COS:dly 030998.WS The Workshop Meeting of the Town of Wappinger was held on March 9, 1998 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith called the meeting to order at 7: 32 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Elaine H. Snowden, Town Clerk Others Present: Al Roberts, Attorney to the Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent Mike Tremper, CAMO Pollution Jack Peluse, Marshall & Sterling JACK PELUSE of Marshall & Sterling gave an update on the history and costs associated with Insurance in the Town. Marshall & Sterling has been handling Insurance for the Town of Wappinger for a good twenty years. He also presented a history of insurance costs from 1992-93 to 1998-99 which showed a constant decrease in premiums, due to good management. The insurance for the Town is put out to bid every year for the best rates and eleven bids were sent out this year. GRAHAM FOSTER, Highway Superintendent presented a sketch on what he feels is a concept to develop and operate the Dean Property into a recycling center for the Town of Wappinger. Five dumpsters are currently in use at the Highway Department, and this will allow for twelve. This would also allow for the expansion of the bulk recycling pick-up, if we wish to set up a program where a ticket is purchased to dispose of bulk items. You may want to go over the sketch, and offer suggestions, and then we can go from there. Next is to authorize Mr. Foster to go out to bid for the bulk wide clean up. Mr. Foster informed the Board that it takes around ten weeks, and we will definitely have to pick up this year. We must also decide what will be picked up. Supervisor Smith went over the items that would be picked up for the clean-up. COUNCILMAN VALDATI moved to authorize Mr. Foster to go out to bid for the bulk pick up and authorize Supervisor Smith to start preparing the letters to send out to residents. Seconded by Mr. Bettina Motion Unanimously Carried Next for discussion is the Multi Modul Projects. The total project cost for the Box Culvert for Regency Drive is $95,000 and the amount of funding 1 030998.WS allocated for this project is $58,144 leaving $36,856 to be funded. The total project for the Box Culvert for DeGarmo Hill Road is $90,000 and the amount of funding allocated for this project is $64,888 leaving $25,312 to be funded. The total cost to be funded for both projects is $62,168. SUPERVISOR SMITH said this money could come out of the Highway Unreserved Fund Balance. There are sufficient funds to cover these projects. COUNCILMAN RUGGIERO moved to authorize $62,168 to come out of the Fund Balance of the DB Fund and move it into these two projects, in order to move forward. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Engineer to the Town Jay Paggi to prepare the designs for each of these projects in order to go to bid. Seconded by Mr. Valdati Motion Unanimously Carried A discussion on late charges imposed on water and sewer bills. As you recall, a request was made by Turnkey operations to waive a late fee of $550. At that time Mr. Ruggiero felt that the late fee of 10% was excessive, and a workshop be held. There was a discussion, and several points were brought up for consideration, such as, a five day grace period; do not mail the late checks back; notify the home owners that check was received, and late fee added to the next bill. COUNCILMAN BETTINA moved to authorize Attorney to the Town, Al Roberts prepare a local law in regard to the late charges that were discussed at tonight's meeting. Seconded by Mr. Valdati Motion Unanimously Carried Mr. Roberts, Attorney to the Town, recommended, that once we adopt this law, a copy be sent to the Bar Association, and a copy to the local Title Company, because when property is transferred, and there are several penalties outstanding, the subsequent purchaser will be responsible for the them. Mike Tremper of CAMO gave a report on Flavormatic. Mr. Tremper read the meter at Flavormatic prior to coming to tonight's meeting, and it is averaging 600 gallons per day. Mr. Tremper said the town needs to develop some sort of rate structure not based on the size of the building. A discussion followed. COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts prepare a Local Law to change the rates to commercial for Flavormatic. Seconded by Mr. Valdati 2 030998.WS 1 ) —' Motion Unanimously Carried Mr. Tremper also informed the Board that children have pulled the man hole covers off and filled them with rocks, and CAMO has cleaned them out and tacked them down again. He was concerned that he is working on private property, and he does not know who owns the sewer line, or if we have the right of way or easement. COUNCILMAN RUGGIERO moved to authorize Engineer to the Town Jay Paggi research the sewer lines at Flavormatic. Seconded by Mr. Valdati Motion Unanimously Carried The next item for discussion is the request from Turnkey Property Management to waive the late fee. COUNCILMAN BETTINA moved to waive the late charge fee and communication be sent to Turnkey Property Management from the Supervisors office, once the Resolution from the attorney is given to the Town Board to review. Seconded by Mr. Ruggiero Motion Unanimously Carried Discussion followed. Supervisor Smith said we have not done this for others, how can we waive the late charge for Turnkey. They are prior to the new proposed law. Discussion followed, and Mr. Bettina suggested to waive the late fee to 50%. Trish Maupin, Receiver of Taxes sent the Town Board documentation of history for Turnkey Property Management which showed a history of being late. Supervisor Smith said she would get further documentation from Mrs. Maupin on Turnkey. Next is a request from the daughter of Mr. LaScolea to have a late fee of $13.52 waived. Mr. LaScolea passed away and his daughter just discovered the bill. COUNCILMAN RUGGIERO moved to waive the $13.52 late fee as requested by Mr. LaScolea's daughter. Seconded by Mr. Valdati Motion Unanimously Carried Discussion by Mr. Tremper of CAMO. Informed the Board that at 15 Brothers Road he found the curve valve in the open position. He could not find a curve valve at 33 Brothers Road, and it should be noted on 33 Brothers Road, the easement runs from Brothers Road over to Edgehill. The curve valve could be anywhere. The only way he could tell if they are hooked in is to gain access into the home and investigate the plumbing. Discussion followed. The residents at 33 Brothers Road would be given a meter and have it installed by their plumber 91 030998.WS COUNCILMAN PAOLONI moved to authorize Attorney to the Town, Al Roberts send a letter to the residents of 33 Brothers Road informing them that if they do not comply after 60 days, they will be charged double. Seconded by Mr. Bettina Motion Unanimously Carried The final item on the Agenda is the Town Water & Sewer surveys. Mr. Paggi gave a report on the cost of the survey and his recommendation. COUNCILMAN RUGGIERO moved to table the Town Water & Sewer surveys to next year. Seconded by Mr. Paoloni Motion Unanimously Carried Mr. Ruggiero on the interviews. Interviews were conducted for the ZBA tonight, when are we going to conduct interviews for the Comptroller job? Supervisor announced that she would have to place local ads first, because she did not get any results from the GOAF. Mr. Ruggiero would like to conduct interviews, hopefully by April 14th. COUNCILMAN RUGGIERO moved to authorize the Supervisor to advertise in the paper for the Comptrollers job. Seconded by Mr. Paoloni Motion Unanimously Carried At this time, 9:50 p.m., COUNCILMAN VALDATI moved to go into Executive Session to discuss personnel. The Meeting reconvened at 10:10 p.m., with all Board members present. There was no action taken at the Executive Session.
