The Regular Meeting of the Town Board of the Town of Wappinger was held
on September 22, 1997 at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York. Supervisor Smith called the Meeting to order at 7:30 P.M.

MINUTES
The Minutes of the Regular Meeting of August 25, 1997 and Bi -Monthly
Meeting of September 8, 1997 having previously been forwarded to the Board
Members, were now placed before them for their consideration.
COUNCILWOMAN VISCONTI moved that the above stated Minutes as
presented by the Town Clerk, be and they are hereby approved.

At the August 25th 1997 meeting, approval was given by the Town Board,
based on recommendations of Engineer to the Town, Jay Paggi, and
Lawrence Paggi, Engineer for the applicant of Maiolo Subdivision, to allow
an open drainage ditch to remain in its existing state and only pipe the
easement to the rear lots. At this time COUNCILMAN RUGGIERO wished
to have the correspondence from, Jay Paggi, Engineer to the Town and Larry
Paggi, applicants engineer to be incorporated into the August 25, 1997
Minutes, verbatim.
COUNCILWOMAN VISCONTI moved to accept the August 25th minutes
and with the inclusion of Mr. Ruggiero's request to attach both
correspondences, as submitted by Jay Paggi and Lawrence Paggi.

Reports for the month of August were received from the Building Inspector,

PETITIONS & COMMUNICATIONS
Correspondence from Joanne Vazquez and Nancy Savidge requesting the
Town of Wappinger consider the development of a swimming facility for
Town residents.
COUNCILWOMAN VISCONTI moved to direct Ralph Holt, Chairman of
Recreation resurrect all previous studies pertaining to a swimming facility
for the Town, to present at a workshop.
Seconded by Mr. Bettina

Correspondence from Judith Webb of 23 Pleasant Lane in regard to the
problems due to the snow removal that have occurred throughout the years.
During the past few years, snow has been pushed down Pleasant Lane and
dumped directly in front of her mailbox, and on several occasions have had 4
to 5 feet of snow plowed in front the mailbox. Mrs. Webb waited until the
end of the storm for the snow to be removed, but the snow would sit there
until they called. They were told if they moved the mailbox the problem
would be solved. They moved the mailbox, and the plow dug up the front
yard killed one tree, and damaged two others. Ground plants have also been
uprooted. She called Highway, and they said they were conducting Spring
clean up, but they would take care of the damage. Highway has been called
on several occasions to correct the problem. Winter will soon be here, and
nothing has been done. Any assistance will be appreciated. MR. FOSTER
explained to the Board, that Pleasant Lane is an old cul de sac, from many
years ago, its very small, approximately 50' wide, with two driveways going
off it, with a sidewalk in front of the Webb property. There is just no place to
push the snow. To the best of his knowledge there not putting the snow any
place different for the past 30 years. The trees in question, he believes were
brought down by the heavy ice storm in April. He does not know what to do.
There are no options. When asked if the Snowblower that Highway had in its
possession could be used to redirect the snow, Mr. Foster explained, that
there was no place to put it. Also, it would not be practical. It would take
two hours to hook up the Snowblower, a loader would have to be disabled,
and then, there would be no place to direct it. Highway does the best they
can not to pile snow in front of the driveway. He spoke to Mrs. Webb on
several occasions. Mr. Foster presented a copy of the property layout to
each of the Board Members. He did seed and rake the sod. Other than that,
there is not much more he can do.

COUNCILMAN BETTINA moved to accept the correspondence and place it
on file, and authorize Mr. Foster to contact resident to discuss, and dispatch
written account to Board.

Zvi Segal, President of Z & M Development Corp. with a request for the
Board to accept the easements in connection with the Dedication of Extension
of Sherwood Heights Road. Recommendations were received from the
Highway Superintendent, and Engineer to the Town, Jay Paggi to accept.
COUNCILWOMAN VISCONTI moved to accept the Performance Bond and
Letter of Credit as security for the extension of Sherwood Heights Road, the
easements to be recorded, and authorize the Supervisor to sign.

