A Town Board Meeting of the Town of Wappinger was held on February 22,
1999 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York.
Supervisor Smith called the meeting to order at 7:30 p.m.

Supervisor Smith wished to have it so noted in the minutes, that Councilman
Bettina was absent tonight, due to a family emergency.
The Supervisor asked all to join in the Pledge of Allegiance to the Flag.
SUPERVISOR SMITH informed the Board that we were only going to cover
about five items on the agenda tonight because she was ill.
MINUTES
The Minutes of January 25, 1999 and February 1, 1999 having previously
been forwarded to the board members was now placed before them for their
consideration.
COUNCILMAN RUGGIERO moved to accept that the above stated Minutes
as submitted by the Town Clerk be and they are hereby approved.

REPORTS OF OFFICERS
Reports for the month of January were received from the Town Justices,
Supervisor/Comptroller, Receiver of Taxes, Building Inspector, Zoning
Department, and Dog Control Officer for December & January.
COUNCILMAN RUGGIERO moved to accept the reports and place them on
file.

A request from Leo Lowney, Village Clerk, for the use of three (3) town voting
machines for the upcoming Village Election to be held on March 16, 1999.
COUNCILMAN VALDATI moved to authorize the use of three (3) voting
machines for the upcoming Village Election as requested by Mr. Lowney,
Village Clerk.

Two requests from Gerald Terwilliger, Comptroller for transfer of funds.
First is a request to transfer from 899B Miscellaneous Reserve, amount
$120,000 to 8540.400B storm cleaning and drainage to cover estimate #1 and
#2 for Robert Lane Drainage Improvement Project, Advanced Excavating and
Landscaping, Inc.
COUNCILMAN RUGGIERO moved to authorize the transfer of $120,000
from 899B Miscellaneous Reserve, to 8540.400B storm cleaning and drainage
as requested by Mr. Terwilliger, Comptroller.
Seconded by Mr. Valdati

The second request is for Budget Amendments for Highway. Increase State
Aid 3502.000 DB SHIPS Program $11,364.00. Increase 5112.410. DB
Improvements SHIPS Program $11,364.00 to show SHIPS money reimbursed
for Wheeler Hill Road Realignment.
COUNCILMAN RUGGIERO moved to authorize the above Budget
Amendments as requested by Mr. Terwilliger, Comptroller.

Correspondence from Al Roberts, Attorney to the Town regarding the matter
of Town of Wappinger vs. Niemcyk. Mr. Niemcyk was sent a notice of
violation in conduct of an automotive body repair shop in a residential
district. Both Town Justices (Wolfson and Morse) have excused themselves
from the matter. The matter was referred to Judge Hancock in the Town of
Fishkill. Acting Zoning Administrator, Mark Liebermann and Town
Consultant Don Close have requested assistance from Mr. Roberts in the
matter. Mr. Roberts is requesting authority from the full board to
participate.
COUNCILMAN VALDATI moved to authorize Al Roberts, Attorney to the
Town to represent the Town in the matter of Niemcyk vs. the Town of
Wappinger, before Judge Hancock in the Town of Fishkill.

The Town was served with a Small Claims Summons form the City of
Beacon Court in the matter of Mullins vs. the Town of Wappinger.
Originally this had been served to the Town as a Torte Claim, forwarded to
our Insurance Carrier, and the Insurance Carrier responded to the Town that
the amount was below the deductible, thus payment was denied. The matter

now being in Small Claims Court, it is necessary for the Town Board to
authorizes the Attorney to the Town, Al Roberts to defend on behalf of the
Town of Wappinger.
COUNCILMAN VALDATI moved to authorize Al Roberts, Attorney to the
Town, to represent the Town in the matter Mullins vs. the Town of
Wappinger, in Small Claims Court, Beacon, New York.

A Public Hearing having been held on a proposed Local Law exempting the
residency requirements for the position of Comptroller for the Town of
Wappinger, the matter of its adoption was now placed before the board for
their consideration.
The following Resolution was offered by COUNCILMAN VALDATI, who
moved its adoption, seconded by Mr. Ruggiero.
LOCAL LAW #2 OF THE YEAR 1999
EXEMPTING THE POSITION OF COMPTROLLER
OF THE TOWN OF WAPPINGER FROM RESIDENCY
REQUIREMENTS
IMPOSED BY NEW YORK STATE TOWN LAW SECTION 23
A Local Law entitled "Local Law Exempting the Position of Comptroller of
the town of Wappinger from Residency Requirements Imposed by New York
State town Law Section 23".
BE IT ENACTED by the Town Board of the Town of Wappinger as
follows:
Section I: Title: Local Law Exempting the Position of
Comptroller of the Town of Wappinger from Residency
Requirements Imposed by New York State Town Law Section 23.
This Local Law shall be known and cited as Town of Wappinger Local
Law No. of 1999, entitled "Local Law Exempting the Position of
Comptroller of the Town of Wappinger from Residency Requirements
Imposed by New York State by New York State Town Law Section 23".
Section II: Legislative Intent:
The Town Board acknowledge that Section 23 (1) of the New York
State Town Law requires every officer of the town at the time of his
appointment and throughout his term of office to be an elector of the town.
However, by recent amendment of Section 23 (3) of the Town Law the State

Legislature has exempted the residency requirement of the Comptroller of
the Town of Mount Pleasant.
Section 10 of the Municipal Home Rule Law of the State of New York
authorizes a town to adopt by local law for its own purposes, any statutory
provision, amendment or exemption which has been expressly authorized by
the State Legislature for any other named town, thereby superseding general
statutory provisions to the contrary.
Moreover the Town Board recognizes that the Town of Wappinger
benefits from the residence of its officers within the Town including, but not
limited to benefits realized by fostering an increased sense of community.
However, the Town Board has determined that the position of Comptroller is
one that requires special skills and training. Moreover, in light of these
requirements for special skills and training, it is the determination of the
Town Board that any benefits that accrue from the residency within the
Town of its Comptroller are outweighed by the importance of filling the
position of Comptroller with the best qualified candidate. Accordingly, the
Town Board has decided to enact a local law exempting the position of
Comptroller from the residency requirements imposed by New York State
Town Law Section 23.
Section III: Exemption of the Residency Requirement for the
Comptroller.
In accordance with the Legislative Intent noted above, the person
appointed to the position of Comptroller in the Town of Wappinger shall not
be required to be an elector or resident of the Town of Wappinger in order to
hold and serve such position.
Section IV: Separability.
The provision of this Local Law are separable and if any provisions,
clause, sentence subsection, work or part thereof is held illegal, invalid or
unconstitutional, or inapplicable to any person or circumstance, such
illegality, invalidity or unconstitutionality, or inapplicability shall not affect
or impair any of the remaining provisions, clauses, sentences, subsections,
words or parts of this Local Law or their application to other persons or
circumstances. It is hereby declared to be the legislative intent that his Local
Law would have been adopted if such illegal, invalid or unconstitutional
provision, clause sentence, subsection work or part had not been included
therein, and if such person or circumstance to which the Local Law or part
thereof is held inapplicable had been specifically exempt therefrom.
Section V: Supersession.

Pursuant to Municipal Home Rule Law Section 22, the provisions of
this Local Law are intended to supersede any inconsistent or contrary
provisions contained in the New York State Constitution or in Town Law
Sections 20 and 23, or Public Officers Law Section 3.
Section VI: Effective Date.
This Local Law shall take effect immediately upon adoption and filing
with the Secretary of State as provided by the Municipal Home Rule.
