW, I, JOSEPH RUGGIERO, SUPERVISOR
OF THE TOWN OF WAPPINGER, issue the following Executive Order:
1. The recitations above set forth are incorporated in this Executive Order as if fully
set forth and recited herein.
2. I hereby direct that the following Town Officers and/or employees and/or
professionals are directed to take whatever steps are necessary to coordinate and facilitate a
replacement of the boiler/heating system serving the dormitory and former chapel at the
Carnwath Estate and have the same replaced as soon as practicable: Recreation Director,
Superintendent of Highways, Engineer to Town and Attorney to Town.
3. I hereby suspend the Town of Wappinger Procurement Policy for the immediate
replacement of the boiler/heating system serving the dormitory building and the former chapel at
the Carnwath Estate and I hereby authorize that said replacement be made by Bottini Fuel, a
qualified plumbing contractor at a sum not to exceed $23,850.
4. This Executive Order is effective immediately, and shall remain in effect for a
period of five (5) days or until rescinded or extended as circumstances dictate.