At this time Renata Poggi was recognized by the Board, and wished to know
the time frame when a building permit may be obtained to build a house on
Sherwood Heights Road. She has a client that has contracted a home to be
built. Mr. Roberts, Attorney to the Town replied, some time this week.
Some minor items must be corrected and recorded at the County Clerks
office.
A request was received from Don Close, Zoning Administrator for permission
6w for Howard Prager, Al Lehigh and Jerry diPierno, Zoning Board Members,
and Chris Simonetty, Hugh Musto, George Grimshaw, Mike Franzese, Phil
DiNonno, Planning Board Members, Building Inspector, Charles Ricotta, and
himself, to attend the Dutchess County Planning Federation Cellular
Communication Workshop, to be held on September 23, 1997 at the Farm &
Home Center in Millbrook. Mr. Close is also requesting permission to attend
the 1997 NYPF Annual Conference on Monday, October 27, 1997, in
Saratoga Springs. Also, Zoning Board Member, Al Lehigh requests
permission to attend the conference from October 26th through October 29th
(three nights).
COUNCILMAN Bettina moved to approve the request for all of the above
Planning Board Members, Zoning Board Members, Building Inspector,
Zoning Administrator, Councilman Ruggiero and Attorney to the Town, Al
Roberts to attend the Cellular Workshop, and to approve the request for Mr.
Close and Mr. Lehigh to attend the 1997 NYPF on the days requested, and
their legitimate expenses charged to the Town.

A report from Jay Paggi, Engineer to the Town regarding the request from
Martin R. Simonds to hookup into Town Sewer and Water lines located at the
intersection of Brown Road and All Angels Hill Road. After researching the
request, Mr. Paggi informed the Board that the work would need to be
designed by the Applicant's Professional, and approved by his office, and final
construction would need to be inspected by CAMO Pollution. With his report,
Mr. Paggi enclosed maps which gave greater detail to the request.
COUNCILWOMAN VISCONTI moved to accept the report and place it on
file, and send a copy of same to Mr. Simonds.

Two update reports from Michael Tremper, CAMO Pollution Control, Inc.
The first report concerns the severe flow spikes occurring at the Rockingham
Farms Sewer Plant that services Flavormatic. CAMO has concluded that
these flow spikes are the result of an electronic malfunction within the flow
meter. His personnel on staff during the night hours, have not witnessed any
changes in flow during the flow meter spiking. CAMO is currently working
with the manufacturer to resolve these electronic interference problems and
will, most likely, have the problem resolved in a short time. To clarify, there
have been no changes in the influent flows which have caused these flow
spikes.
COUNCILMAN VALDATI moved to accept the report from Mr. Tremper on
the Rockingham Sewage Treatment plant flows report, and place it on file.

The second report concerns the monitoring of the Fleetwood Water supply.
CAMO has been monitoring the Fleetwood Water supply since the early part
of the summer of 1997. The hot dry summer caused concerns for water usage
throughout the Town, especially Fleetwood Water District. Mr. Tremper
reported that 312,000 gallons of water were trucked to Fleetwood to
supplement the well fields at a cost of $7,540. The amount budgeted for
1997 was $10,000. CAMO will continue to monitor and keep the Town
informed.

Water and place it on file.

Matthew D. Rudikoff Associates, Inc. has enclosed for review, two (2) copies
of the Stage 1B Resources Survey completed buy Archeologist Michael
Gimigliano, PhD of Environmental Consulting Associates which was

prepared as part of the SEQR review of the Town of Wappinger Phase 3A
Sewer Improvement. Since the Town has a separate contract with Mr.
Gimigliano, an invoice from Cultural Sources Survey will be sent directly to
the Town of Wappinger.
COUNCILWOMAN VISCONTI moved to accept the survey report and place
it on file pending the decision on Phase 3A.

Next is CHIPS correspondence from Senator Stephen Saland, Assemblyman,
Joel Miller, and Lawrence M. Knapek, Assistant Commissioner Office of
Budget and Finance for New York State. The Town was informed that the
Approved State Budget includes a $265.7 million Consolidated Local Street
and Highway Improvement Program (CHIPS) for SFY 97-98, and under the
Capital reimbursement portion of CHIPS, the Town of Wappinger will
receive a SFY 97-98 Capital apportionment of $76,834.87.

on file.

Correspondence from Walter Leczinski of 17 Cider Mill Loop requesting
someone look into the deteriorating driveway leading into the Water Tower
off Cider Mill Loop. He recently cleaned up all the deteriorated blacktop on
this driveway, and spoke to CAMO Pollution Control, who stated it was the
Town's responsibility. Over the years Mr. Leczinski has repaired the
driveway where it meets the road, but feels whomever is responsible to repair
it correctly.
COUNCILWOMAN VISCONTI moved to refer Mr. Leczinski's request to Mr.
Foster, Highway Superintendent.

