A Town Board Meeting of the Town of Wappinger was held on November 23.
1998 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York.
Supervisor Smith called the meeting to order at 8:05 p.m.

MINUTES
The Minutes of the Regular Meeting of October 26, 1998 and Workshop
Meeting of November 9, 1998, having previously been forwarded to the Board
Members, were now placed before them for their consideration.
COUNCILMAN BETTINA wished to clarify the Minutes of the October 26,
1998. The reason he voted nay on the tentative budget, was because Mr.
Valdati was absent from the meeting.
COUNCILMAN RUGGIERO moved to accept the above stated Minutes as
submitted by the Town Clerk be and they are hereby approved at corrected.

Reports for the month of October were received from the Town Justices,

and audit, be and the same is hereby approved for payment, in the amount so

PETITIONS & COMMUNICATIONS
The first item for the boards consideration is a petition from adjoining
property owners to the former Parsons property on Myers Corners Road, now
believed to be owned by A. Lieberman and having been running an illegal
business know as PIQWON, has requested a zoning variance and/or rezoning
of the property. The residents oppose such change, and believe the portion of
property occupied by PIQWON is zoned residential and should remain that
way. The petitioners further request all work or activities on the property
cease immediately and all stored construction equipment and house/office
trailers be removed at once. Don Close, Zoning Administrator explained that
he had notified Mr. Lieberman he was in violation, and ordered a petition to
remedy within 90 days. Discussion followed, and Mr. Roberts, Attorney to
the Town informed the board that he believes that there are portions of Mr.
Lieberman's business that can still be conducted, such as his administrative
offices, and perhaps some of the repair work. The actual contractors yard is
not a permitted use. That portion would have to be relocated. In fairness to
Mr. Close, the only thing he can do is issue an Order to Remedy, and if they
fail to comply with that, he can issue a fine. He can not close them down. Its
up to the Town Board to bring an action to the Supreme Court and get an
injunction.
COUNCILMAN PAOLONI moved to authorize Attorney to the Town, Al
Roberts, to prepare and file an application to the Supreme Court for an
injunction, at the conclusion of the expiration of the Petition to Remedy.

At this time resident Guy Gagne of 80 All Angels Hill Road was recognized
by the board, and he wished to know if it would be possible to send the owner
a warning letter instead of filing an application to the Supreme Court for an
injunction. Mrs. Smith informed Mr. Gagne that the owner has already
received a warning letter, and this would be step 2.

CORRESPONDENCE from Maureen Wolfe a resident of 37 Ardmore Drive in
regard to the dispute that has arisen in regard to the renaming of the
private portion of the Ardmore Drive extension. Mr. Ruggiero informed the
Board that he met with Mrs. Wolfe regarding the controversy over renaming
of the road. A committee met, and they decided that they would like the
road to be named Farms End Road.
COUNCILMAN RUGGIERO moved to renaming the private portion of
Ardmore Drive to Farms End Road, effective January 1, 1999.

A memorandum from Betsy Brockway, the STOP -DWI Coordinator,
informing the Town that the STOP DWI Policy Board has decided to
discontinue funding the aforementioned Court Assistance for the 1999
program year.

A request from the Hughsonville Fire House for the use of one (1) voting
machine for their upcoming Election on December 8th, and a request from
the Wappinger Central School District for the use of seven (7) voting
machines for a Bond Referendum to be held on December 15, 1998.

machine to the Hughsonville Fire House for December 8th, and the use of
seven (7) voting machines to the WCSD for December 15th.

Notification of intent to renew their liquor license was received from the
Twin Lakes Sportsmen Association for their "Catering Establishment Liquor

Associates, $1,500 for Ardmore Rezoning.

Associates for $1,500, base on the recommendation of the Zoning
Administrator.

Several reports from Jay Paggi, Engineer to the Town. The first report
concerns the Fishkill/Fleetwood Water connection. Mr. Paggi is in receipt of
a memo from Michael Tremper regarding the illegal use of the fire hydrant
during the restoration work of the above referenced project. It occurred after
working hours, and was not done with his offices acknowledgment and/or
inspection. Mr. Tremper is recommending that some sort of action be taken
against the subcontractor.
COUNCILMAN BETTINA moved to authorize Attorney to the Town send a
letter to the sub -contractor requesting him to compensate the district with
one truck load of water.

