The Workshop Meeting of the Town Board of the Town of Wappinger was
held on January 12, 1998 at the Town Hall, 20 Middlebush Road,
Wappingers Falls, New York. Supervisor Smith called the Meeting to order
at 8:10 P.M.
Present:

A presentation was made by Frank Gildea Executive Director of Sloper
Willen Ambulance. Mr. Gildea went over the services that Sloper Willen has
provided for the Town.
JENNIFER VAN TYLE discussed the conversion of the proposed Assisted
Living Facility on Route 376, what the Assisted Living Program was, and the
type of services that would be provided.
AL ROBERTS, Attorney to the Town, gave a presentation on the "'Civil
Rights Policy". As a result of an audit by Sedore, and O'Sullivan, etc., they
requested the Town adopt a Civil Rights Policy. Mr. Roberts researched the
process, and there is nothing in the law that requires the Town of Wappinger
to adopt a Policy. However, if the Federal Government provides any funding,
they require the Town to comply with their policies. As a result of the audit
one of the items to be checked is, if the Town has a formal policy of Civil
Rights. Mr. Roberts will comply with the standards that are required by the
auditors and bring it back to the Board on January 26 for their decision.
Next is to introduce the Local Law Exempting the Residency Requirements
for the position of Building Inspector.
The following resolution was moved by Councilman Valdati and seconded by
Councilman Bettina.
WHEREAS, the position of Building Inspector for the town of
Wappinger is vacant;
WHEREAS, pursuant to Section 23 of the Town Law of the State of
New York, the position of Building Inspector is an office requiring the
officeholder to be an elector of the Town; and
WHEREAS, the Dutchess County Civil Service Department has
provided the town with a list of eligible candidates to be appointed to the

position of Building Inspector and only one of those eligible candidates is a
resident of the Town; and
WHEREAS, the eligible candidate who is a resident of the Town has
declined said position; and
WHEREAS, in accordance with the authority granted to other
municipalities by the New York Legislature in Section 23.3 of the Town Law
and Section 3.17, 3.18 and 3.22 of the Public Officers Law, which sections
permitted certain Towns to appoint non-residents to the position of Building
Inspector, a Local Law may be adopted by the Town Board of the Town of
Wappinger to effectuate an exemption of such residency requirement
pursuant to the provisions of the Municipal Home Rule Law; and
WHEREAS, Section 10 of the Municipal Home Rule Law specifically
authorizes the Town Board of the town of Wappinger to adopt a Local Law
authorizing a similar exemption from the aforesaid residency requirement;
and
WHEREAS, the Town Board has determined that it is in the best
interests of the welfare of people of the town of Wappinger to permit
qualified, experienced and competent, albeit non-residents of the Town, to be
appointed to the position of Building Inspector in the Town of Wappinger.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The Town Board hereby introduces for adoption Local Law #_ of
the Year 1998 in the form annexed hereto.
2. The Town Board hereby determines that the proposed action, that
is the introduction of the aforementioned Local Law, is no an action
that may affect the environment, and, accordingly, the Town Board
hereby expressly determines that his action is not an action that
requires review pursuant to the provisions of the New York State
Environmental Quality Review Act (SEQRA) or pursuant to Local
Law #6 of 1992 or pursuant to 6 NYCRR Part 617, and that no
formal environmental review is therefor required because the
adoption of this Local Law will have absolutely no effect upon the
environment.
3. The Town Board hereby schedules a Public Hearing on the
proposed adoption of Local Law #_ of 1998 to be held at the Town
Hall, 20 Middlebush Road, Wappingers Falls, New York on the 9th
day of February, at 7:25 o'clock p.m., and that the Town Clerk be
directed to post and publish notice of the Public Hearing in form
annexed hereto.
The question of the adoption of the foregoing Resolution was duly put
to a vote on roll call, which resulted as follows:

Next is a discussion by Jay Paggi, Engineer to the Town and Mike Tremper
of CAMO Pollution, on the Wappinger Park Water.
COUNCILMAN VALDATI moved to authorize Mr. Tremper to send a letter
to the residents of the Wappinger Park Water District and informing them of
the options that were discussed.
Seconded by Mr. Bettina
Motion Unanimously Carried
Mr. Paggi was requested to draft a letter on October 3, 1997 to Karl Weed of
the DEC on the proposed Wappinger Park Water/Route 9 project. Mr. Weed
contacted Mr. Paggi and requested additional information and/or drawings
with regard to their proposed water line extension in the area of Hark Plaza
and Route 9 in Wappingers Falls. Until this information is received and
reviewed, a meeting to advise the Town would be fruitless.
COUNCILMAN VALDATI moved to authorize Jay Paggi, Engineer to the
Town, to send the additional information and/or drawings, as requested by
Mr. Weed.
Seconded by Mrs. Smith
Motion Unanimously Carried
At this time, 9:35, Supervisor Smith advised the Board that she wished to go
into Executive Session to discuss the Hilltop Well production and the
Fleetwood Contract with the Village of Fishkill.
COUNCILMAN VALDATI moved to go into Executive Session, seconded by
Mr. Bettina.
Motion Unanimously Carried
The Town Board returned from Executive Session with all Board members
present. There was no action to be taken at the Executive Session.
COUNCILMAN BETTINA moved to close the Town Board Meeting,
Seconded by Mr. Valdati and Unanimously Carried.
The Meeting closed at 11:07 P.M.