A request from our new Assessor, Linda Tasadfoy for permission to attend
the New York State Assessors Conference from October 5th to October 8th at
the Concord Hotel in Kiamesha Lake. This is a required seminar to maintain
her advanced certification with the State of New York.
COUNCILWOMAN VISCONTI moved to approve the request of Linda
Tasadfoy, to attend the Annual New York State Assessors Conference from
October 5th to October 8th, 1997 at the Concord Hotel in Kiamesha Lake, and
her legitimate expenses to be a Town charge.

Correspondence from Jim Hammond, County Legislature regarding two
resolutions being considered by the County Legislature at the September
meeting, which may be of interest to the Town.
The first resolution is in support of the Veterans Hospital at Castle Point and
the Veterans Administration Medical Center at Albany to remain open with
complete Services for Area Veterans.
COUNCILWOMAN VISCONTI moved to authorize the Town Clerk send a
letter stating the Town of Wappinger is in full support of the Veterans
facilities remain open with complete services for Area Veterans.

The second resolution being considered pertains to the reconstruction of an
Aircraft Hangar Roof at the Dutchess County Airport.

COMMITTEE REPORTS
COUNCILMAN RUGGIERO on the Codification. At last months meeting Mr.
Ruggiero was appointed to be the contact person. He spoke with the editor
in Albany who will be handling Codification. What they asked for was the
draft of the pre -approved Zoning Ordinances that was performed by Clark
Associates last year.
COUNCILMAN VALDATI on Highway. Reported that everything seems to
be going fine at the Highway. The Roads seem to be in fairly good shape and
we are gearing up for a good winter.
COUNCILWOMAN VISCONTI commended Mr. Foster on the great job that
was done on Diddell Road. The residents are very pleased. Hopefully we will
be able to do the same thing next year with Maloney Road. Mr. Foster said
the remainder of the work will be done in the off season. While we are still
discussing HIGHWAY, Mr. Foster advised the Board that something would
have to be done with the Dean Property. He has stripped much of the
vegetation and would like to get it functional before the winter season sets in.
He would like the Board to come up and take a look at the property, so we
may set up a proposed plan.
COUNCILWOMAN VISCONTI had no reports at this time.
COUNCILMAN BETTINA had no reports at this time.
SUPERVISOR SMITH announced that "Goodwill Industries" will be opening
on Thursday, September 25th at 9:45 A.M., and everyone is invited to attend.

At this time the Board Recognized Hank DiMarco who gave a short
presentation on the Wappinger Greenway Trail and requested the Board act
on a resolution supporting a grant application under the Clean Water/Clean
Air Bond Act for the Hudson River Valley Greenway Project. The Bond Act
provides assistance towards the cost of any project, not to exceed 50% of the
approved project's costs. A sample resolution to authorize an application for
funds was read by the Town Clerk, and given to Al Roberts, Attorney to the
Town to examine. The Board made recommendations for Al Roberts, Attorney
to the Town to prepare a resolution for the support of the Greenway Trail,
however the facts were not clear enough to act on the proposal this evening.
SUPERVISOR SMITH moved to table the request to a Special Meeting on
September 29th at 4:45 P.M.

BONDS AND LETTERS OF CREDIT
Mr. Close, Zoning Administrator, submitted his report for the month of
August on the schedule of Bonds and Letters of Credit on the a various
subdivisions, the amounts, expiration dates, and call up dates.
There was some discussion on Nicole Farms. The Letter of Credit and
Maintenance Bond were about to expire on 10/1/97 and had not been
renewed.
COUNCILWOMAN VISCONTI moved to authorize Supervisor Smith to call
up the Performance Bond and Maintenance Bond if the Letter of Credit was
not renewed.