The next report concerns the field inspection of the Monaco Drainage at 27
Doyle Drive that Mr. Paggi conducted on October 27, 1998. His previous
May 8th 1997 recommendations are still valid, i.e. the easement should be
cleaned of all debris, the streambed cleaned to better define the channel, and
rip -rap be placed along the banks to prevent future erosion. Mr. Paggi
recommends that the Highway Department be consulted to determine if they
have sufficient time in their schedule to perform the work.
COUNCILMAN BETTINA moved to accept the report and place it on file.

Mr. Paggi presented a report on a preliminary investigation conducted
regarding the feasibility of utilizing the former Oakwood Knolls sewer
Treatment Facility site as a neighborhood park facility, that was requested
by the Mr. Ruggiero

The next report concerns the Maloney Road Culvert. In response to the
NYSDEC letter dated September 22, 1988, regarding the permit application

for the replacement of the culvert at the above referenced location, Mr. Paggi
has revised the plans in accordance with same and has re -submitted the
application on October 13, 1998.
COUNCILMAN PAOLONI moved to authorize the Supervisor to sign the
permit application.

Mr. Paggi is in receipt of a letter of transmittal from Cal Mart Enterprises
requesting the release of retainage for the Rockingham Drainage Project.
The project was completed in October 1997, but not finalized until January
1998. The reason for the delay was a contractual dispute between one of the
suppliers and the Contractor, Cal Mart Enterprises. The dispute was
resolved, and final payment was made on January 14, 1998. Cal Mart feels
that the project was completed in October 1997, and therefore the one (1)
year guarantee period has expired. He has vouchered the Town for the
remainder 3% ($31,812.59) retainage. Mr. Paggi has reviewed the request,
and finds it to be mathematically correct.
COUNCILMAN RUGGIERO moved to authorize the release of the retainage
for $31,812.59 to Cal Mart Enterprises, upon the recommendation of Mr.
Paggi, Engineer to the Town.

The final report from Mr. Paggi concerns the Proposed County Highway
Entrance on to Old Hopewell Road for a Town of Wappinger owned recreation
site. Mr. Paggi submitted three copies of a Site Plan dated October 19, 1998
detailing the entrance. It is anticipated at this time that the work will be
performed by Town of Wappinger, either through force account work or by
contract. Also submitted is a DCDPW Highway permit application.
COUNCILMAN RUGGIERO moved to authorize the Supervisor to sign the
DCDPW work permit application.

Correspondence from Tanveer Hussain of 18 Bell -Air Lane, requesting the
status of the sewer ejector station located in his front yard. He was assured
that the surrounding area would be kept neat, trimmed and in a presentable
appearance. Supervisor Smith informed the board that Mr. Tremper went
out there and trimmed all the trees as requested by Mr. Hussain.

As directed by the Board, Attorney to the Town, Al Roberts met with Craig
O'Donnell and his attorney, Jennifer Van Tuyl regarding the Shamrock Hills
Subdivision. The property is proposed to be developed in 45 residential lots.
Most of the property is located within CWWIA. Even though the property is
within CWWIA, presently there is an insufficient water supply to serve the
proposed new lots. The Board has been contemplating various proposals to
upgrade the water supply to CWWIA. However, no firm decision has been
made. When and if the Board decides on how to upgrade the water supply, it
will still take a considerable period of time before water is made available. It
is his recommendation that this be discussed at a workshop meeting.

Correspondence from Grinnell Library with a request for the Town of
Wappinger to consider an extension of the 1997 Community Development
Block Grant, due to insufficient funds to cover all costs associated with both
an elevator and a handicap accessible restroom.

Development Block Grant as requested by Grinnell Library.

Correspondence from Laurel Becker with a complaint about a dog roaming in
her neighborhood unattended. After several conversations with our Animal
Control Officer, Ann Marie Buck, she was advised to file a deposition and
drop it off at the Town Hall. The clerk who took the deposition immediately
called Mrs. Buck and was told to place it in her mailbox, and Mrs. Buck
would call her that evening. It has been two weeks, and she has heard
nothing. If she does not have a written response to this letter within thirty
days advising her that a court date has been set, she will be forced to bring
her complaint to another forum.