A Public Hearing was held by the Town Board of the Town of Wappinger, on
January 12, 1998 at the Town Hall, 20 Middlebush Road, Wappingers Falls
New York in the Matter of the Increase and Improvement of the Facilities of
the Fleetwood Water District in the Town of Wappinger.
Supervisor Smith opened the Meeting at 7:10 P.M.

The Town Clerk offered the Affidavit of Posting and Publication duly signed
and notarized. (These Affidavits are attached hereto and made part thereof
of the Minutes of this hearing.
Supervisor Smith announced that the purpose of tonight's hearing is to give
the residents a presentation on what the Town feels would be the solution to
the water problems for the Fleetwood Water Resident. We are hoping to do
something to help you by the end of this year. After the presentation, all who
signed up to speak will get a chance to be heard.
AL ROBERTS, Attorney to the Town spoke and informed the residents that
the Town Board has determined that the most cost effective alternative and
by far the most practical, is by the connection to the Village of Fishkill Water
System. Mr. Paggi, Engineer to the Town will explain the technical aspects of
this proposed connection, and Mike Tremper of CAMO Pollution will discuss
the practical benefits of the new water supply.
JAY PAGGI, Engineer to the Town went over the plans for the proposed
connection to supply the residents of Fleetwood Water District to the Village
of Fishkill with water. Mr. Paggi explained that there would be 187 units
within the district that go to defray the cost. During the past few years, the
supply from the existing wells have been decreasing and two years ago it got
to the point were the production could not meet the average daily needs of
the district. Water was being trucked in 1995, 1996, and 1997. That method
to supply the district was not economical. Various alternatives were studied,
and after months of study, it appeared that the connection to the Village of
Fishkill was the most cost effective way of supplying this water. Mr. Paggi
described the route of the proposed water connection to the residents. The
existing water plant that is at he bottom of Fleetwood Drive can be

abandoned. It would no longer be needed, and would serve no useful
function. It must be abandoned according to Health Department Codes.
All the old meters would be replaced, and the total cost would be $740 K. The
Serial Bonds would be for twenty years at 5.4% at a cost of $372 per unit and
reduces every year and the debt repayment reduces to $250 on the last year.
The cost of the water will be $10.72 per cubic foot and will cost approximately
$48K per year to run. Between $43-$48 K has been budgeted for this.
MIKE TREMPER of CAMO Pollution gave a report on the trucking of water
for the past few years. The wells have depleted to a point where they don't
seem to be filling up, even with the wet weather. The water we will be
obtaining from the village has less hardness. We will also be able to flush
the hydrants. Mike Andriella of Fleetwood Drive wished to know where the
funds would come from. What is going to happen to the budget. You told us
we were going to be $7000 over budget for 1997, and we are only allotted
$10,000 for 1998. SUPERVISOR SMITH said its hard to give an answer at
this time. Now that we foresee this, we can correct it in the next budget.
Mr. Paggi explained, what we are hoping for, is the project be completed at
such a point during the calendar year 1998, that the necessity for trucking
water will not be there. Ken Duxberry of Barbara Lane asked what the
minimum amount he pays for usage is right now. Mr. Tremper said 14,143
gallons is the minimum, and $48.60 is the minimum charge for three months.
Mr. Hartman wished to know if the billing formula would remain the same.
Engineer to the Town, Jay Paggi answered, it will all be determined by
usage. Also questions arose regarding the easements. SUPERVISOR
SMITH answered, we don't have them yet, but we will have no problem
obtaining them. Mrs. Mayerhofer of Barbara Lane wish to know if the
Condos have meters. Mr. Tremper said that the Condos have three master
meters, and the condos are charged the same as the houses. Mr. Schwartz
wished to know if this has gone out to bid yet, and Mr. Paggi answered, no,
until the Public Hearing and the amount to be raised by Bonds is authorized
by the Town Board, no work can be started. SUPERVISOR SMITH informed
the residents that all kinds of applications for Grants for this project have
been made. Resident Jerry Schutter felt he was speaking on behalf of all the
residents in the room, they do not wish to spend any more money than they
have to, and in his opinion he does not see any other option. We have to go
the best route, which this is. Get on with it, so we can have some decent
water. Asked when the Town would get started, Supervisor Smith answered,
we must go out to Bond first, and will vote on this on the 26th of January.
There was no other questions or comments, Supervisor Smith thanked all the