For the Boards information, Mr. Foster informed the Town Board that a
meeting was held with the County on the realignment of All Angels Hill and
Kent Roads. As you know, it's a very dangerous County/Town intersection.
The County is going to propose a modified change to the intersection, but not
the one that was adopted by the Planning Board. Mr. Nichols was supposed
to get back to Mr. Paggi sometime today, so we would have some information
for the meeting tonight, but Mr. Paggi has not heard from him. Mr. Paggi
told the Board that he was contacted to attend a meeting with the County

last Thursday. They informed Mr. Paggi that they wished to make some
changes in the Plan that was approved by the Planning Board, and he told
them that he did not have the authority to approve the changes. There was a
Plan that was approved, and bonded, and that bond is going to run out, but
he would support the changes.
RESOLUTIONS
Next for the Boards consideration is to direct the Assessor, Linda Tasadfoy to
prepare the Benefit Assessment Rolls for all the Water and Sewer
Improvement Areas and Districts.

moved its adoption, and seconded by Mr. Bettina.
RESOLUTION DIRECTING ASSESSOR
TO COMPLETE ASSESSMENT ROLL FOR
ARDMORE WATER IMPROVEMENT
The Town Assessor is hereby authorized and directed to prepare an
assessment roll for the ARDMORE WATER IMPROVEMENT AREA in
accordance with the following standards:
1. All property within the benefit area shall be assessed.
2. The formula for such assessment shall be as follows:
a. A single family house on a lot of less than two acres - one benefit
unit. Where acreage over two acres - .2 benefit unit for each acre or
part thereof over two acres.
b. Vacant residential land less than two acres - .8 benefit unit.
c. Residential acreage in excess of two acres - .8 benefit unit for the
first two acres, .2 benefit unit for each acre in excess of two acres.
d. Multi -family residential units - .75 units per residential dwelling
unit.
e . Industrial, commercial, institutional and exempt properties shall
be assessed by computation whereby the assessed valuation shall be
computed in relation to the valuation of all property within the benefited
area and a benefit unit assigned in accordance with the ratio which the
subject property bears to the total assessed valuation within the benefited

UNFINISHED BUSINESS
Correspondence from Michael Gimigliano, of Environmental Consulting
Associates that he has recently been informed by Rudikoff Associates that his
report from Spring of 1997 on the Stage IB Cultural Resources Study, for the
Town of Wappinger Sewer Improvement, had just been forwarded to the
Town of Wappinger. No invoice had been sent to the Town on his behalf.
Accordingly, Mr. Gimigliano has enclosed his invoice on the agreed price of
$4,000.
COUNCILWOMAN VISCONTI moved to authorize payment of $4,000
payable to Environmental Consulting Associates, for the Stage IB Cultural
Resources Survey for the Town of Wappinger Sewer Improvement Area.

Additional Correspondence from Arlene Cole of 4 Scott Drive satisfying her
thirty day obligation to notify the Town that there are rats living in the
easement trench that runs through Rockingham Farms where it borders her
property. She is notifying the Town if Town workers do anything to disturb
the nesting areas of these rats to migrate onto her property, she will hold the
Town responsible for this occurrence and will expect the Town to pay for any
damages to her property, including any expenses that the may occur in the
course of eradicating the rats from her property.

place it on file.

At the Meeting of September 8th, Chelsea Fires District requested the Town
to consider changing the names of two roads in Chelsea. At that time Mr.

Foster Highway Superintendent reminded the Board that the roads in
question were County Roads, and the Town has never accepted them. Mr.
Foster and Mr. Bettina were asked to look into this. After speaking to Mr.
Stella, of DC Highway, he told Mr. Foster that County Route numbers are
established by the County and they will remain the same. The local names
comes under the jurisdiction of the Town.
COUNCILMAN BETTINA moved to authorize Supervisor Smith send letters
to Chelsea Fire Company and all the residents, to set up a workshop to
discuss.

NEW BUSINESS
Correspondence from Jim and Barbara Whalen, of 4 Carroll Drive,
requesting Town assistance, due to unsafe conditions created by the eroding
soil on the easement adjacent to their home. They believe this occurred when
the Town widened the creek several years ago. They spoke to Mr. Foster,
Highway Superintendent who in turn contacted Mr. Paggi, Engineer to the
Town. They both feel it is a problem that needs to be remedied.
COUNCILMAN RUGGIERO moved to authorize Engineer to the Town Jay
Paggi, survey property first, to see where the easements are, and present a
permanent recommendations to the Board. If an emergency condition exits,
authorize Highway to do temporary work.

Last year, the Hughsonville Fire District asked the Highway to sand their
parking lot and facilities, as needed. The other fire districts, as needed if
they requested it. Mr. Foster was asked to sand again this year.

the fire districts informing them that if they need sanding, the Highway
Department will again sand their parking lot and facilities, as needed.