COUNCILMAN VALDATI informed Supervisor Smith he wished to have the
Dog Control Officer to get in touch with Miss Pamela Cortwright.
COUNCILMAN BETTINA had no reports at this time.
SUPERVISOR SMITH said she had several items. Dennis Truett of Alpert
Drive is requesting a NO TRESPASSING sign be placed where the teenagers
are congregating on the concrete wall near his home. She called the
vandalism patrol, and was informed that the area is being checked more
frequently, and he makes them move on when they are congregating.
SUPERVISOR SMITH also informed the board that Dot Schwartz was
having surgery on her knee on December 2, 1998. She plans to take 3
personal days, December 2,3, and 4th. She anticipates being out of work for
two weeks. Because she has no more sick time left, she has requested to take
the two weeks off without pay.
COUNCILMAN VALDATI moved to approve the request from Dot Schwartz
to take two weeks off without pay.

Mark Liebermann, Fire Inspector has put in a request to have his car
repaired. Highway inspected it, and it was also taken to Lee Miles. It needs
a new transmission. It will cost $1,689.00 for repairs. It's all apart at Lee
Miles, so we can't really go out to get more bids. It is an emergency situation.
COUNCILMAN RUGGIERO moved to authorize $1,689.00 for the repair of
Mr. Liberian's car.

Hammond property in Chelsea, in regard to the survey. Mr. Paggi informed
him that it has not been done yet. It will be completed by the end of the year.

he would contact the DCDPW and ask them to erect a NO LITTERING
SIGN on Osborne Hill Road.
BONDS & LETTERS OF CREDIT
Mr. Close submitted his report for the month of October on the schedule of
Bonds and Letters of Credit on the various subdivisions, the amounts,
expiration dates, and call up dates.

RESOLUTIONS
At the November 4th meeting, Assessor, Linda Tasadfoy was authorized to
research the Wallace Sheft Property in order to determine the correct Benefit
Assessment charges. Upon review of this property she found that more of
this property is usable than claimed by the petitioner. She found that there
were 19 more acres that were usable than claimed by the petitioners
appraiser. She came up with a reduction on the benefit assessment for all
usable property. She spoke with the claimants attorney and this reduction is
agreeable.
COUNCILMAN PAOLONI moved to authorize Mrs. Tasadfoy to determine
and resolve the number of benefit units and report back to the board.

Public Hearings having been held on October 4, 1998 to accept the Benefit
Assessment for the Water & Sewer Improvement Areas and Districts as
prepared by the Assessor, the matter was now placed before the Board for

for 1999 as prepared by the Assessor for the following:

A Public Hearing having been held to consider approval of the relocation of
Decision Technologies International, from 66 Middlebush Road to Amrita
Club in Poughkeepsie, the matter of its adoption was now placed before the
Board for their consideration.
The following Resolution was offered by COUNCILMAN VALDATI who
moved its adoption and seconded by Mr. Bettina.
Whereas, Decision Technologies International, Inc. (DTI) is a company
which develops and distributes specialized computer software for business
management; and
Whereas, DTI currently employs six persons and rents office space in the
Town of Wappinger at 66 Middlebush Road, Wappingers Falls; and
Whereas, DTI has experienced success and growth in the business, requiring
additional staff and office space; and
Whereas, DTI has investigated available office space within the town of
Wappinger and was unable to find suitable space at an affordable price; and
Whereas, officers of DTI are interest in historic rehabilitation and have the
opportunity to purchase the Amrita Club from the City of Poughkeepsie and
restore this prominent landmark as a distinguished headquarters for the
growing company; and
Whereas, the expanded operation will benefit the local economy as it creates
job opportunities for five additional employees without dislocating existing
employees; and
Whereas, the Town Board has heard public comments;
Now therefore, Be It Resolved that the Town Board of the town of
Wappinger consents to the relocation of Decision Technologies, International,
Inc., to the Poughkeepsie/Dutchess Economic Development Zone.

and Report for the Wappinger Sewer Transmission/Treatment Improvement
Area Phase 3A submitted by Jay Paggi, Engineer to the Town.

to be Known as Sewer Transmission/
Treatment Improvement Area No. 3A
WHEREAS, a map, report and plan, including an estimate of cost, have
been duly prepared in such manner and in such detail as has heretofore been
determined by the Town Board of the Town of Wappinger, Dutchess County,
New York Relating to the Construction of additions to the Tri -Municipal
Treatment plant and construction of a pump station and generator as well as
collector, transmission and force mains, including original furnishings,
equipment, machinery, apparatus, appurtenances, land or rights -in -land and
incidental improvements and expenses in connection therewith, to serve a
benefited area in said Town to be know as Sewer Transmission/Treatment
Improvement Area No. 3A whose boundaries shall consist of the area
specified in Appendix A as attached hereto and hereby made a part hereof, as
more fully shown upon a map on file in the office of the Town Clerk, which
map is available for inspection by any person or persons interested in same
during regular office hours at said office; and
WHEREAS, said map, plan and report, including estimate of cost, were
prepared by Paggi, Martin & DelBene, LLP, competent engineers, duly
licensed by the State of New York and have been filed in the office of the
Town Clerk of said Town, where the same are available during regular office
hours for examination by any person or persons interested in the subject
matter thereof; and
WHEREAS, the capital improvements proposed in connection with the
establishment of the Sewer Transmission/Treatment Improvement Area No.
3A of the Town of Wappinger as hereinbefore described, are at a maximum
estimated cost of $10,400,000; and
WHEREAS, said maximum estimated cost shall be authorized to be
financed by the issuance by the Town of Wappinger of its serial bonds with a
maximum maturity not in excess of the forty year period prescribed by the
Local Finance Law; and
WHEREAS, said maximum estimated cost is greater than one-tenth of one
per centum of the full valuation of taxable real property in the area of the
Town of Wappinger outside of any villages and therefor an application to the
Office of the State Comptroller for approval of establishment of said Sewer
Transmission Treatment Improvement Area No. 3A will be required; and
WHEREAS, it is proposed that the cost of the aforesaid improvements
shall be borne by the real property in said Sewer Transmission/Treatment
Improvement Area No. 3A by assessing, levying upon and collecting from the

several lots and parcels of land within such Sewer Transmission/Treatment
Improvement Area No. 3A, outside of any village, which the Town Board
shall determine and specify to be especially benefited by the improvements,
an amount sufficient to pay the principal and interest on serial bonds and
bond anticipation notes issued in anticipation of the issuance of serial bonds,
as the same become due and payable; and
WHEREAS, the aforesaid improvements have been determined to be a
Type I Action pursuant to the New York State Department of Environmental
Conservation promulgated pursuant to the State Environmental Quality
Review Act, the implementation of which as proposed, however, the Town
Board has not made a Determination of Significance pursuant to said
regulations and hereby reserves its right to make a Determination of
Significance, and will not make such Determination until the conclusion of
the Public Hearing and authorized herein; and
WHEREAS, it is now desired to call a public hearing for the purpose of
considering said map, plan and report, including estimate of cost, and to hear
all persons interested in the subject thereof concerning the same, all in
accordance with the provisions of Section 209-q of the Town Law; NOW
THEREFORE BE IT
ORDERED by the Town Board of the Town of Wappinger, Dutchess
County, New York, as follows:
Section 1. A Public meeting of the Town Board of the Town of Wappinger,
Dutchess County, New York, shall be held at the Town Hall, 20 Middlebush
Road, in Wappingers Falls, New York, in said Town, on the 14th day of
December, 1998, at 7:00 o'clock p.m., Prevailing Time, to consider the
aforesaid map, plan and report, including estimate of cost, and to hear all
persons interested in the subject thereof concerning the same and to take
such action thereon as is required be law.
Section 2. The Town Clerk is hereby authorized and directed to cause a
copy of this Order to be published once in Southern Dutchess News, and also
to post a copy thereof on the town signboard maintained by the Town Clerk,
not less than ten (10) nor more than twenty (20) days before the day
designated for the hearing as aforesaid, all in accordance with the provisions
of Section 209-q of Town Law.
Section 3. This Order shall take effect immediately.

GRAHAM FOSTER, said there were some descrepences on the center line
striping on Route 9D. We were informed there would be a NO PASSING
zone going south on 9D approaching Ketchamtown Road, and they have now
been corrected.

A Public Hearing was held by the town Board of the town of Wappinger on
November 23, 1998 at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York on the proposed relocation of Decision Technologies
International, Inc., from 66 Middlebush Road to Amrita Club in the City of
Poughkeepsie, New York.
Supervisor Smith opened the meeting at 7:25 p.m.

The Town Clerk offered for the record the Affidavit of Posting and

Supervisor Smith informed the board, that because DTI is moving its offices
to the City of Poughkeepsie which is an EDZ zone, they need our support in
order to qualify for grants when they move.
COUNCILMAN BETTINA
Andrew Healy, DTI Project Coordinator was recognized by the Board and
said if anyone had any questions concerning their intention to relocate, feel
free to ask.
COUNCILMAN RUGGIERO moved to close the Public Hearing, seconded by
Mr. Paoloni, and unanimously carried.
